Background Summary:
The current provisions of the Auburn City Code call for impounded vehicles to be stored in tow lots
located within the City limits. However, because there is a limited availability of tow yards within the City
of Auburn, it is appropriate that the code be amended to accommodate tow yards located within a
reasonable distance of the city limits (not just within the city limits). The language of Ordinance Number
5984 seeks to make such an amendment. This is also consistent with the ongoing efforts of the City to
contract for tow services so that the services and the fees are controlled or at least uniform within the City
of Auburn.

AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF AUBURN, WASHINGTON, AMENDING
SECTION 10.40.100 OF THE AUBURN CITY CODE
RELATING TO IMPOUNDMENT OF VEHICLES
WHEREAS, state law places on cities responsibilities for impounding
certain vehicles for various reasons, to maintain control over the streets and
rights-of-way within their jurisdiction; and
WHEREAS, the current provisions of the Auburn City Code call for
impounded vehicles to be stored in lots within the city limits, however, there may
be times when there are not lots available within the city limits in which
impounded cars may be located, so that it would be appropriate for the
impounded vehicles to be taken to lots within a reasonable distances of the city
limits.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, DO ORDAIN as follows:
Section 1. Amendment to City Code. That section 10.40.100 of
the Auburn City Code be and the same hereby is amended to read as follows:
10.40.100 Violation — Vehicle impoundment.
In addition to the penalties specified in ACC 10.40.040 through 10.40.090,
the police department of the city may impound any vehicle parked in a municipal
off-street parking facility of the city in violation of ACC 10.40.010 through
10.40.025 and ACC 10.40.035. Any vehicle impounded pursuant to the terms of
this chapter shall be placed in such storage lot within the city limits, or within a
reasonable distance of the city limits, as may be convenient to the police
department, and all charges for storage shall be paid by the registered owner of

the vehicle before the owner or any other person may take possession thereof.

Section 2. Implementation. The Mayor is hereby authorized to
implement such administrative procedures as may be necessary to carry out the
directions of this legislation.
Section 3. Severability. The provisions of this ordinance are
declared to be separate and severable. The invalidity of any clause, sentence,
paragraph, subdivision, section or portion of this ordinance, or the invalidity of the
application thereof to any person or circumstance shall not affect the validity of
the remainder of this ordinance, or the validity of its application to other persons
or circumstances.
Section 4. Effective date. This Ordinance shall take effect and be
in force five days from and after its passage, approval and publication as
provided by law.
