Lewis called the meeting to order at 7:30 p.m. and led those in attendance in the Pledge of Allegiance. B. Roll Call Mayor Lewis and the following Councilmembers were present: Rich Wagner, Sue Singer, Gene Cerino, Nancy Backus, Bill Peloza, Roger Thordarson, and Lynn Norman. Staff members present included: Planning & Community Development Director Paul Krauss, City Attorney Daniel B. Heid, City Engineer Dennis Selle, Police Chief Jim Kelly, Human Resources/Risk Manager Brenda Heineman, Fiscal Services Manager Craig Violante, Information Services Director Lorrie Rempher, Fire Chief Russ Vandver, Parks and Recreation Director Daryl Faber, and City Clerk Danielle Daskam. C. Announcements and Appointments 1. Announcements a) Proclamation – Auburn Family Week Mayor Lewis presented a proclamation declaring March 20-26, 2005 as Auburn Family Week in the City of Auburn to Auburn Family Week Chairman Julie Molen. Ms. Molen was accompanied by Co-chair Alice Dean, Family Time Chairman Sindye Uhler, and Holly Fletcher. Page 1 City of Auburn Council Meeting Minutes February 22, 2005 Mayor Lewis thanked Ms. Molen for her efforts related to the implementation of Auburn Family Week. Ms. Molen thanked Mayor Lewis and Councilmembers for City of Auburn support and sponsorship of Auburn Family Week. 2. Appointments There were no appointments for Council consideration. D. Agenda Modifications There was no agenda modification. II. CITIZEN INPUT, PUBLIC HEARINGS & CORRESPONDENCE A. Public Hearings No public hearing was scheduled for this evening. B. Audience Participation This is the place on the agenda where the public is invited to speak to the City Council on any issue. Roxanne Bangus, 3435 Auburn Way South, Unit 31, Auburn Ms. Bangus stated that she is a Sociological Doctorate student. Ms. Bangus expressed her desire to volunteer her services to the City of Auburn to strengthen cultural communications. Ms. Bangus also expressed a desire to form a committee to assist Native Americans, people of diversity, and the City of Auburn with regards to alternatives to incarceration. C. Correspondence No correspondence was received. III. COUNCIL COMMITTEE REPORTS A3.7.6 A. Municipal Services Chair Cerino reported that the Municipal Services Committee met this evening at 5:00. The Committee discussed and recommends approval of consent agenda items including contract administration and Airport rent refund items, and Resolution Nos. 3825 and 3828. The Committee also discussed the proposed ordinance related to motorized scooters and similar devices, proposed regulations for Page 2 City of Auburn Council Meeting Minutes February 22, 2005 abandoned shopping carts, and received updates on various projects included in the Municipal Services Committee project matrix. The next regular meeting of the Municipal Services Committee is scheduled for March 7, 2005 at 5:00 p.m. B. Planning & Community Development Chair Singer reported that the Planning and Community Development Committee met February 14, 2005 at 5:00 p.m. The Committee discussed home occupancy standards, Auburn Way South scope of work and project schedule, housing repair policy issues, and the Parks Plan. The next regular meeting of the Planning and Community Development Committee is scheduled for February 28, 2005 at 5:00 p.m. C. Public Works Chair Wagner reported that the Public Works Committee met on February 14, 2005 at 3:30 p.m. The Committee discussed and recommends approval of contract administration items, Ordinance Nos. 5889 and 5898, and Resolution Nos. 3814, 3817, and 3824. The Committee also discussed the proposed West Hill annexation pilot project with King County relating to development standards, 2005 Public Works Committee work agenda, and the Save Our Streets Plan. The Committee also reviewed parking in the vicinity of the intersection at East Main and “D” Street, Lakeland water supply planning and service standards, and the Auburn Way South Median project. The next regular meeting of the Public Works Committee is scheduled for February 28, 2005. D. Finance Chair Backus reported that the Finance Committee met this evening at 6:30. The Committee discussed and recommends approval of claims and payroll vouchers, and Resolution Nos. 3816, 3820, 3823, and 3830. The next regular meeting of the Finance Committee is scheduled for March 7, 2005 at 6:30 p.m. IV. COUNCILMEMBER REPORTS At this time Councilmembers may report on items not specifically described on the agenda, which are of interest to the community. Councilmember Singer reported that she attended a focus group for Green River Community College to discuss the college goals. She, Mayor Lewis, and other Councilmembers attended an Auburn Youth Resources breakfast, the Soroptomist Cupid Caper Fund Raiser, and the Page 3 City of Auburn Council Meeting Minutes February 22, 2005 Association of Washington Cities (AWC) Legislative Conference. She also attended an Auburn Downtown Association Design Committee meeting. Councilmember Cerino reported regarding an encounter with Governor Gregoire at the AWC Legislative Conference. Councilmember Cerino explained that Governor Gregoire was a former student of his at Auburn High School. Councilmember Wagner reported that he and Councilmember Peloza attended a Cascade Water Alliance annual meeting at which King County Executive Sims spoke regarding an agreement between King County and Cascade Water Alliance. Councilmember Backus reported that she toured the Auburn Justice Center with ninety first-graders from Washington Elementary School. Students heard a speech from Judge Patrick Burns and toured the courtroom and various police vehicles. Councilmember Backus expressed appreciation for City staff and volunteers for their participation related to the field trip. She also attended the AWC Legislative Conference. Councilmember Backus noted that she was also a student of Councilmember Cerino. Councilmember Norman reported that she attended the Puget Sound Regional Council Prosperity Partnership Round Table Discussion meeting, various Economic Development Strategy meetings, the Auburn Downtown Association meeting, Puget Sound Regional Council Growth Management Board meeting, Arts Advocacy Committee of King County Cultural Development Authority meeting, and the Community Center meeting. Councilmember Norman congratulated the Auburn Symphony on their Sunday performance. Councilmember Cerino reported that he, Mayor Lewis, and Councilmember Peloza attended the General Assembly of Pierce County Regional Council (PCRC). A director of the PCRC spoke regarding traffic problems, including emphasis on the regional significance of State Route 167, and commented on the number of individuals on the PCRC from the south King County area. Councilmember Thordarson reported on the progress of Raynia Bradsher who has been approved for a lung transplant. Page 4 City of Auburn Council Meeting Minutes February 22, 2005 Councilmember Peloza reported that he attended the Auburn Youth Resources (AYR) fund raising breakfast. Councilmember Peloza shared a success story of a young man who received assistance through AYR. Councilmember Peloza believes AYR is making a difference in the Auburn community. Councilmember Peloza also attended the newly formed Metropolitan Solid Waste Management Advisory Committee meeting to establish working by-laws to determine new or existing transfer station needs, criteria, and standards, an Airport Advisory Board meeting at which Mike Morrisette was voted Chairman, AWC Legislative Conference including the committee hearing on election reform, and the Auburn Symphony Orchestra performance. Mayor Lewis reported on visits with legislators he and five Councilmembers participated in at the AWC Legislative Conference. The Mayor and Councilmembers visited Senators Johnson and Roach, and Representatives Dan Roach, Jan Shabro, Jeff Simpson, and Pat Sullivan. Mayor Lewis also reported that he and Councilmember Peloza visited the capitol today. Mayor Lewis commented on his testimony relating to Streamlined Sales Tax (SST) issues. V. CONSENT AGENDA All matters listed on the Consent Agenda are considered by the City Council to be routine and will be enacted by one motion in the form listed. A. Minutes 1. Claims Claims check numbers 338525 through 338966 in the amount of $2,681,230.99 and a wire transfer in the amount of $10,553,394.82 and dated February 22, 2005. 2. Payroll Payroll check numbers 511309 through 511450 in the amount of $644,153.15 and electronic deposit transmissions in the amount of $947,952.63 for a grand total of $1,592,489.23 for the pay period covering February 3, 2005 to February 16, 2005. Ordinance No. 5889 O4.11 An Ordinance of the City Council of the City of Auburn, Washington, amending Auburn City Code Title 13 entitled “Water, Sewers and Public Utilities” for the purpose of adding assessments for hydrant meter assembly permit violations and penalties Councilmember Wagner moved and Councilmember Thordarson seconded to introduce and adopt Ordinance No. 5889. MOTION CARRIED UNANIMOUSLY. 7-0. 2. Ordinance No. 5898 F4.3, O4.11.2 An Ordinance of the City Council of the City of Auburn, Washington, amending Auburn City Code Title 13, entitled “Water, Sewers and Public Utilities” for the purpose of revising the “Take or Pay” wholesale water rates Councilmember Wagner moved and Councilmember Thordarson seconded to introduce and adopt Ordinance No. 5898. Councilmember Cerino reviewed the process of the “Take or Pay” wholesale water rates procedure and system. MOTION CARRIED UNANIMOUSLY. 7-0. 3. Ordinance No. 5902 O4.9.1 An Ordinance of the City Council of the City of Auburn, Washington, amending Section 10.36.490 of the Auburn City Code and creating a new Chapter 10.28 of the Auburn City Code relating to restrictions and limitations of public right-of-way use Councilmember Wagner moved and Councilmember Thordardson seconded to introduce and adopt Ordinance No. 5902. Resolution No. 3814 O4.12.1 PR C425A, A3.16.9 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor to execute an Interlocal Agreement between the City of Auburn and Auburn School District No. 408 related to Project No. C425A, Pioneer Elementary Walkway Improvements Councilmember Wagner moved and Councilmember Thordarson seconded to adopt Resolution No. 3814. MOTION CARRIED UNANIMOUSLY. 7-0. 2. Resolution No. 3816 A3.16.3, A2.5 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk to execute an Agreement for Telephone Services between the City of Auburn and Qwest Business and Government Services for the purpose of maintaining the City’s telephone system Councilmember Backus moved and Councilmember Norman seconded to adopt Resolution No. 3816 MOTION CARRIED UNANIMOUSLY. 7-0. 3. Resolution No. 3817 O4.11 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk to execute an Interim Water Sales Agreement between the City of Auburn and Covington Water District and Water District No. 111 Councilmember Wagner moved and Councilmember Thordarson seconded to adopt Resolution No. 3817. Resolution No. 3820 F1.8, F4.5.4, A3.16.3 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk to execute an Agreement for Utility Billing Services between the City of Auburn and DataProse, Inc for the purpose of providing for and maintaining printing and mailing services for the City’s utility billing system Councilmember Backus moved and Councilmember Norman seconded to adopt Resolution No. 3820. MOTION CARRIED UNANIMOUSLY. 7-0. 5. Resolution No. 3823 A2.1.2 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk to execute an agreement with West Publishing Corporation d/b/a Thomson Elite for Pro Law Software Councilmember Backus moved and Councilmember Norman to adopt Resolution No. 3823. MOTION CARRIED UNANIMOUSLY. 7-0. 6. Resolution No. 3824 O4.6.1 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor to execute an Interlocal Agreement with the Lakehaven Utility District for the purpose of providing sanitary sewer service from Auburn to property located within the Lakehaven Utility District’s sanitary sewer service area Councilmember Wagner moved and Councilmember Thordardson seconded to adopt Resolution No. 3824. Resolution No. 3825 Page 9 City of Auburn Council Meeting Minutes February 22, 2005 O6.9.1 A Resolution of the City Council of the City of Auburn, Washington, authorizing the City to expend funds to abate the litter, debris and junk nuisance at 2107 Riverview Drive NE, in the city of Auburn, Washington and authorizing a lien for labor and materials Councilmember Cerino moved and Councilmember Peloza seconded to adopt Resolution No. 3825. MOTION CARRIED UNANIMOUSLY. 7-0. 8. Resolution No. 3828 O4.4.9.2, F5.2.15 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor to accept a grant from the State of Washington, Department of Transportation Division of Aviation for grant funds in the amount of Six Thousand Five Hundred Dollars ($6,500.00) to be used to replace the existing REIL light system on Runway 34 with electronic light heads at the Auburn Municipal Airport Councilmember Cerino moved and Councilmember Peloza seconded to adopt Resolution No. 3828. MOTION CARRIED UNANIMOUSLY. 7-0. 9. Resolution No. 3830 F4.6.1 A Resolution of the City Council of the City of Auburn, Washington declaring certain items of property as surplus and authorizing their disposal Councilmember Backus moved and Councilmember Norman seconded to adopt Resolution No. 3830. Executive Session Mayor Lewis recessed the meeting to executive session at 8:20 p.m. for approximately twenty minutes in order to discuss issues of property acquisition.
