Background Summary: The City of Auburn owns an existing storm drainage facility on "A" Street SE at 358`h. The property is currently in the unincorporated island of King County. Pursuant to RCW 35A.14.300 the City may annex city owned property for municipal purposes whether the property is adjacent to the City Limits or not. The property should be annexed which would allow for the City's police to respond to any issues as well as any future permitting Would be through the City as opposed to King County. After the adoption of this ordinance the next step will be the preparation of a "notice of intention" to annex which will be forwarded to the King County Boundary Review Board for their review. The PCD Committee reviewed the proposal on January 9, 2006 and recommended approval. El Finance ❑ Parks El Human Services ® Planning & CD El Fire El Planning ❑ Park Board ❑Public Works ❑ Legal ❑Police ❑ Planning Comm. ❑ Other ❑ Public Works ❑ Human Resources ❑ Information Services Action: Committee Approval: ❑Yes []No Council Approval: ❑Yes ❑No Call for Public Hearing Referred to Until Tabled Until Councilmember: Norman Staff: Krauss Meeting Date: January 10, 2006 Item Number: VIII.A.2 AUBURN* MORE THAN YOU IMAGINED ORDINANCE NO. 5 9 7 9 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, ANNEXING THE EAST SIDE OF "A" STREET SOUTHEAST AND SOUTH OF SOUTH 358TH STREET INTO THE CITY FOR MUNICIPAL PURPOSES WHEREAS, pursuant to Section 35A.14.300 of the Revised Code of Washington (RCW), legislative bodies of code cities may by a majority vote annex territory outside the limits of such city, whether contiguous or not contiguous for any municipal purpose when such territory is owned by the city; and, WHEREAS, the City of Auburn owns property located on the east side of "A" Street Southeast and south of South 358th Street, for which it has a municipal purposes, to wit: storm drainage facilities; and, WHEREAS, in accordance with RCW 35A.14.300, the City Council desires to annex said territory into the City of Auburn. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN as follows: Section 1. The City of Auburn owns property located on the east side of "A" Street Southeast and south of South 358th Street legally described as follows: LOTS 1,2,3,6,7,8,9 AND 10 OF BLOCK 6 SOUTH AUBURIN GARDEN TRACTS AS RECORDED IN THE RECORDS OF KING COUNTY WASHINGTON VOLUME 20 PAGE 76; TOGETHER WITH THE S. 358TH RIGHT OF WAY THAT ABUTS SAID LOTS 1 AND 10; TOGETHER WITH THE S. 359TH RIGHT OF WAY THAT ABUTS SAID LOT 6. -------------------------------- Ordinance No. 5979 January 3, 2006 Page 1 Section 2. The City Council finds that said property should be used for municipal purposes, to wit: storm drainage facilities. Section 3. That the City Council hereby annexes said property into the City of Auburn pursuant to the authority of RCW 35A.14.300. Section 4. Implementation. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directions of this legislation. Section 5. Severability. The provisions of this ordinance are declared to be separate and severable. The invalidity of any clause, sentence, paragraph, subdivision, section or portion of this ordinance, or the invalidity of the application thereof to any person or circumstance shall not affect the validit�f of the remainder of this ordinance, or the validity of its application to other persons or circumstances. Section 6. Effective date. This Ordinance shall take effect and be in force five days from and after its passage, approval and publication as provided by law. INTRODUCED: PASSED: APPROVED: PETER B.
