Backoround Summary:
The Hearing Examiner on December 7, 2005 conducted an open record hearing on the request of Brian
McCabe of Investco Financial Corporation (applicant) for a planned unit development (PUD) known as
"Auburn 40". The PUD request consists of rezoning a 38.48-acre site from R2 (Single Family Residential)
to PUD (Planned Unit Development). The project also consists of preliminary plat approval to subdivide
the site into 236 single-family lots and 27 tracts. The site is generally, west of the Green River and east
of I Street NE, if extended, in the 4200-4300 block. The site is within the SE Y. of Section 31, Township
22 Range 5 East, W.M.
The Hearing Examiner's recommendation issued on January 10, 2006 is for approval of the rezone from
R2 (Single Family Residential) to PUD (Planned Unit Development) with twenty-three (23) conditions and
approval of the preliminary plat with fifteen (15) conditions.
The City Council may now, either affirm the Examiner's decision, remand to the Hearing Examiner with
direction for changes or schedule a closed record hearing. The Council can only modify or disaffirm the
Examiner's decision after conducting its own closed record hearing. Staff is recommending that the City
Council conduct a closed record hearing based on staff's understanding of the Council practices based
on recent cases.
The timeframe (seven calendar days) for any person to file a Reconsideration of the Hearing Examiner's
recommendation in accordance with ACC 18.66.150 will expire 5:00 PM on Tuesday, January 17, 2006,
the same day of the City Council Meeting. Should a reconsideration request be filed with the City, the
rezone to PUD and Preliminary plat cases will be removed from the City Council meeting agenda.
