Lewis called the meeting to order at 7:30 p.m. and led those in attendance in the Pledge of Allegiance. B. Roll Call Mayor Lewis and the following Councilmembers were present: Rich Wagner, Sue Singer, Gene Cerino, Nancy Backus, Bill Peloza, and Roger Thordarson. Councilmember Lynn Norman was excused. Staff members present included: Police Chief Jim Kelly, Assistant Fire Chief Mike Gerber, Human Resources and Risk Management Director Brenda Heineman, Parks and Recreation Director Daryl Faber, Recreation Manager Brian Petty, Finance Director Shelley Coleman, Information Services Director Lorrie Rempher, Planning and Community Development Director Paul Krauss, City Attorney Daniel B. Heid, City Engineer Dennis Selle, Planner Bill Mandeville, Teen Coordinator Jim Westhusing, and Deputy City Clerk Cathy Richardson. C. Announcements and Appointments 1. Announcements a) White River Park and Refuge Proposal Senator Pam Roach reported on efforts to acquire approximately 2,500 acres along the White River for a park and wildlife refuge. Senator Roach distributed documentation and maps related to the Puget Sound Energy (PSE) White River property. Senator Roach commended the Lake Page 1 City of Auburn Council Meeting Minutes July 5, 2005 Tapps Task Force and community efforts involved in saving Lake Tapps. Now that the project is complete, PSE has no further need for the property they were required to maintain while the hydro project was operating. The property lies 56% within Pierce County and 44% within King County along the White River. Senator Roach spoke of the tremendous opportunity and potential to create a wildlife refuge and recreational public access area. PSE has ordered a formal appraisal, which should be available within the next two weeks. The conservancy agreement with Cascade Water Conservancy requires that PSE retain 500 of the 3,000 acres of the property to be used as mitigation. Senator Roach spoke of a multitude of recreational activities that the PSE property could provide for the public, including horseback riding, camping, hiking, cycling, and fishing. Senator Roach also spoke regarding her quest for support and appropriation of funds regarding the purchase of the PSE property and the various groups, cities, and government officials and entities she has contacted in her endeavors. Senator Roach recommended a strong movement towards public education, acquiring federal, state, and county funding for the purchase of the PSE property, regional planning for use of the property, and planning for support and maintenance for a public access regional park. Senator Roach spoke regarding the economic and recreational benefits to surrounding cities the addition of a recreational public access area would provide. In response to questions from Councilmembers Thordarson, Peloza, Wagner, and Cerino, Senator Roach expressed concerns in partnering with private entities. Her major concerns related to retaining public access, public input related to usage of the property, and possible covenants that might be attached to the property. Senator Roach stated that the appraisal should be available within the next two weeks and the property could be on the market as Page 2 City of Auburn Council Meetina Minutes July 5. 2005 soon as six months from completion of the appraisal. The County must be in a position to move quickly when the property becomes available for purchase. The appraisal will be on current assessed value and zoning and will be in component format with regard to land and timber value, etc. The subject property lies east of the urban growth boundaries of both King and Pierce counties. The 500 acres referred to in the conservancy agreement can be divided to allow possible access through the area. There are many possibilities regarding the configuration of the 500 acres. Senator Roach reported that there is strong legislative and county support for the project. Senator Roach encouraged Councilmembers to express municipal support for the project in the form of a resolution. Mayor Lewis thanked Senator Roach for her presentation. b) Proclamation "Recreation and Parks Month" Mayor Lewis declared the month of July, 2005 as "Recreation and Parks Month" in the City of Auburn. Mayor presented the Proclamation to Parks and Recreation Director Daryl Faber. c) Outstanding Teen Services Professional Mayor Lewis and Parks and Recreation Director Faber presented Teen Coordinator Jim Westhusing with the Washington Recreation and Parks Association Outstanding Teen Services Professional Award. Director Faber stated that the award was presented to Mr. Westhusing at the Washington Recreation and Parks Association Annual Conference. Mr. Westhusing was recognized at the conference as the Outstanding Teen Service Coordinator in Washington State for year 2005. Director. Faber thanked Mr. Westhusing for his dedication to the teens in the City of Auburn. Mr. Westhusing leads teens in the City's Page 3 City of Auburn Council Meeting Minutes July 5, 2005 Late Night Program, Teen Council, Pea Patch Program, and many other City events and activities. 2. Appointments There were no appointments for Council consideration. D. Agenda Modifications Agenda modifications included transmission of revised Ordinance Nos. 5921 and 5923, transmission of Ordinance No. 5926, and also corrected a scrivener's error in the title of Resolution No. 3869. It. CITIZEN INPUT, PUBLIC HEARINGS & CORRESPONDENCE A. Public Hearings No public hearing was scheduled for this evening. B. Audience Participation This is the place on the agenda where the public is invited to speak to the City Council on any issue. Leonard Couch, 1203 28th Street SE, Auburn Mr. Coach thanked Mayor Lewis and Councilmembers for approving the contract with Bonnie Tours for senior outings. Mr. Couch and his wife have attended other outings provided by Bonnie Tours and have been very pleased with their service. C. Correspondence No correspondence was submitted for Council review. III. COUNCIL COMMITTEE REPORTS A3.7.6 A. Municipal Services Chair Cerino reported that the Municipal Services Committee met this evening at 5:00. The Committee discussed and recommends approval of Ordinance Nos. 5921, 5923 and 5924. The Committee also discussed Ordinance No. 5920 and received a report from Information Services (IS) Director Lorrie Rempher on laptop replacement for Police Department vehicles. The next regular meeting of the Municipal Services Committee is scheduled for July 18, 2005 at 5:00 p.m. B. Planning & Community Development Vice Chair Cerino reported the Planning and Community Development Committee met on June 27, 2006 at 5:00 p.m. The Page 4 City of Auburn Council Meeting Minutes July 5, 2005 Committee held a public hearing on Application No. WSC04-0015 and discussed Ordinance Nos. 5925 and 5927, and Resolution Nos. 3866, 3867, and 3869. The Committee also discussed the 2005 Community Development Block Grant (CDBG) budget. The regular meeting of the Planning and Community Development Committee scheduled for July 11, 2005 at 5:00 p.m. has been cancelled. The next regular meeting of the Planning and Community Development Committee is scheduled for July 25, 2005 at 5:00 p.m. C. Public Works Chair Wagner reported that the Public Works Committee met on June 27, 2005 at 3:30 p.m. The Committee approved Right of Way Use permits and discussed and recommends approval of contract administration items and Ordinance No. 5926. The Committee also discussed water and sewer availability for Hazel Heights, off-street parking, and possible regulations related to boats parked in front yards. The Committee also received a report on a commercial spray head replacement program for water conservation purposes, discussed the 2006-2011 Transportation Improvement Program, received updates on the State Route 164 and State Route 167 Corridor studies, and discussed Fourth Street NE sewer service changes and a possible Local Improvement District (LID) for sidewalks. The Committee also had a preview of the ITS cameras being installed on Auburn Way South. The next regular meeting of the Public Works Committee is scheduled for July 11, 2005 at 2:00 p.m. D. Finance Chair Backus reported that the Finance Committee met this evening at 6:30. The Committee discussed and recommends approval of claims and payroll vouchers and Ordinance No. 5920. The Committee also discussed Ordinance No. 5924 and received a report from Director Rempher on replacement laptops for Police Department vehicles. The next regular meeting of the Finance Committee is scheduled for July 18, 2005 at 6:30 p.m. IV. COLINCILMEMBER REPORTS At this time Councilmembers may report on items not specifically described on the agenda, which are of interest to the community. Mayor Lewis noted that the ITS camera equipment is included in the existing cable franchise agreement. Page 5 City of Auburn Council Meeting Minutes July 5, 2005 Councilmember Singer reported that she has been working on economic development for the City of Auburn. She has spoken with managers of high-tech and environmental companies to encourage them to locate in Auburn and also with Pacific Lutheran University and Green River Community College with regard to economic development around the Auburn Environmental Park. She is also working through Puget Sound Regional Council to encourage more elected officials to become involved in that organization. She attended the Association of Washington Cities (AWC) Annual Conference, the 80th birthday celebration for the Auburn Area Chamber of Commerce, and the City of Auburn Fourth of July celebration at Les Gove Park. Councilmember Wagner reported that he attended a Kiwanis Club meeting, the Miss Washington Pageant, and the Freight Summit. Councilmember Backus reported that she and Councilmember Wagner attended Auburn's KidsDay. She also attended the sign dedication for Kathy Soriano who was killed by a drunk driver, East Main Street Neighborhood meeting, City of Auburn Fourth of July celebration at Les Gove Park, and the Miss Washington Pageant. Councilmember Cerino reported that he attended the AWC Annual Conference and the sign dedication for Kathy Soriano. He and Councilmember Wagner also attended the first annual Washington State Bocce Ball Tournament in the City of Auburn. Councilmember Thordarson reported that he attended the AWC Annual Conference, South King County Council of Human Services Annual Luncheon, sign dedication for Kathy Soriano, Freight Summit, and toured the new facilities of Valley Cities Counseling and Consultation. Councilmember Peloza reported that he attended the AWC Annual Conference, 80th birthday celebration for the Auburn Area Chamber of Commerce, the City of Auburn Fourth of July celebration at Les Gove Park, recycling event staffed by City employees and volunteers for the annexed Lea Hill area, South King County Council of Human Services Annual Luncheon, and the East Main Street Neighborhood meeting. Councilmember Peloza also reported that he missed the King County Regional Water Quality Control special meeting, but was able to watch the two hour meeting on KCTV, Channel 22. Mayor Lewis reported that he has attended fifty-six meetings in the last week and a half, including the swearing in of a new Auburn police officer in the Massey Room at the Auburn Justice Center and the South King Page 6 City of Auburn Council Meeting Minutes July 5, 2005 County Human Services Luncheon. Mayor Lewis reviewed human services supported by the City of Auburn and the movement towards organizing inter -jurisdictional multi -service centers due to loss of revenues by local governments. Mayor Lewis also reported the he and all Councilmembers attended the sign dedication for Kathy Soriano, and he attended the ribbon cutting ceremony for Jiffy Lube, East Main Street Neighborhood meeting, 80th birthday celebration for the Auburn Area Chamber of Commerce, City of Auburn Fourth of July celebration at Les Gove Park, and the Northwest Family Church service honoring flag, country, and armed services personnel. V. CONSENT AGENDA All matters listed on the Consent Agenda are considered by the City Council to be routine and will be enacted by one motion in the form listed. A. Minutes 1. C. Contract Administration 1. Community Development Block Grant Program Year 2004 Amendment City Council to call for a public hearing to be held August 1, 2005 to receive public comment on a proposed amendment to the Program Year 2005 Action Plan for the City of Auburn's Consolidated Plan. Councilmember Singer moved and Councilmember Wagner seconded to approve the Consent Agenda. MOTION CARRIED UNANIMOUSLY. 6-0. VI. UNFINISHED BUSINESS There was no unfinished business. VII. NEW BUSINESS There was no new business. VIII. ORDINANCES AND RESOLUTIONS A. Ordinances 1. Ordinance No. 5920 A3.8.23 An Ordinance of the City Council of the City of Auburn, Washington, amending Chapter 2.76 of the Auburn Municipal code relating to the Auburn Tourism Board Councilmember Backus moved and Councilmember Singer seconded to introduce and adopt Ordinance No. 5920. MOTION CARRIED UNANIMOUSLY. 6-0. 2. Ordinance No. 5921 01.8, 05.1 Page 8 City of Auburn Council Meeting Minutes July 5, 2005 An Ordinance of the City Council of the City of Auburn, Washington, amending Section 10.58.040 of the Auburn City Code relating to use of skateboards and roller skates Councilmember Cerino moved and Councilmember Peloza seconded to introduce and adopt Ordinance No. 5921. MOTION CARRIED UNANIMOUSLY. 6-0. 3. Ordinance No. 5923 01.8 An Ordinance of the City Council of the City of Auburn, Washington, amending Auburn City Code Chapter 10.56, regarding the regulation of bicycles in the City of Auburn Councilmember Cerino moved and Councilmember Peloza seconded to introduce and adopt Ordinance No. 5923. MOTION CARRIED UNANIMOUSLY. 6-0. 4. Ordinance No. 5924 A3.8.1 An Ordinance of the City Council of the City of Auburn, Washington, amending Chapter 2.33 of the Auburn City Code relating to the Municipal Airport Advisory Board Councilmember Cerino moved and Councilmember Peloza seconded to introduce and adopt Ordinance No. 5924. MOTION CARRIED UNANIMOUSLY. 6-0. 5. Ordinance No. 5925 A3.8.12 An Ordinance of the City Council of the City of Auburn, Washington, repealing Chapter 2.69 of the Auburn City Code relating to the City of Auburn Library Board Councilmember Cerino moved and Councilmember Backus seconded to introduce and adopt Ordinance No. 5925. Councilmember Wagner suggested that a representative from the Parks and Recreation Department work with Friends of the Library in an advisory position. MOTION CARRIED UNANIMOUSLY. 6-0. 7. Ordinance No. 5927 03.4.1.7 An Ordinance of the City Council of the City of Auburn, Washington, to amend Exhibit "A" of Ordinance No. 5795 and authorize the Mayor to implement the approved changes Councilmember Cerino moved and Councilmember Backus seconded to introduce and adopt Ordinance No. 5926. MOTION CARRIED UNANIMOUSLY. 6-0. B. Resolutions 1. Resolution No. 3866 05.1 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk of the City of Auburn to amend a Concessionaire Agreement between the City and the Optimists Club of Auburn Washington for the concession operations at Game Farm Park Ballfields for 2005 Councilmember Cerino moved and Councilmember Backus seconded to adopt Resolution No. 3866. MOTION CARRIED UNANIMOUSLY. 6-0. 2. Resolution No. 3867 A3.13.8 Page 10 City of Auburn Council Meeting Minutes July 5. 2005 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk to execute an Outside Utility Extension Agreement between the City of Auburn and Hazel Heights, LLC, Fremantle Development, Baima and Holberg, and David and Clemence Baker for extension of water and sewer services to property located at 11112 SE 304th Street Councilmember Cerino moved and Councilmember Backus seconded to adopt Resolution No. 3867. Resolution No. 3869 03.1 ANX05-0002 A Resolution of the City Council of the City of Auburn, Washington, accepting the sixty percent petition to annex certain property located in King County adjacent to the City's western boundary and setting a public hearing therefor Councilmember Cerino moved and Councilmember Backus seconded to adopt Resolution No. 3869. MOTION CARRIED UNANIMOUSLY. 6-0. IX. MAYOR'S REPORT A. Executive Session Mayor Lewis recessed the meeting at 8:47 p.m. for a five-minute intermission and then to executive session for approximately fifteen minutes for the purpose of discussing property acquisition and potential litigation pursuant to RCW 42.30.110(1)(b) and (i).
