Background Summary:
In May 2005 the City of Auburn accepted an "Application for Annexation" from Steve Nichols (32516 58th
Avenue South) for two parcels that he owns which is located adjacent to the west boundary of the city
limits up on West Hill. The parcels (Parcel #9262800210 and Parcel #9262800280) are each
approximately 4.5 acres. The total area of the annexation is nine acres. Mr. Nichols currently resides on
one of the parcels. He plans to subdivide the property.
City staff prepared the annexation petition. In June 2005 City received the signed petition back from Mr.
Nichols. On June 14th the King County Assessor certified the petition was sufficient to meet the statutory
requirements for the 60% petition method of annexation.
City staff request the Council consider the proposed annexation and call for a public hearing. The subject
of the public hearing will be to authorize staff to submit the required "Notice of Intent" to the King County
Boundary Review Board. If the Boundary Review Board approves the annexation, an ordinance will be
prepared to adopt it.

ANNEXATION PETITION CERTIFICATION
TIllS IS TO CERTIFY that the petition submitted June 7, 2005 to the
King County Department of Assessments by F. W. "Bill" Mandeville,
Planner for the City of Auburn, supporting the annexation to
Auburn of the properties described as the Nichols Annexation" has
been examined, the property taxpayers, tax parcel numbers, and
assessed value of properties listed thereon carefully compared with
the King County tax roll records, and as a result of such examination,
found to be sufficient under the provisionS of the New Section of
Revised Code of Washington, Section 35.13.002.
The Department of Assessments has not verified that the signature
on the petition is valid through comparison with any record of actual
signatures, nor that the signature was obtained or submitted in an
appropriate time frame, and this document does not certify such to
be the case.

We, the undersigned property owners of the real property
lying within the boundaries of the area hereinafter
described, do hereby petition the City of Auburn to annex
the following described area lying adjacent to the existing
city limits of the City of Auburn. Said annexation shall
include the portion of the real property illustrated on the
"Annexation Map" and attached legal description. The
said area, if annexed by the City of Auburn, will assume
its pro-rata portion of the existing bonded indebtedness of
the City of Auburn, In accordance with the City of
Auburn's Comprehensive Land Use Plan, the annexation
area will be zoned R-I: Single Family Residential (AMC
18.12),

Every person who signs this petition with any other than his/her true name, or who knowingly
signs more than one of these petitions, or signs a petition when he/she is otherwise not qualified
to sign, or who makes any false statement, shall be guilty of a misdemeanor.

1, The signature of the record owner, as determined by the records of the County Auditor, shall be suffici;ent without the
signature of his or her spouse.
2. In case of mortgaged property, the signature of the mortgagor shall be suffICient without the signature of his or her
spouse.
3. In case of property purchased on contract, the signature of the contract purchaser, as shown by the records of the
County Auditor, shall be deemed sufficient. without the signature of his or her spouse.
4. Any officer of a corporation owning land within the annexation area who is duly authorized to execute deeds or
encumbrances on behalf of the corporation, may sign on behalf of such corporation, and shall attach to the petition a
certified excerpt from the bylaws of such corporation showing such authority.
5. When property stands in the name of a deceased person or any person for whom a guardian has been appointed, the
signature of the executor, administrator, or guardian, as the case may be. shall be equivalent 10 the siønature of the
owner of Ihe property.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
AUBURN, WASHINGTON, ACCEPTING THE SIXTY PERCENT
PETITION TO ANNEX CERTAIN PROPERTY LOCATED IN KING
COUNTY ADJACENT TO THE CITY'S WESTERN BOUNDARY
AND SETTING A PUBLIC HEARING THEREFOR
WHEREAS, the City of Auburn, Washington, received an application
(ANX05-0003) to annex two parcels of land with a total area of nine (9) acres
located in King County adjacent to the City's western boundary; and
WHEREAS, at a regularly scheduled Council meeting on May 1'6, 2005,
the City Council authorized City staff to prepare the necessary anl1exation
petition stating that said area, if annexed by the City of Auburn, will assume the
pro rata portion of the existing bonded indebtedness of the City of Auburn; and
WHEREAS, the City received a signed petition from the property owner of
both parcels, thereby representing 100% of the assessed valuation of the
property lying within the limits of the proposed annexation area; and
WHEREAS, on June 14, 2005, the King County Assessor declared that
the petition was sufficient to meet the statutory requirements for a petition to
annex,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, IN A REGULAR MEETING DULY ASSEMBLED DOES
HEREBY RESOLVE THAT:

Section 1. The City of Auburn hereby accepts the Sixty-percent Petition
for Annexation received in connection with the requested annexation and hereby
sets a Public Hearing for July 18,2005, at 7:30 p.m., or as soon thereaft'~r as the
matter may be heard, at the Auburn City Council Chambers, Auburn City Hall, 25
West Main Street, Auburn, Washington, for the City Council to hear all persons
wishing to speak to said annexation, and to consider its position with respect to
the annexation.
Section 4. The Mayor is hereby authorized to implement administrative
procedures necessary to carry out the directives of this legislation.
Section 5. That this Resolution shall take effect and be in full force
upon passage and signatures hereon.
