Background Summary: The City of Auburn owns an existing parcel of property (Jacobsen Tree farm) which is located on the west side of 132nd Avenue South in the 29400 block. The property contains two single family hordes and the future use will be for park purposes. The property is currently in the unincorporated Lea Hill area of King County. Pursuant to RCW 35A.14.300 the City may annex city owned property for municipal purposes whether the property is adjacent to the City Limits or not. The property should be annexed which would allow for the City's police to respond to any issues as well as any future permitting would be through the City as opposed to King County. After the adoption of this ordinance the next step will be the preparation of a "notice of intention" to annex which will be forwarded to the King County Boundary Review Board for their review. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN as follows: Section 1. The City of Auburn owns property located on the west side of 132"d Avenue South in the 29400 block, legally described as follows: SITUATE IN SECTION 4 TOWNSHIP 21 NORTH RANGE 5 E.W.M., KING COUNTY WASHINGTON, MORE PARTICULARLY DESCRIBED AS FOLLOWS: THE SOUTH'/ OF THE SOUTHEAST'/ OF THE NORTHEAST 'Y OF SECTION 4 TOWNSHIP 21 NORTH RANGE 5 E.W.M., LESS COUNTY ROAD - 132ND AVENUE SE; TOGETHER WITH THE FOLLOWING DESCRIBED PARCEL; -------------------------------- Ordinance No. 5982 January 3, 2006 Page 1 BEGINNING AT THE NORTHWEST CORNER OF THE SOUTHEAST '/ OF THE NORTHEAST % OF SAID SECTION 4; THENCE SOUTHERLY ALONG THE WEST LINE OF SAID SOUTHEAST % 337.76 FT TO THE TRUE POINT OF BEGINNING (TPOB); THENCE S 87-36-42 E 1292.14 FT TO THE WEST MARGIN OF 132ND AVENUE SE; THENCE SOUTHERLY AL014G SAID WEST MARGIN 170.94 FT; THENCE N 87-41-44 W 120.01 FT; THENCE S 01-29-46 W 150.01 FT TO SOUTH LINE OF THE NORTH Y2 OF SAID SOUTHEAST '/; THENCE WESTERLY ALONG SAID SOUTH LINE 1172.53 FT TO THE WEST LINE OF SAID SOUTHEAST '/; THENCE NORTHERLY ALONG SAID WEST LINE 322.85 FT TO THE TPOB. Section 2. The City Council finds that said property should be used for municipal purposes, to wit: for parks and recreation and/or open spaces. Section 3. That the City Council hereby annexes said property into the City of Auburn pursuant to the authority of RCW 35A.14.300. Section 4. Implementation. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directions of this legislation. Section 5. Severability. The provisions of this ordinance are declared to be separate and severable. The invalidity of any clause, sentence, paragraph, subdivision, section or portion of this ordinance, or the invalidity of the application thereof to any person or circumstance shall not affect the validity of the remainder of this ordinance, or the validity of its application to other persons or circumstances. Section 6. Effective date. This Ordinance shall take effect and be in force five days from and after its passage, approval and publication as provided by law.
