Background Summary:
In June 2005 the City of Auburn accepted an "Application for Annexation" from James Stipp, 32810 56th
Avenue South, for a single parcel that he owns which is located adjacent to the north-western boundary
of the city limits up on West Hill. The parcel (Parcel #9262800325) is approximately 4 acres. Mr. Stipp
plans to subdivide the property in conjunction with the proposed Nichols annexation.
City staff prepared the annexation petition. In August 2005 the City received the signed petition back
from Mr. Stipp. Staff submitted the petition to the King County Assessor, who verified that it meets the
statutory requirements for the 60% petition method of annexation. Attached is the King County
"Annexation Petition Certification".
Staff request the Council consider the petition and, if accepted, schedule a public hearing for it on
September 19th. The public hearing on the Nichols Annexation was suspended pending the Council
hearing public testimony about the Stipp Annexation. Consequently, Staff request the Council resume
the public hearing on the Nichols Annexation as well.
Attached is a resolution asking the Council accept the 60% petition for annexation and schedule a public
hearing prior to submitting its intent to annex the Stipp property with the King County Boundary Review
Board. If the Review Board finds its acceptable, then an ordinance to effect the annexation will be
prepared and submitted to Council for review and approval.

RESOLUTION NO. 3898
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
AUBURN, WASHINGTON, ACCEPTING A SIXTY PERCENT
PETITION TO ANNEX CERTAIN PROPERTY LOCATED IN KING
COUNTY ADJACENT TO THE CITY'S NORTHWESTERN
BOUNDARY AND SETTING A PUBLIC HEARING THEREFOR
WHEREAS, the City of Auburn, Washington, received an application
(ANX05-0004) to annex one parcel of land with a total area of four (4) acres
located in King County adjacent to the City's northwestern boundary; and
WHEREAS, at a regularly scheduled Council meeting on June 6, 2005,
the City Council authorized City staff to prepare the necessary annexation
petition stating that said area, if annexed by the City of Auburn, will assume the
pro rata portion of the existing bonded indebtedness of the City of Auburn; and
WHEREAS, the City received a signed petition from the property owner of
the parcels, thereby representing 100% of the assessed valuation of the property
lying within the limits of the proposed annexation area; and
WHEREAS, it is necessary to schedule the public hearing on the petition
for annexation to ensure that appropriate public notice is provided.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, IN A REGULAR MEETING DULY ASSEMBLED DOES
HEREBY RESOLVE THAT:
Section 1. The City of Auburn hereby accepts the Sixty -percent Petition
for Annexation received in connection with the requested annexation and hereby
sets a public hearing for September 19, 2005 at 7:30 p.m., or as soon thereafter

as the matter may be heard, at the Auburn City Council Chambers, Auburn City
Hall, 25 West Main Street, Auburn, Washington, for the City Council to hear all
persons wishing to speak to said annexation, and to consider its position with
respect to the annexation.
Section 2. The Mayor is hereby authorized to implement administrative
procedures necessary to carry out the directives of this legislation.
Section 3. That this Resolution shall take effect and be in full force
upon passage and signatures hereon.

ANNEXATION PETITION CERTIFICATION
THIS IS TO CERTIFY that the petition submitted August 3, 2005 to
the King County Department of Assessments by F.W. 'Bill"
Mandeville, Planner for the City of Auburn, supporting the
annexation to Auburn of the property described as the Stipp
Annexation, has been examined, the property taxpayer, tax parcel
number, and assessed value of the property listed thereon carefully
compared with the King County tax roll records, and as a result of
such examination, found to be sufficient under the provisions of the
New Section of Revised Code of Washington, Section 35.13.002.
The Department of Assessments has not verified that the signature
on the petition is valid through comparison with any record of actual
signatures, nor that the signature was obtained or submitted in sin
appropriate time frame, and this document does not certify such to
be the case.
