The City of Auburn received an application from Steve Nichols to annex two parcels that he owns consisting of nine acres of unimproved land. The property is adjacent to the west boundary of the existing city limits just north of Mountain View Cemetery and east of 58th Avenue South. The! area is within the City's potential annexation area. Comprehensive Plan Policy CE-3 states the City shail require annexation as a condition of extending sewer and/or water utility service to properties within the potential annexation area and adjacent to the City limits. The parcel is adjacent to the City limits. Mr. Nichols intends to subdivide the property into additional lots and therefore will require City sewer connections to the new lots. He has also discussed the possibility of developing at a lower density using septic tanks. The proposed subdivision of the property into singie-family lots is consistent with Auburn's Comprehensive Plan designation f'Jr "Single- Family Residential." The proposed Nichols annexation was part of the much larger Mountainview-West Hill annexation that failed earlier this year due to an inability to achieve the 60% of assessed valuation threshold. The Mountainview-West Hill annexation included some privately maintained roads on public right-of-ways, which were a contentious issue between several property owners. These roads or "driveways" include South 322 Place, which is privately owned, and the north end of 58th Avenue South between South 324th Street and South 318th Street. However, the proposed Nichols annexation does not include these privately maintained roadways nor has the applicant expressed intent to connect to these roadways. Although the specific details of roadway to the Nichols annexation would need to be resolved when Nichols submits the preliminary plat for his proposed subdivision; his expressed plans include a public roadway on the south end of 58th Avenue South that connects to the public roadway at South 328th Piace. He states access to the annexation area wiil not connect to the privately maintained roadway on 58th Avenue South roughly two blocks north of the proposed annexation area. It does not appear likely that they would want to be part of the proposed Nichols annexation, since only two of these eleven parcels returned petitions in the proposed Mountainview-West Hill annexation that failed earlier this year Based on State annexation laws, the Council is asked at this time to consider accepting the attached 10% application for annexation from Steve Nichols. If the Council accepts his application, then C,ity staff will request Mr. Nichols {since he is the sole property owner of entire annexation area} to consider and submit a petition for annexation. Upon receipt of Mr. Nichol's petition, the City Council will be asked to consider accepting his petition. Upon accepting the petition, the Council will call for a public hearing and City staff will post the necessary public notices announcing it. Following the public hearing, Council will be asked to consider filing the petition and their intent to annex with the King County Boundary Review Board. If approved by the Boundary Review Board, the Council will then be asked to consider and pass an ordinance to effect the annexation.
