Background Summary:
In June 2005 the City of Auburn accepted a ten (10) percent "Application for Annexation" from Patricia
Campbell on behalf of Community of Christ Church for the annexation of the parcel on which the church
is located 31808 116th Avenue SE. The boundaries of the proposed annexation included the Community
of Christ Church along with two adjacent parcels.
In August 2005 the City received two signed petitions representing 68% of the assessed valuation of the
three parcels. The owner of the parcel at 31822 116th Avenue S.E. did not sign a petition because he is
not in favor of the annexation. He requested that his property be excluded from the annexation. The City
Council complied with his request and removed his property from the annexation.
The City Council held a public hearing about the annexation on October 3rd and authorized staff to file
the City's intention to annex the property with the King County Boundary Review Board (KCBRB). The
KCBRB reviewed the annexation and approved it.
Attached is an ordinance to effect the annexation on February 1, 2006.

ORDINANCE NO. 5986
AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON,
ANNEXING APPROXIMATELY FIVE AND ONE-HALF ACRES OF
LAND LOCATED IN KING COUNTY AND ADJACENT TO THE
CORPORATE LIMITS OF THE CITY KNOWN AS THE
"COMMUNITY OF CHRIST CHURCH ANNEXATION"
WHEREAS, in accordance with Chapter 35A.14 RCW, the owners; of more
than 60% of value according to the assessed valuation for general taxation of
certain lands in King County, Washington, and more particularly described in
Section 1 of this ordinance, filed their petition with the City Council of the City of
Auburn, petitioning to have annexed to the City of Auburn the said described land;
and
WHEREAS, the King County Assessor's Office certified the aforesaid
petition containing the signatures of those property owners having an assessed
valuation of more than sixty (60) percent of the assessed valuation of the
annexation area; and
WHEREAS, the City of Council of the City of Auburn called for and
conducted a public hearing on the proposed annexation on October 3, 2005, and
thereafter authorized filing Auburn's intent to annex said property with the King
County Boundary Review Board; and
WHEREAS, the notice of intention to annex was filed with the King County
Boundary Review Board and subsequently approved; and

WHEREAS, it appears to the City of Auburn that said annexation meets the
requirements specified by law; to and including the consideration of the passage
of this ordinance also meets the requirements specified by law; and the lands
proposed to be annexed are contiguous to the City of Auburn and have not
heretofore been incorporated in as a city or town; and
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1. That there shall be annexed to the City of Auburn, Washington,
the property situated in the County of King, State of Washington, legally described
as follows:
THAT PORTION OF THE SOUTHWEST QUARTER OF THE
SOUTHWEST QUARTER OF SECTION 9, TOWNSHIP 21 NORTH,
RANGE 5 EAST, W.M. IN KING COUNTY WASHINGTON, DESCRIBED
AS FOLLOWS:
BEGINNING AT A POINT ON THE NORTH LINE OF THE SOUTH 201.5
FEET OF THE NORTHWEST QUARTER OF THE SOUTHWEST
QUARTER OF THE SOUTHWEST QUARTER OF SAID SECTION 9,
SAID POINT BEING THE SOUTHEAST CORNER OF LOT 6 OF THE
PLAT OF WINDSOR PLACE AS RECORDED IN VOLUME 159 OF
PLATS AT PAGES 15 THROUGH 17, RECORDS OF KING COUNTY,
WASHINGTON;
THENCE SOUTHERLY ALONG THE EAST LINE OF SAID NORTHWEST
QUARTER OF THE SOUTHWEST QUARTER OF THE SOUTHWEST
QUARTER OF SAID SECTION 9 AND ALONG THE EAST LINE OF THE

97 FEET OF THE NORTH 4 ACRES OF THE SOUTHWEST QUARTER

SAID SECTION 9 TO THE EAST MARGIN OF 116TH AVENUE
SOUTHEAST AND THE EAST LINE OF THE LANDS ANNEXED TO THE
CITY OF AUBURN IN ANNEXATION ORDINANCE 5346;
THENCE NORTHERLY ALONG SAID EAST LINE AND SAID EAST
MARGIN TO THE NORTH LINE OF THE SOUTH 201.5 FEET OF SAID
NORTHWEST QUARTER OF THE SOUTHWEST QUARTER OF THE
SOUTHWEST QUARTER OF SAID SECTION 9;
THENCE EASTERLY ALONG SAID NORTH LINE OF THE SOUTH 201.5
FEET OF SAID NORTHWEST QUARTER OF THE SOUTHWEST
QUARTER OF THE SOUTHWEST QUARTER OF SAID SECTION 9 TO
THE POINT OF BEGINNING.
Section 2. That the property hereby annexed shall be assessed and taxed
at the same rate and on the same basis as other property within the City of
Auburn is assessed and taxed to pay for any outstanding general indebtedness of
the City to which the area was annexed.
Section 3. That the annexation of the property will become effective at
12:01 AM on February 1, 2006 and the property shall become part of the City of
Auburn, subject to all of the laws and ordinances of the City then otherwise
provided by law.
Section 4. Within ten (10) days after the effective date of the annexation
referred to in this ordinance, the City Clerk of the City of Auburn shall send to the
Office of the Clerk of the County Council one (1) certified copy of this Ordinance
together with a copy of a letter from the Executive Secretary of the King County

Boundary Review Board, which letter contains a copy of the decision of the
Boundary Review Board relating to this annexation.
Section 5. The City Clerk of the City of Auburn shall record a certified copy
of this Ordinance with the King County Auditor's Office.
Section 6. The Mayor is hereby authorized to implement such
administrative procedures as may be necessary to carry out the directions of this
legislation.
Section 7. This Ordinance shall take effect and be in force five days from
and after its passage, approval and publication as provided by law.

RE: CLOSING LETTER FOR COMPLETED ACTION (WITH WAIVER)

Dear Mr. Mandeville:
We are writing to advise you that the Boundary Review Board has now completed the required
preliminary evaluation, as specified in RCW 36.93, for the above -referenced proposed action
filed with the Board effective: November 10, 2005.
The Boundary Review Board has determined that the proposed action is consistent with RCW
36.93. The Board waives further review of the proposed action on the basis that further review
is not necessary for the protection of the public interest (RCW 36.93.100).
The Boundary Review Board, therefore, hereby deems this proposed action approved, effective:
December 20, 2005. Final approval of the proposed action is also subject to the following
actions, where applicable:
1. Sewer and Water District actions and some other actions are also subject to approval by the
Metropolitan King County Council. If the Council makes changes to the proposal, the Board
may then be required to hold a public hearing.
2. Filing with King County of franchise application(s), as required, accompanied by a copy of
this letter.
3. Filing with King County of permit application(s), as required, accompanied by a copy of this
letter.
4. Fulfillment of all other statutory requirements and/or procedures specified in your Notice of
Intention.

5. Notification in writing of your intended effective date of annexation. This notification should
be provided as early as possible. Please send this information to Elissa Benson, Office of
Regional Policy and Planning, 516 Third Avenue, Room 420, Seattle, Washington 98104.
6. Filing with King County Council of : (1) one certified copy of your final resolution or
ordinance accomplishing this proposed action; and (2) a copy of this letter. This document
should be filed with the Clerk of the Council (Attn: Anne Noris), King County Courthouse,
Room 1025, Seattle, Washington 98104.
