Background Summary: The Hearing Examiner on August 16, 2005 conducted an open record hearing on the request of Monte Adams, for rezoning of 13.14 acres from RR (Rural Residential) and RMHP (Residential Mobile Home Park) to R3 (Duplex Residential). The majority of the parcel is currently designated RR (Rural Residential) (the western approximately 12.62 acres) while the portion zoned RMHP (Residential Mobile Home Park) is limited to the extreme northeastern corner (approximately 0.52 acres) where the access road to the adjacent mobile home park bisects the site. The site is currently vacant. The rezone is sought in order to develop a preliminary plat referred to as “Adams Vista” in accordance with the requirements of the R3 (Duplex Residential) zoning district. The site is located east of the southern terminus of Hemlock Street SE. The site is located between the Auburn Way South and the White River. The Hearing Examiner’s recommendation differed from the staff’s recommendation since it recommended denial of the rezone from RR (Rural Residential) to R3 (Duplex Residential) for the southern 6.2 acres of the site that is steeply sloped and proposed to be tract (Tract B) dedicated to the City of Auburn as part of the associated preliminary plat. On September 28, 2005 a Request for Reconsideration was filed by Jane Ryan Kohler on behalf of Frary Breckenridge. On October 11, 2005 the applicant’s representative, Hans Korve, provided a letter to the Hearing Examiner responding to the Request for Reconsideration. The Hearing Examiner ruled on the Request for Reconsideration by adding a plat condition (Condition Number 9) regarding installation of protective fencing for trees to be retained. On October 12, City staff made a written request for clarification to the Hearing Examiner of his decision. On October 21, 2005 the Hearing Examiner issued a decision modifying Condition Number 9 of his earlier decision and to replace “qualified professional forester” with “certified arborist”. The City has received written confirmation from the applicant that exceeding the 120-day permit processing timeframe is acceptable. Page 2 of 2
