AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
AUBURN, WASHINGTON, AMENDING CHAPTER 2.76 OF
THE AUBURN MUNICIPAL CODE RELATING TO THE
AUBURN TOURISM BOARD
WHEREAS, pursuant to the provisions of RCW 67.28.1817 citiE!S collecting
lodging taxes are to establish lodging tax advisory committees to operate pursuant to
statute in order to determine appropriate procedures and methodology for the tax
collection and expenditure under the statute; and
WHEREAS, as tourism is also a necessary adjunct of that lodging tax, and the
purposes for which the lodging tax advisory committee would be operating translate
very closely to tourism considerations, it would be reasonable and advantageous for the
City to expand the purposes of the committee to include tourism related issu,es; and
WHEREAS, in addition to the slight change in these duties, it would make sense
to re-Iabel the committee to the Auburn Tourism Board.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, DO ORDAIN as follows:
Section 1. Amendment to City Code. That Chapter 2.76 of the Auburn City
Code is amended to read as follows:

2.76.010 Creation. .
There is hereby created the lodging tax aElvisory committoe Auburn Tourism
Board. The committee board shall serve in an advisory capacity to the mayor and city
council. as the lodaina tax advisorv committee pursuant to RCW 67.28.181i:. (Ord. 5554
§1,2001.)
2.76.020 Membership.
The lodging tax advisory committeo Auburn Tourism Board shall consist of at
least five members as follows:
A. Two members appointed by the city council who are representatives of
businesses required to collect tax under Chapter 67.28 RCW.
B. Two members appointed by the city council who are persom; involved in
activities authorized to be funded by revenue received under Chapter 67.28 RCW.
C. Persons who are eligible for appointment under subsection A of this
section are not eligible for appointment under subsection B of this section ;and persons
who are eligible for appointment under subsection B of this section are not eligible for
appointment under subsection A of this section.
D. One elected official shall serve as chair of the 10dgiR€ tax aEl'/i80ry
committoe Auburn Tourism Board.
E. The city council shall review the membership of the advi80ry
committeoboard annually and make changes as appropriate. (Ord. 5554 § 1, 2001.)
2.76.030 Terms.
All members appointed pursuant to ACC 2.76.020 shall serve three··year terms.
The initial appointment shall be staggered with two appointments serving a one-year
term, two appointments serving a two-year term, and two appointments serving a three-
year term. Organizations representing businesses required to collect tax under Chapter
67.28 RCW and organizations involved in activities authorized to be funded by revenue
received under said tax as well as local agencies involved in tourism and promotion
may submit recommendations for membership on the committoeboard.
Members of the committee board shall be subject to removal in accordance with
the provisions of Chapter 2.30 ACC as it currently exists or as it may be amended
hereafter. (Ord. 5803 § 11, 2003; Ord. 5554 § 1, 2001.)
2.76.040 Responsibilities.
The lodging tax ad'Jisory semmittee Auburn Tourism Board shall make reports
and recommendations to the mayor and city council as follows:
A. The committee board shall consider proposals for impositic,n of a city
lodging tax under Chapter 67.28 RCW.

B. If such a tax is adopted, the committee board shall review any increases in
the rate of tax imposed, repeal of any exemption from a tax imposed or a change in the
use of revenue received under Chapter 67.28 RCW. The committee board shall
consider any such proposal, provide for public input, and submit comments in a timely
manner to the mayor and city council. The comments shall include an analysis of the
extent to which the proposal will accommodate activities for tourists or increase tourism,
and the extent to which the proposal will affect the long-term stability of the fund created
under RCW 67.28.1815.
C. The Auburn Tourism Board shall also make such other recommendations
to the Citv Council on tourism promotion and tourism related issues as are consistent
with the functions of the board as provided herein. (Ord. 5554 § 1, 2001.)
Section 2.
Implementation. The Mayor is hereby authorized tl) implement
such administrative procedures as may be necessary to carry out the directions of this
legislation.
Section 3.
Severabilitv. The provisions of this ordinance are declared to be
separate and severable. The invalidity of any clause, sentence, paragraph, subdivision,
section or portion of this ordinance, or the invalidity of the application thE~reof to any
person or circumstance shall not affect the validity of the remainder of this ordinance, or
the validity of its application to other persons or circumstances.
Section 4. Effective date. This Ordinance shall take effect and be in force
five days from and after its passage, approval and publication as provided by law.
