Background Summary: On July 5, 2005, the City Council adopted Resolution No. 3869 which accepted the sixty percent petition to annex the property known as the Nichols Annexation and set the date for public hearing on the petition for annexation for July 18, 2005. It is necessary to reschedule the public hearing from July 18, 2005 to August 1, 2005 in order to provide the appropriate public notice. Resolution No. 3872 amends Resolution No. 3869 to reflect the public hearing date of August 1, 2005. 03.1 ANX05-0002 Reviewed by Council & Committees: Reviewed by Departments & Divisions: ❑ Arts Commission COUNCIL COMMITTEES: ❑ Building ❑ M&O ❑ Airport ❑ Finance ❑ Cemetery ❑ Mayor ❑ Hearing Examiner ❑ Municipal Serv. ❑ Finance ❑ Parks ❑ Human Services ❑ Planning & CD ❑ Fire ❑ Planning ❑ Park Board ❑Public Works ❑ Legal ❑ Police ❑ Planning Comm. ❑ Other ❑ Public Works ❑ Human Resources ❑ Information Services Action: Committee Approval: ❑Yes []No Council Approval: ❑Yes ❑No Call for Public Hearing Referred to Until Tabled Until Councilmember: NormanStaff: Krauss MeetingDate: Jul 18, 2005 Item Number: VIII.B.3 AUBURN* MORE THAN YOU IMAGINED RESOLUTION NO. 3 8 7 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, AMENDING RESOLUTION NO. 3869 ACCEPTING THE SIXTY PERCENT PETITION TO ANNEX CERTAIN PROPERTY LOCATED IN KING COUNTY ADJACENT TO THE CITY'S WESTERN BOUNDARY AND SETTING A PUBLIC HEARING THEREFOR WHEREAS, the City of Auburn, Washington, received an application (ANX05-0002) to annex two parcels of land with a total area of nine (9) acres located in King County adjacent to the City's western boundary; and WHEREAS, at a regularly scheduled Council meeting on May 16, 2005, the City Council authorized City staff to prepare the necessary annexation petition stating that said area, if annexed by the City of Auburn, will assume the pro rata portion of the existing bonded indebtedness of the City of Auburn; and WHEREAS, the City received a signed petition from the property owner of both parcels, thereby representing 100% of the assessed valuation of the property lying within the limits of the proposed annexation area; and WHEREAS, on June 14, 2005, the King County Assessor declared that the petition was sufficient to meet the statutory requirements for a petition to annex the property and WHEREAS, on July 5, 2005, the City Council of the City of Auburn, Washington, adopted Resolution No. 3869 accepting the sixty percent petition to annex the property (known as the Nichols Annexation) and set the date for public hearing on the petition for annexation for July 18, 2005; and Resolution No. 3872 July 12, 2005 Page 1 of 3 WHEREAS, it is necessary to reschedule the public hearing on the petition for annexation to ensure that appropriate public notice is provided. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, IN A REGULAR MEETING DULY ASSEMBLED DOES HEREBY RESOLVE THAT: Section 1. Section 1 of Resolution No. 3869 is hereby amended to read as follows: Section 1. The City of Auburn hereby accepts the Sixty - percent Petition for Annexation received in connection with the requested annexation and hereby sets a Public Hearing for July 19, 2005 August 1, 2005, at 7:30 p.m., or as soon thereafter as the matter may be heard, at the Auburn City Council Chambers, Auburn City Hall, 25 West Main Street, Auburn, Washington, for the City Council to hear all persons wishing to speak to said annexation, and to consider its position with respect to the annexation. Section 2. The Mayor is hereby authorized to implement administrative procedures necessary to carry out the directives of this legislation. Section 3. That this Resolution shall take effect and be in full force upon passage and signatures hereon.
