The amendment entails appropriating unencumbered funds from prior years to two new activities: $15,000 to the Auburn Food Bank for a feasibility study to determine if they can afford a larger facility and $94,240 to create a revolving loan fund for first-time homebuyers who choose to locate in targeted neighborhoods. Since the amendments involve new activities, the City's Consolidated Plan will likewise need to be amended which, in turn, requires a public hearing. The PY2004 CAPER found $145,209 of unencumbered funds from prior years that needs to be re- appropriated. Most of these funds {$90,000} came from the defunct Neighborhood House Grant. Approximately $38,000 came from unspent administrative funds in PY2003. The remainder represents the sum total of unspent funds from several and various projects between PY1998 and PY2002. A portion of these unencumbered funds ($25,969) will offset the reduction in the City of Auburn's COBG entitlement for PY2005. The City PY2005 budget was based on an anticipated entitlement of $482,000; whereas, the actual entitlement was $456,031 leaving a $25,969 PY2005 budget shortfall. A separate budget amendment proposes to allocate $10,000 to the Les Gove Spray Pool to build an area designated for people who use skateboards. The remaining $109,240 {$145,209-$25,969-$1 0,000 = $109,240) is the subject of this particular budget amendment. One of the objectives in the Community Development Strategy of Auburn's Consolidated Plan is to -- "Keep up with the growing demand for emergency food services by increasing storage capacity and coordinating regional partnerships among South King County food banks and food distributors." This particular objective was not funded in the existing PY2005 Action Plan. This appropriation would fund a study to determine the capacity of the Auburn Food Bank to build and sustain the operating costs of a larger facility. CDBG regulations define these types of studies as an administrative expensive. Between the two projects, the appropriation to the $15,000 appropriation to the Auburn Food Bank is the most time sensitive. The Food Bank's appropriation will need to be expended before December 31, 2005. The Food Bank would like to complete the study before the end of the fiscal year so that it can decide whether it needs to grants and donors to fund and sustain a larger facility during forthcoming fiscal years. The appropriation for the Revolving Loan Fund does not lapse at the end of the fiscal year and may be expended at some future date during the forthcoming years. If funded, staff will begin drafting for Committee review and approval the necessary program guidelines. The program would probably not be ready to implement until sometime next year. On June 27th the Planning and Community Development Committee considered and accepted the Human Service Committee's recommendations. They moved to forward the proposed amendments to the City Council. If the City Council chooses to postpone action, then the unencumbered funds will be included into next year's CDBG appropriation and the Year 2006 Action Plan. If the Council chooses to consider one or both of the proposed activities, then Staff request the Council call for a public hearing to amend the "Annual Action Plan" of the Consolidated Plan. HUD regulations stipulate a public hearing precede any changes to the Consolidated Plan, which includes the CDBG budget. Staff request the public hearing be scheduled for the August 1 Council meeting so as to provide sufficient time to post and publish a notice about the public hearing and proposed action. Amendments to PY2005 CDBG Action Plan & Budget Page 2 of 2 RESOLUTION NO.3 8 7 1 A RESOLUTION OF THE CITY OF AUBURN, WASHINGTON, TO AMEND RESOLUTION NO. 3775, PROGRAM YEAR 2005 ANNUAL ACTION PLAN OF THE CITY OF AUBURN'S CONSOLIDATED PLAN, AND RESOLUTION NO. 3772, CDBG FUNDING FOR PROGRAM YEAR 2005; AND AUTHORIZE THE MAYOR TO IMPLEMENT THE APPROVED CHANGES, PROGRAMS AND PROJECTS WHEREAS, the City of Auburn has unencumbered CDBG funds from prior years that are currently not allocated to serve any eligible CDBG activity; and WHEREAS, since the source of these funds is from previous years' CDBG entitlements, the appropriation of these funds does not represent an increase in revenues nor an increase in Auburn's current CDBG entitlememt and, therefore, does not trigger the "Contingency Plan" of Resolution No. 3722; and WHEREAS, the City of Auburn desires to use these funds to promote affordable housing choices within the city of Auburn; and WHEREAS, the City of Auburn wants to keep up with the growing demand for emergency food services by increasing storage capacity and coordinating regional partnerships among South King County food banks and food distributors; and WHEREAS, both of the above desires are unfunded objectives in the City of Auburn's existing Consolidated Plan for Years 2005-2008; and Resolution 3871 June 28, 2005 Page 1 WHEREAS, the City Council of the City of Auburn wants to make the necessary amendments to include these objectives in the PY2005 Annual Action Plan. NOW THEREFORE THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DOES HEREBY RESOLVE TO DO THE FOLLOWING: Section 1. Amend Resolution No. 3775 - "A resolution of the City Council of the City of Auburn, Washington, adopting the Consolidated Plan for Years 2005-2008 and the Program Year (PY) 2005 Annual Action Plan." The City Council of the City of Auburn hereby approves the changes to "Chapter 5: PY2005 Annual Action Plan" for the City of Auburn's Consolidated Plan as represented in Exhibit "A" of this resolution. Section 2. Amend Resolution No. 3772 - "A resolution of the City Council of the City of Auburn, Washington, approving the City's CDSG funding for Program Year 2005 in total amount of Four Hundred Eighty-two Thousand Dollars ($482,000)." The City Council of the City of Auburn hereby appropriates an adlditional ONE HUNDRED NINE THOUSAND TWO-HUNDRED FORTY DOLLARS ($109,240) of unencumbered CDBG funds from prior years to the PY2005 CDBG budget for projects itemized in Exhibit "B", attached hereto and incorporated herein by this reference. FIVE HUNDRED NINETY.: ONE THOUSAND TWO HUNDRED FOURTY DOLLARS ($S91.240). WHEREAS, the City Council of the City of Auburn must adopt and approve all appropriations by resolution pursuant to Chapter 3SA RCW; and WHEREAS, the City is an entitlement recipient for Community Development Block Grant (CDI3G) funds under the Housing and Community Developmcnt Act of 1974 (the Act), Pub L 93-383 as amended, and will receive CDBG funds for the purpose of carrying out eligible community development and housing activities under the Act and under regulations promulgated by the Department of Housing and Urban Development (HUD) at 24 CFR Part S70; and WHEREAS, according to RCW 3SA.33.ISO special fund appropriations do not lapse but carry forward trom year to year until fully expended or the purpose has been accomplished or abandoned without necessity of re-appropriation; and WHEREAS, it is in the best interest of the City of Auburn and its citizens to set forth a contingency plan to take into consideration the possibility of changes in th~~ anticipated CDBG entitlement amount; and WHEREAS, the City desires to award certain funds for use as described within this Resolution, for the purpose of implementing eligible activities under the Act :md HUD regulations; and WHEREAS, the Legislature has declared that carrying out the purposes of federal grants or programs is both a public purpose and an appropriate function for a city, town, county, or public corporation; NOW THEREFORE THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DOES HEREBY RESOLVE AS FOLLOWS: Resolution #3772 October 18, 2004 Page 1 SECTION 1. CDBG Budget for 2005 Program Year. The City Council of the City of Auburn hereby approves the PY2005 CDBG program of F01:lr H1:1ftdreà Eight)' TV/e The\lsRaà DeBars ($182,Q9Q) Five Hundred Ninetv-one Thousand Two Hundred Fourtv Dollars ($591.240) for programs, projects, and administrative costs recommended by the Human Services Committee, as amended and approved by the Planning and Community Development Committee, for the 2005 CDBG Program Year. Specific expenditures for the 2005 Program Year are itemized in Exhibit "A", attached hereto and incorporated herein by this reference. A sample contract to govern these expenditures is represented by Exhibit "B". Disbursement of CDBG funds for a specific program or project shall not exceed the amount appropriated, as indicated on the itemized budget set forth in Exhibit "A" to this Resolution No. 3772, for that particular program or project. SECTION 2. Prerequisites for use of CDBG Funds. Grant recipients must certify that their planned use of CDBG funds complies with the following: (a) Compliance with national obiectives. Grant recipients must certify that their use of CDBG funds gives maximum feasible priority to activities that benefit low and moderate income residents or aid in the prevention or elimination of slums or blight. (b) Compliance with environmental review procedures. Grant recipients must certify that compliance with environmental review procedures set forth in 24 CFR, part 58, for each activity as applicable. SECTION 3. Contingency Plan No appropriation shall be made in excess of actual revenues and no liability is to be incurred in excess of appropriations. In the event that actual revenues are different than the revenues estimated by the CDBG budget, the following actions shall be taken: Resolution #3772 October 18, 2004 Page 2 (a) Public Service Programs: In the event the City receives a lesser amount of funding than its budgeted CDBG entitlement, each appropriation for public services will æceive a proportionately equal reduction in its appropriation relative to the total del~rease in total revenues. In the case of an increase in available funding, the final award will be calculated based on the increase in funds available subject to the CDIBG 15% Public Services Gap. (b) Capital-Funds Programs: Appropriations for capital projects, including the Housing Repair Program, shall be released only when actual revenues are sufficient to fully fund the appropriation unless both the recipient Agency and the City mutually agree to a partial funding of the Agency's original appropriation. Partial funding of an appropriation will release the City from further obligations to fund that particular appropriation and, thereby, allow the City to consider funding either all or part of another appropriation. In the event that the City receives more than its budgeted CDBG entitlement, the non-budgeted portion of the appropriation not available for public service activities will be allocated to the Housing Repair Program up to an additional $50,000. Additional funds received will be allocated in the 2006 program year. Funds budgeted to capital projects which are reduced in costs, thus returning funds to the CDBG program during the Program Year, will be reallocated to the Housing Repair Program. SECTION 4. Implementation. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directives of this legislation. Resolution #3772 October 18, 2004 Page 3 SECTION 5. Severability. The provisions of this Resolution are declared to be separate and severable. The invalidity of any clause, sentence, paragraph, subdivision, section or portion of this Resolution, or the invalidity ofthe application thereofto any person or circumstance shall not affect the validity of the remainder of this Resolution, or the validity of its application to other persons or circumstances. SECTION 6 Effective Date This Resolution shall be in force and take effect five (5) days from and after its passage, approval and publication, as provided by law.
