Background Summary: The residence located at 2107 Riverview Drive NE in the City of Auburn, Washington, has a long history of nuisance code violations. There have been complaints regarding the condition of the property from other residents in the area. The property constitutes a public nuisance because of the owner's failure to control and clean up litter, debris and junk. Several attempts were made to contact the property owner but were met with negative results. A formal Notice to Correct Violation was posted on the property and sent to the owner of record on August 10, 2004. The property owner was given until August 15, 2004, to correct the violations or face civil enforcement action. No abatement has been done. The Code Enforcement Officer has written numerous civil infractions to the owner. The owner has failed to respond and the Court has fined the owner. In spite of this, the owner has continued to allow the nuisance to exist and has failed to take any remedial actions. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, HEREBY RESOLVES as follows: Resolution 3825 February 7, 2005 Page 1 Section 1. FINDING OF NUISANCE. That the City Council finds that the junk, litter, and debris at the property located at 2107 Riverview Drive NE, Auburn, Washington, constitutes a nuisance warranting corrective action necessary to preserve the public health, safety and welfare, and that the property owner has failed to take corrective action after due notice of the problems and concerns caused by Amy Lynn Freeman (owner) at the property located at 2107 Riverview Drive NE, Auburn, Washington. A copy of recent notices, correspondence and photographs concerning the nuisance is collectively identified as Exhibit "A" attached hereto and incorporated herein by this reference. Section 2. AUTHORIZATION FOR ABATEMENT AND LIEN. That The Mayor or designee is herewith authorized to utilize City resources to correct and abate the nuisance conditions at said property, and to have a lien placed on said property to recover the City's cost of labor and materials. You failed to respond and the Court assessed a fine of $9,000.00 for this violation. On October 5, 2004, you were served with a Notice of Infraction under Auburn Municipal Code 8.12.020 again for failure to remove litter and debris and junk from your yard and driveway. You failed to respond and the Court assessed a fine of $3,500 for this violation. On October 12, 2004, you were served with a Notice of Infraction under Auburn Municipal Code 8.12.020 again for failure to remove litter and debris and junk from your yard and driveway. You failed to respond and the Court assessed a fine of $2,000 for this violation. On November 19, 2004, you were served with a Notice of Infraction under Auburn Municipal Code 8.12.020 again for failure to remove litter and debris and junk from your yard and driveway. You failed to respond and the Court assessed a fine of $9,050.00 for this violation. To date, you have failed to clean up your property and/or remedy any of the problems addressed by the various infractions. As I am writing this letter, the violation continues and the potential fines are mounting. I must warn you that if you continue to ignore the City's request to clean up your property, we will be forced to take further action. Please be aware that if you do not clean up your property or make. alternative arrangements with the City's Code Compliance Office within ten days of the date of this letter, the City may issue a criminal nuisance citation to you pursuant to RCW 9.66.030. A violation of RCW 9.66.030 is a misdemeanor and you may therefore be subject to a fine of $1,000.00 and/or 90 days in jail if you continue to Ignore the City's request to clean up your property. AUBURN * MORE THAN YOU IMAGINED Ms. Amy Freeman January 20, 2005 Page 2 of 2 You should also be aware that the City is considering filing a lawsuit against you in Superior Court which would request that the Court grant the City an order allowing the City to go on your property and clean it up as well as a judgment against you for the full amount of any clean up costs and outstanding infractions. Any judgment obtained by the City would be collected by foreclosure upon your property if necessary. In light of this, I believe that it would be in your best interest to clean up your property within ten days from the date of this letter, and/or contact Mr. Mike Dunbar with the City's Code Compliance Department, in order to make arrangements satisfactory to the City. It may be that you could sign an agreement with the City that would allow the City to clean up your property in exchange for a lien against your property for the cost of the clean up as well as any infractions that remain unpaid. If this solution is of interest to you, or you wish to discuss this matter, please do not hesitate to contact Mr. Dunbar or myself. However, please do not be slow to clean up your property and/or contact the City in order to make alternative arrangements as the City fully intends to take criminal and civil action against you to ensure the clean up of your property as soon as possible.
