Background Summary:
One of the constant problems with which cities in this state must contend, and to which police frequently
respond are domestic violence situations. The City of Auburn is not unique in that regard and it faces a
number of domestic violence violations that occur within its corporate jurisdiction. To better equip the City
to address those problems, state law has provided an opportunity for the collection of a domestic violence
penalty assessment, in which courts of this state, including the Auburn Municipal Court, are authorized to
collect.
In order to address the collection of this assessment (a discretionary decision by the Court), it is
appropriate that a fund be created since the statute that authorizes collection of these funds, also
imposes limitations on how it can and cannot be used. For instance, the statute authorizes the use of the
funds for establishment of domestic violence advocacy and domestic violence prevention and prosecution
programs but precludes use of these funds for indigent criminal defense. The statute also provides that
these assessments shall be in addition to and shall not supersede any other penalties, fines or costs
provided by law. In order to put the City in the position of being able to collect and utilize these funds in
terms of their limited use, it would be appropriate for a fund to be created that establishes the parameters
set forth in state law (RCW 10.99.080).
