Background Summary: On May 16, 2005, City Council authorized the Mayor to execute Consultant Agreement No. AG-C-248 with Gordon, Thomas, Honeywell, Malanca, Peterson & Daheim LLP for legal representation related to the Cascade Water Alliance (CWA) and the Puget Sound Energy (PSE) water right applications for the Lake Tapps Project. The legal representation from the firm was provided by attorney Peter Eglick, who has represented the City in regard to CWA since 2003 when he was with Helsell & Fetterman. Mr. Eglick now has his own firm, and it is desirable for the City to continue to have him work on the CWA issue because of his knowledge and experience in this area. Eglick Kiker Whited will be providing legal services relating to the PSE water right applications for the Lake Tapps project, which PSE is under contract to sell to CWA for municipal water supply. The work includes an appeal of the water rights issued by the Department of Ecology (DOE) before the Pollution Control Hearings Board, litigation in Superior Court relating to the Determination of Non-Significance issued by CWA for their Transmission and Supply Plan, and related advice and representation in other forums as may arise, including the King County Water Supply planning process. The City has spent over $300,000 for related services to date. The not-to-exceed amount for Agreement No. AG-C-248 with Gordon, Thomas, Honeywell, Malanca, Peterson & Daheim LLP had a not-to-exceed amount of $150,000. Thus far, approximately $40,000 has been spent on this agreement, and the pending final invoice is anticipated to be approximately $2,000. The not-to-exceed amount for Agreement No. AG-C-257 with Eglick Kiker Whited is $40,000, which is budgeted in the Water Fund for 2005, under professional services.
