As a homeowner in Cobble Creek which will be affected a great deal by the subdivision
of the 9.2 acres fronting our development off 304'' Street I object to some of the
assumptions in the permit application. I have lived here for nearly 12 years and the
hillside adjacent to our driveway 106'` Avenue is constantly wet and drains into Cobble
Creek which is a tributary of the Green River and is a protected salmon spawning area.
Of the proposed mitigation measures there appears to be a lot of emphasis on reports and
operation & maintenance programs; but, very little in terms of what the on-site storm
drainage facilities will be to alleviate the effects of developing on a severely -sloped wet
drainage area.. I believe this development directly affects the stability of our driveway
(106'' Avenue) to Cobble Creek and the capacity of the culvert to handle the additional
drainage especially during the winter. I also believe there will be more than temporary
impacts to more than 500 sf of wetlands and crossing Cobble Creek. How do they
propose to construct this waterline and still allow access and egress from Cobble Creek?
I do not believe you can issue a Mitigated Determination of Non -Significance and allow
this development to take place based on all the outstanding environmental issues and
impacts not clearly addressed or by mitigation measures that are too general in nature and
not specific enough. Everything in the Proposed Mitigation Measures disturbs me like
"What Cultural and Historical considerations?", "Lot Line Adjustment?", "Approved
automatic sprinkler system for structures on Lots 1 and 6" — Does this mean there is not
enough side yard setback from the houses in Cobble Creek.-

RE: Highlands at Cobble Creek
Dear Mr. Krauss:
On behalf of the Cultural Resources Committee, I have reviewed the information sent on
07/15/04 regarding the Highlands at Cobble Creek Project and have the following comments. The
Highlands at Cobble Creek property is an area the Tribe has flagged as high potential for
archaeological discovery. There is a recorded archaeological site within one mile of this project.
Information regarding previous surveys and recorded archaeological sites is available from the
Office of Archaeology and Historic Preservation, in Olympia.
Due to the project's ground disturbing activities and the potential for archaeological
discovery, the Cultural Committee is requesting:
1. An archaeological field study of the project APE by a professional archaeologist.
2. To review the archaeological survey's scope of work
3. The option of sending a tribal monitor during the field survey
4. To review the draft survey for completeness and accuracy
5. An Action Plan in place in the event that human remains or artifacts are uncovered
during construction
6. A copy of the final technical report for our files
The Cultural Resources Program does not represent the Wildlife Program and the
Fisheries Program which are separate departments under the Muckleshoot Indian Tribe. Please
contact these departments separately for their input on this project.
We appreciate the effort to coordinate with the Muckleshoot Tribe prior to site
preparation. The destructive nature of construction excavation can often destroy a site and cause
delays and unnecessary expense for the contractor. If you have any questions, please contact u e

Dear Mr. Krauss:
We have reviewed the materials. forwarded to our office for the proposed project referenced
above.
The area has the potential for archaeological resources; there are many Native American
ethnographic place names associated with the vicinity and an archaeological site is located
within one mile of the project area. Because the large scale activities of the project area would
disturb or destroy any archaeological sites present, we recommend a professional archaeological
survey be required of those areas proposed for any excavation prior to ground disturbing actions
to determine if any sites are present and to recommend mitigation measures. We also
recommend consultation with the concerned tribes cultural committees and staff regarding
cultural resource issues.
These comments are based on the information available at the time of this review and on behalf
of the State Historic Preservation Officer. Thank you for the opportunity to comment on this
project and we look forward to receiving the survey report.

I have discussed the Archeological Survey Request with representatives
from both the Muckleshoot Indian Tribe and the Office of Archeological
and Historic Preservation. All three parties have reached a consensus
that a condition attached to the building permit for Highlands at Cobble
Creek will satisfy the documented concerns. The text of the condition
will read as follows:
"Prior to the disturbance of any onsite soils, the applicant will
commission a state licensed archeological survey that includes
recommendations for the treatment and/or mitigation of any cultural
resources found in the project area. A copy of that report shall be
provide
to OAHP, the City and the Muckleshoot Tribe upon its completion. The
applicant shall demonstrate to the city of auburn that the survey
recommendations have been addressed prior to commencement of any
permitted activities."

Thanks for returning my call yesterday afternoon.
As we discussed, our project team will need to forward your written
approval of the survey condition on our building permit to the City of
Auburn. The texts of the specific condition as well as an approval from
the Muckleshoot Cultural Resources Program are contained in this email
thread. Please review the condition and respond at your earliest
opportunity.

Thank you also for the conversation this morning, and I would be happy
to help further or answer any other questions you may have. I agree
with the condition statement below, and appreciate the thoroughness of
your commitment to addressing cultural resources in your project area.
I understand from our conversation that you are not willing to permit
tribal monitors to join the archaeological survey for the project, and I
agree to your decision. I will take the project information that I have

received from the City of Auburn and will present it to the Tribe's
Cultural Committee to see if they can or wish to provide any specific
comments about past Muckleshoot use of or knowledge about your project
area. If so, I will contact you and ask permission to contact your
archaeologist to include their comments in the final cultural survey
report. Additionally, I would appreciate a phone call if your
archaeologist finds anything 'in the survey, and of course, in the
unlikely and unfortunate event that they find human remains, the
protocol is to call the King County Coroner first, the Office of
Archaeology and Historic Preservation as well, and affected Tribes for
disposition consultation if the coroner determines the remains to be

Laura,
Thanks for our discussion this morning. We will do our best to address
the tribe's concerns while staying within the parameters of the City of
Auburn's development process. I spoke to the city planner that is
managing our project, Jeff Dixon, and explained what you and I briefly
discussed and he feels it will satisfy any state or city requirements.
As I mentioned on the phone, we will attach a condition to our building
permit that must be fulfilled before we are able to break ground on any
clearing or grading sitework. The condition will read as follows:
