Background Summary: The City of Auburn owns an existing parcel of property which is located on the south side of the cemetery. The property was given to the City by King County a few years ago. It is steep and the future use will likely be for open space purposes related to the cemetery or View Point Park. The property is currently in the unincorporated area of King County. Pursuant to RCW 35A.14.300 the City may annex city owned property for municipal purposes whether the property is adjacent to the City Limits or not. The property should be annexed which would allow for the City's police to respond to any issues as well as any future permitting would be through the City as opposed to King County. After the adoption of this ordinance the next step will be the preparation of a "notice of intention" to annex which will be forwarded to the King County Boundary Review Board for their review. The PCD Committee reviewed the proposal on January 9, 2006 and recommended approval. 1-0117-7 03.1 Reviewed by Council & Committees: Reviewed by Departments & Divisions: ❑ Arts Commission COUNCIL COMMITTEES: ❑ Building ❑ M&O ❑ Airport ❑ Finance ❑ Cemetery ❑ Mayor ❑ Hearing Examiner ❑ Municipal Serv. ❑ Finance ❑ Parks ❑ Human Services ® Planning & CD ❑ Fire ❑ Planning ❑ Park Board []Public Works ❑ Legal ❑ Police ❑ Planning Comm. ❑ Other ❑ Public Works ❑ Human Resources ❑ Information Services Action: Committee Approval: ❑Yes ❑No Council Approval: ❑Yes ❑No Call for Public Hearing Referred to Until Tabled Until — Councilmember: Norman Staff: Krauss Meeting Date: January 17, 2006 Item Number: VIII.A.4 AUBURN* MORE THAN YOU IMAGINED ORDINANCE NO. 5 9 8 1 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, ANNEXING PROPERTY LOCATED ON THE SOUTH SIDE OF MOUNTAIN VIEW DRIVE INTO THE CITY FOR MUNICIPAL PURPOSES WHEREAS, pursuant to Section 35A.14.300 of the Revised Code of Washington (RCW), legislative bodies of code cities may by a majority vote annex territory outside the limits of such city, whether contiguous or not contiguous for any municipal purpose when such territory is owned by the city; and, WHEREAS, the City of Auburn owns property located on the south side of Mountain View Drive, for which it has a municipal purposes, to wit: for parks and recreation and/or open spaces; and, WHEREAS, in accordance with RCW 35A.14.300, the City Council desires to annex said territory into the City of Auburn.
