Background Summary: In May 2005 the City of Auburn accepted an "Application for Annexation" from Steve Nichols (32516 58th Avenue South) for two parcels that he owns which is located adjacent to the west boundary of the city limits up on West Hill. The parcels (Parcel #9262800210 and Parcel #9262800280) are each approximately 4.5 acres. The total area of the annexation is nine acres. Mr. Nichols currently resides on one of the parcels. He plans to subdivide the property. City staff prepared the annexation petition. In June 2005 City received the signed petition back from Mr. Nichols. On June 14th the King County Assessor certified the petition was sufficient to meet the statutory requirements for the 60% petition method of annexation. On August 1 the City Council held a public hearing on the proposed annexation. Since the Nichols annexation will depend upon the outcome of the Stipp annexation for its street access, the City Council moved to continue the public hearing at the same time it hears public testimony about the Stipp Annexation. The public hearing on the Stipp Annexation is scheduled for September 19. Staff request the Council consider the petition and, if accepted, pass Resolution 3876 authorizing filing the City of Auburn's intent to the two parcels referred to as the Nichols annexation. If the Review Board finds the proposed annexation acceptable, then an ordinance to effect the annexation will be prepared and submitted to Council for review and approval. PLEASE NOTE 1. The signature of the record owner, as determined by the records of the County Auditor, shall be sufficient without the signature of his or her spouse. 2. In case of mortgaged property, the signature of the mortgagor shall be sufficient without the signature of his or her spouse. 3. In case of property purchased on contract, the signature of the contract purchaser, as shown by the records of the County Auditor, shall be deemed sufficient, without the signature of his or her spouse. 4. Any officer of a corporation owning land within the annexation area who is duly authorized to execute deeds or encumbrances on behalf of the corporation, may sign on behalf of such corporation, and shall attach to the petition a certified excerpt from the bylaws of such corporation showing such authority. 5. When property stands in the name of a deceased person or any person for whom a guardian has been appointed, the signature of the executor, administrator, or guardian, as the case may be, shall be equivalent to the signature of the owner of the property. W. `Bill" Mandeville, Planner for the City of Auburn, supporting the annexation to Auburn of the properties described as the Nichols Annexation, has been examined, the property taxpayers, tax parcel numbers, and assessed value of properties listed thereon carefully compared with the King County tax roll records, and as a result of such examination, found to be sufficient under the provisions of the New Section of Revised Code of Washington, Section 35.13.002. The Department of Assessments has not verified that the signature on the petition is valid through comparison with any record of actual signatures, nor that the signature was obtained or submitted in an appropriate time frame, and this document does not certify such to be the case.
