Flag Salute Mayor Lewis called the meeting to order at 7:30 p.m. and led those in attendance in the Pledge of Allegiance. B. Roll Call Mayor Lewis and the following Councilmembers were present: Rich Wagner, Sue Singer, Gene Cerino, Nancy Backus, Bill Peloza, Roger Thordarson, and Lynn Norman. Staff members present included: Police Chief Jim Kelly, Employee Relations and Compensation Manager John Fletcher, Planner Bill Mandeville, City Attorney Daniel B. Heid, Planning and Community Development Director Paul Krauss, Multimedia Manager Bernadette Castner, Finance Director Shelley Coleman, Public Works Director Dennis Dowdy, Assistant Police Chief Bob Lee, Community Development Administrator David Osaki, Fire Chief Russ Vandver, Police Commander Larry Miller, Police Sergeant of Investigations Bill Waldroop, Police Commander Will Lathrop, Senior Planner Jeff Dixon, Environmental Protection Manager Aaron Nix, and City Clerk Danielle Daskam. C. Announcements and Appointments 1. Announcements a) Proclamation – “Safe Boating Week” Mayor Lewis to proclaim the week of May 21 – 27, 2005 as “Safe Boating Week” in the City of Auburn. Page 1 City of Auburn Council Meeting Minutes May 2, 2005 Mayor Lewis read and presented the proclamation to Poverty Bay Power Squadron Commander Ross Earnst and Public Relations Committee Chair Martha Holling. Mayor Lewis commended the efforts of the Poverty Bay Power Squadron members for their work and educational efforts regarding the promotion of boating safety. On behalf of Poverty Bay Power Squadron, Commander Earnst thanked Mayor Lewis and Councilmembers for their support. Poverty Bay Power Squadron is a sail and power boating organization, which is dedicated to safe boating. The Squadron teaches the American Boating Course to the public and provides free pleasure vessel safety checks. b) Police Department Promotions Chief Kelly reported that Officer David Colglazier began service as a police officer with the Port of Seattle in 1993. He joined the City of Auburn Patrol Division in 1995 and was assigned to the K-9 Unit in 1998. He and Police Service Dog, Bone, responded to approximately 514 K-9 calls for service and were credited with 120 misdemeanor and/or felony arrests. He is also a member of the Police Department’s Peer Support Team. Chief Kelly announced the promotion of Officer Colglazier to the rank of Sergeant. Mayor Lewis congratulated Sergeant Colglazier on his promotion and presented him with his Sergeant’s badge. Sergeant Colglazier was joined by his wife, Jody. Chief Kelly reported that Sergeant Greg Wood is an Auburn native. He became an Auburn Police Explorer in 1985. He joined the City of Auburn Police Department in 1991 as a Community Service Officer and transitioned to Parking Enforcement Officer in 1992. In 1993 he became a commissioned Police Officer and worked in the Patrol Division for five Page 2 City of Auburn Council Meeting Minutes May 2, 2005 years. He transferred to the Special Investigation Unit as a Narcotics Detective in 1999. He was promoted to sergeant in 2000 and has worked as a Patrol Sergeant and Inspectional Services Unit Sergeant. Chief Kelly announced the promotion of Sergeant Wood to the rank of Commander. Mayor Lewis congratulated Commander Wood and presented him with his Commander’s badge. Commander Wood was joined by his wife, Gracene. Chief Kelly recognized Sergeant Waldroop’s twenty- five years of service to the City of Auburn. He has held many positions with the City of Auburn, most recently supervising the Major Crimes Division for the Police Department. Mayor Lewis commended Sergeant Waldroop for his many years of service to the City of Auburn. 2. Appointments There were no appointments for Council consideration. D. Agenda Modifications Agenda modifications included correspondence from Ron and Jean Smith regarding Item II.A.1, the Tucci/Polygon annexation hearing, additional revisions to proposed Ordinance No. 5894 under Item VIII.A.1, and also correspondence from Daniel Martorana regarding the Item II.A.2, the Vorozhko annexation which was distributed just prior to the meeting. II. CITIZEN INPUT, PUBLIC HEARINGS & CORRESPONDENCE A. Public Hearings 1. Annexation No. ANX04-0002 O3.1 ANX04-0002 City Council to conduct a public hearing on the petition to annex certain property located in Pierce County adjacent to the City’s southern boundary, which area is referred to as the Tucci-Polygon Annexation. Page 3 City of Auburn Council Meeting Minutes May 2, 2005 Planner Bill Mandeville reported that the proposed annexation of 271 acres consists of 63 parcels and is located in Pierce County within the City’s Potential Annexation Area (PAA). Mr. Mandeville displayed a map of the proposed annexation location. Property owners representing 84% of the total assessed valuation signed the petitions requesting annexation. Currently, the area has a population of approximately 50 people and the land use is residential. The anticipated land uses in the proposed annexation area will be primarily residential with a portion previously approved by Pierce County for commercial use nd near the Lake Tapps Parkway and 182 Street. The proposed annexation is an extension of an existing neighborhood. Portions of the proposed annexation are part of Lakeland Hills South Planned Unit Development (PUD) approved by Pierce County in 1993. According to the City’s Comprehensive Land Use Plan, approximately 80 acres of the annexation will be developed for moderate density residential land uses. The remaining portions of the annexation will be developed for single family residential land uses. Staff estimates that the area has the capacity to house approximately 4,000 residents. The City of Bonney Lake will provide water to the lands subject to the annexation through an existing interlocal agreement. Councilmember Wagner inquired regarding the portion of land which is not being annexed that lies within the proposed annexation area. Mr. Mandeville stated that the portion not being annexed is owned by the City of Bonney Lake and contains their water tower. Mayor Lewis opened the public hearing. Chris Huss, 4224 Waller Road, Tacoma Mr. Huss spoke on behalf of Evergreen/Tucci Partners. Evergreen/Tucci Partners owns 77 acres of the proposed annexation area. If the annexation is approved, Evergreen/Tucci Partners intends to request that the area be included in the Lakeland Hills South PUD. Mr. Huss spoke in favor of the annexation. Annexation No. ANX05-0001 O3.1 ANX05-0001 City Council to conduct a public hearing on the petition to annex certain property located in King County adjacent to the City’s eastern boundary, which area is referred to as the Vorozhko Annexation. Mr. Mandeville reported that the proposed annexation is for th a single parcel which is located on the east side of 116 Street SE, adjacent to the east boundary of the city limits. The applicant indicated that their intent is to short-plat the property into three or four lots. City policy requires application for annexation in order to connect to the City’s water and sewer services. Mayor Lewis opened the public hearing. th Dan Martorana, 11517 SE 327 Place, Auburn Mr. Martorana indicated that he was not opposed to the annexation, but requested Council impose conditions to the annexation related to removal of various unlicensed, damaged or inoperable vehicles located on the property. Mr. Martorana displayed slides of numerous vehicles parked on the proposed annexation area. Mr. Martorana also requested that the applicant submit a signed statement that they will abide by the zoning codes and laws of the City of Auburn. th Pat Bork, 32234 116 Avenue SE, Auburn Ms. Bork indicated that her property is located immediately south of the proposed annexation area and her mother owns property behind the proposed annexation area. Ms. Bork expressed concerns related to the number of cars on the subject property and also with plans related to platting of the property. No one else requested to speak. Mayor Lewis closed the public hearing. Page 5 City of Auburn Council Meeting Minutes May 2, 2005 3. 2004 Consolidated Annual Performance Evaluation Report (CAPER) for the Community Development Block Grant Program O3.4.1.7, F5.4.3 The CAPER is an overall review of housing and community development activities undertaken in Auburn during 2004. Its primary purpose is to inform the citizens of Auburn how and where the federal funds are spent, and assess the program accomplishments as they relate to housing and community development goals set forth in the Consolidated Plan. The purpose of this hearing is to solicit public comments prior to approval of the CAPER and submission of the report to the U.S. Department of Housing and Urban Development. Mr. Mandeville briefly reviewed the purpose of the CAPER. Mayor Lewis opened the public hearing. No one in the audience requested to speak. Mayor Lewis closed the public hearing. B. Audience Participation This is the place on the agenda where the public is invited to speak to the City Council on any issue. th Bob Derrigan, 104 South 325 Place, Federal Way Mr. Derrigan stated that he is a former member of Auburn Lions Club. Mr. Derrigan read an article that will be published in the Lions magazine regarding the first annual Zone C-319C Lions Club Fishing Derby for special needs children at Mill Pond in Auburn. Community families from Lions Clubs from Auburn, Bonney Lake, Covington, Enumclaw, Fife, Federal Way, Kent, Sumner, and surrounding cities participated. Mr. Derrigan reported that the event was a tremendous success. Mr. Derrigan acknowledged and thanked all the individuals, agencies, and businesses that participated in this special event. Keith Stump, 1620 Riverview Drive, Auburn Mr. Stump spoke regarding proposed Ordinance No. 5894. Mr. Stump expressed concerns related to the definitions related to Page 6 City of Auburn Council Meeting Minutes May 2, 2005 critical habitat and sensitive species and suggested Council reconsider the language as now written. C. Correspondence No correspondence was received for Council review. III. COUNCIL COMMITTEE REPORTS A3.7.6 A. Municipal Services Chair Cerino reported that the Municipal Services Committee met this evening at 5:00. Chair Cerino noted that Item V.C.1 Final Pay Estimate amount was corrected to $17,754.30. The Committee discussed school zone speed limits and proposed regulations related to aggressive begging. The Committee also received an update on traffic safety cameras and the fire station financial analysis, and discussed an airport land lease agreement and the proposed golf course clubhouse. The next regular meeting of the Municipal Services Committee is scheduled for May 16, 2005 at 5:00 p.m. B. Planning & Community Development Chair Norman reported that the Planning and Community Development Committee met on April 25, 2005 at 5:00 p.m. The Committee discussed and recommends approval of Ordinance No. 5894 and Resolution Nos. 3811, 3856, and 3857. Chair Norman thanked staff members for their work related to the critical areas ordinance and the Parks and Recreation Plan. The Committee also discussed proposed Ordinance No. 5913 related to off street parking, and received a report on the 2004 CAPER and Tree Board Work Plan. Chair Norman announced that a special joint meeting of the Planning and Community Development Committee with the Planning Commission is scheduled for Tuesday, May 3, 2005 at 7:00 p.m. The next regular meeting of the Planning and Community Development Committee is scheduled for May 9, 2005 at 5:00 p.m. C. Public Works Chair Wagner reported that the Public Works Committee met April 25, 2005 at 3:30 p.m. The Committee discussed and recommends approval of two all-way stops and contract administration items. The Committee also discussed Pioneer Elementary walkway improvements, left turn issues into the new Bigfoot Espresso location, and pedestrian and video detection technology. The next Page 7 City of Auburn Council Meeting Minutes May 2, 2005 regular meeting of the Public Works Committee is scheduled for May 9, 2005 at 3:30 p.m. D. Finance Chair Backus reported that the Finance Committee met this evening at 6:30. The Committee discussed and recommends approval of claims and payroll vouchers and Resolution No. 3855. The Committee also received a report on 2005 first quarter revenues and expenditures. The next regular meeting of the Finance Committee is scheduled for May 16, 2005 at 6:30 p.m. IV. COUNCILMEMBER REPORTS At this time Councilmembers may report on items not specifically described on the agenda, which are of interest to the community. Councilmember Singer extended congratulations to Councilmember Roger Thordarson on his birthday. Councilmember Singer also reported that she attended the White River Valley Museum opening for the Native American basket collection, Safeway Distribution Center ribbon cutting ceremony, Puget Sound Regional Council staff meeting, a meeting with King County Department of Public Health Director Alonzo Plough and County Councilmember Pete Von Reichbauer, Puget Sound Regional Council Operations and Executive meeting, Suburban Cities Networking meeting, Lodging Tax Advisory Committee meeting, Cities and Schools Forum, and the re-opening ceremony at the Valencia Apartments. Councilmember Singer, together with Mayor Lewis and Councilmember Thordarson, also attended Evergreen Heights new playground commemoration, and a reception celebrating 25 years of service for Auburn Police Sergeant Waldroop Councilmember Wagner reported that he attended the Auburn Community Volunteers Recognition Luncheon, Safeway Distribution Center ribbon cutting ceremony, Cities and Schools Forum, and the opening of the GSA Little League ballfields. Councilmember Norman reported that she attended the Auburn Community Volunteers Recognition Luncheon, Washington State’s Main Street Program at which the City of Auburn and Auburn on Main, LLC were recognized and presented with an “Outstanding Design Project” award for the Auburn Justice Center, and the Auburn Symphony Beethoven festival. Page 8 City of Auburn Council Meeting Minutes May 2, 2005 Councilmember Cerino reported that he attended the Pierce County Regional Council meeting and a Cascade Water Alliance Committee meeting. Councilmember Thordarson reported that he and Councilmembers Wagner and Peloza attended the Federal Way and Auburn Boys and Girls Club fundraiser, and he attended the Safeway Distribution Center ribbon cutting ceremony, a Regional Transit Committee meeting which will be meeting in Auburn in June 2005, the Extreme Sports Extravaganza Committee meeting, the Evergreen City Ballet production of Sleeping Beauty which was dedicated to his late wife, Margaret, and the Cities and Schools Forum. Councilmember Peloza reported that he attended the Federal Way and Auburn Boys and Girls Club fundraiser, Auburn Community Volunteers Recognition Luncheon, Safeway Distribution Center ribbon cutting ceremony, Steering Committee meeting for the establishment of a Sister City in Italy, Regional Wastewater Services Plan Update meeting, the re- opening ceremony at the Valencia Apartments, and the Auburn Symphony Beethoven festival, a portion of which was dedicated to Gertie Springer, deceased. Mayor Lewis reported on the Washington State Department of Community Trade and Economic Development “Outstanding Design Project” award presented to the City of Auburn and Auburn on Main, LLC for the Auburn Justice Center project and also on the re-opening ceremony at the Valencia Apartments. Mayor Lewis announced that the Cancer Relay for Life will be held in Auburn on May 13-14, 2005, at the Auburn Memorial Stadium. Mayor Lewis noted that his mother-in-law survived cancer, twice. She recently passed away due to heart failure. Unknown to the Mayor, a team t-shirt was designed by members of his team, Team Millie, as a tribute to her memory. V. CONSENT AGENDA All matters listed on the Consent Agenda are considered by the City Council to be routine and will be enacted by one motion in the form listed. A. Minutes 1. Councilmember Singer moved and Councilmember Wagner seconded to approve the consent agenda. MOTION CARRIED UNANIMOUSLY. 7-0. VI. UNFINISHED BUSINESS There was no unfinished business. VII. NEW BUSINESS There was no new business. VIII. ORDINANCES AND RESOLUTIONS A. Ordinances 1. Ordinance No. 5894 O3.4.2.9 An Ordinance of the City Council of the City of Auburn, Washington, adopting a new Chapter 16.10 to the City of Auburn City Code entitled “Critical Areas” Councilmember Norman moved and Councilmember Cerino seconded to introduce and adopt Ordinance No. 5894 as revised and presented in the agenda modification. Councilmember Singer referred to the agenda modification regarding the reference to lists, categories, and definitions of species promulgated by the Washington Department of Fish and Wildlife in Auburn City Code Section 16.10.020. Councilmember Singer inquired if that specific language will include species from outside lists that are not endangered or threatened. Planning and Community Development Director Krauss stated that the intent was to focus more on the official lists developed by the State. Originally, the Planning Commission recommended listing locally significant species, which raised the potential that there could be any number of animals listed based upon local initiatives. Page 11 City of Auburn Council Meeting Minutes May 2, 2005 Environmental Protection Manager Aaron Nix recommended deleting the language referred to by Councilmember Singer. The State has an interesting system and has developed numerous lists, including a Species of Concern List and a State Monitor List. The language referred to by Councilmember Singer falls under the State Monitor List, which are species that will not be considered under the critical areas ordinance. Discussion followed regarding the reference to sensitive species in Auburn City Code Sections 16.10.020 and 16.10.080. Councilmember Singer moved and Councilmember Backus seconded to amend Ordinance No. 5894 by deleting the final sentence of the “Critical Habitat, or Critical Wildlife Habitat” definition on page 16.10-7 (Amendment No. 1 to Auburn City Code Section 16.10.020 per the agenda modification, bottom of the first page of the memorandum) and revising the definition to read as follows: “Habitat areas associated with threatened, endangered, or sensitive species of plants or wildlife (pursuant to WAC 232- 12-297 Sections 2.4, 2.5 and 2.6) and which, if altered, could reduce the likelihood that the species will maintain and reproduce over the long term.” Discussion followed related to identifying lists related to threatened, endangered, and sensitive species of plants and wildlife. Resolution No. 3855 O3.11 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk to execute a contract with the Auburn Food Bank Councilmember Backus moved and Councilmember Norman seconded to adopt Resolution No. 3855. MOTION CARRIED UNANIMOUSLY. 7-0. 3. Resolution No. 3856 O3.1 ANX04-0002 A Resolution of the City Council of the City of Auburn, Washington, relating to its intention to annex certain property located in Pierce County adjacent to the City’s southern boundary Councilmember Norman moved and Councilmember Cerino seconded to adopt Resolution No. 3856. Resolution No. 3857 O3.1 ANX05-0001 A Resolution of the City Council of the City of Auburn, Washington, relating to its intention to annex certain property located in King County adjacent to the City’s eastern boundary Councilmember Norman moved and Councilmember Cerino seconded to adopt Resolution No. 3857. Councilmember Singer inquired whether the citizen concerns related to inoperable and junk vehicles can be dealt with through enforcement of the Auburn City Code or if conditions could be placed on the annexation agreement. Page 13 City of Auburn Council Meeting Minutes May 2, 2005 City Attorney Daniel Heid stated that making annexations contingent or conditional is not consistent with the law. Director Krauss stated that he is unaware of any outstanding or prior code compliance issues with regard to approval from King County. If the annexation is approved, the property would be subject to the City of Auburn nuisance code, which already addresses unlicensed vehicles. Councilmember Peloza expressed concern regarding the number of vehicles parked on the subject property. Councilmember Peloza commented that City code enforcement should mitigate citizen concerns. MOTION CARRIED UNANIMOUSLY. 7-0. IX. MAYOR’S REPORT A. Executive Session Mayor Lewis recessed the meeting to executive session at 9:20 p.m. for approximately forty minutes to discuss real property acquisition issues and pending and potential litigation. Mayor Lewis reconvened the meeting at 9:55 p.m. X. ADJOURNMENT There being no further business to come before the Council, the meeting adjourned at 9:55 p.m. APPROVED THE ______ DAY OF MAY, 2005.
