Background Summary:
The City of Auburn owns an existing parcel of property (Auburndale Park) which is located south of the
BPA power lines between 116th and 118th Avenues SE. The property is currently vacant and the future
use will be for park purposes. The property is currently in the unincorporated Lea Hill area of King County.
Pursuant to RCW 35A.14.300 the City may annex city owned property for municipal purposes whether
the property is adjacent to the City Limits or not.
The property should be annexed which would allow for the City's police to respond to any issues as well
as any future permitting would be through the City as opposed to King County.
After the adoption of this ordinance the next step will be the preparation of a "notice of intention" to annex
which will be forwarded to the King County Boundary Review Board for their review.
The PCD Committee reviewed the proposal on January 9, 2006 and recommended approval.

AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF AUBURN, WASHINGTON, ANNEXING
SOUTH OF THE BPA POWER LINES BETWEEN
116TH AVENUE SOUTHEAST AND 118TH AVENUE
SOUTHEAST INTO THE CITY FOR MUNICIPAL
PURPOSES
WHEREAS, pursuant to Section 35A.14.300 of the Revised Code of
Washington (RCW), legislative bodies of code cities may by a majority vote
annex territory outside the limits of such city, whether contiguous or not
contiguous for any municipal purpose when such territory is owned by the city;
and,
WHEREAS, the City of Auburn owns property located south of the BPA
power lines between 116th Avenue Southeast and 118th Avenue Southeast, for
which it has a municipal purposes, to wit: for parks and recreation and/or open
spaces; and,
WHEREAS, in accordance with RCW 35A.14.300, the City Council
desires to annex said territory into the City of Auburn.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, DO ORDAIN as follows:
Section 1. The City of Auburn owns property located south of the BPA
power lines between 116th Avenue Southeast and 118th Avenue Southeast
legally described as follows:
LOT 4 OF THE SOUND TRUSTEE COMPANY'S THIRD
ADDITION AS RECORDED IN VOLUME 13 PAGE 100 OF THE
RECORDS OF KING COUNTY WASHINGTON

Section 2. The City Council finds that said property should be used for
municipal purposes, to wit: for parks and recreation and/or open spaces.
Section 3. That the City Council hereby annexes said property into the
City of Auburn pursuant to the authority of RCW 35A.14.300.
Section 4. Implementation. The Mayor is hereby authorized to
implement such administrative procedures as may be necessary to carry out the
directions of this legislation.
Section 5. Severability. The provisions of this ordinance are declared to
be separate and severable. The invalidity of any clause, sentence, paragraph,
subdivision, section or portion of this ordinance, or the invalidity of the application
thereof to any person or circumstance shall not affect the validity of the
remainder of this ordinance, or the validity of its application to other persons or
circumstances.
Section 6. Effective date. This Ordinance shall take effect and be in
force five days from and after its passage, approval and publication as provided
by law.
