City Council introduce and adopt Ordinance No. 5987.
Background Summary:
In May 2005 the City of Auburn accepted an "Application for Annexation" from Steve Nichols (32516
58th Avenue South) for two parcels that he owns located adjacent to the west boundary of the city limits
up on West Hill. The parcels (King County Assessor's Parcel #9262800210 and King County Assessor's
Parcel #9262800280) are each approximately 4.5 acres in size. The total area of the annexation is nine
acres. Mr. Nichols currently resides on one of the parcels. He plans to subdivide the properties
In June 2005 City received a signed 60% annexation petition from Mr. Nichols. The King County
Assessor certified the petition was sufficient to meet the statutory requirements for the 60% petition
method of annexation. The City Council held a public hearing on the annexation request on August 1 st
and again on September 19th in conjunction with the Stipp Annexation. The City Council passed
Resolution No. 3876 authorizing staff to file the City's intention to annex the property with the King
County Boundary Review Board (KCBRB). The KCBRB reviewed the annexation and approved it.
Attached is an ordinance to effect the annexation on February 1, 2006.

ORDINANCE NO. 5987
AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON,
ANNEXING APPROXIMATELY FOUR ACRES OF LAND LOCATED IN
KING COUNTY AND ADJACENT TO THE CORPORATE LIMITS OF
THE CITY KNOWN AS THE "NICHOLS ANNEXATION"
WHEREAS, in accordance with Chapter 35A.14 RCW, the owners of more
than 60% of value according to the assessed valuation for general taxation of
certain lands in King County, Washington, and more particularly described in
Section 1 of this ordinance, filed their petition with the City Council of the City of
Auburn, petitioning to have annexed to the City of Auburn the said described land;
and
WHEREAS, the King County Assessor's Office certified the aforesaid
petition containing the signatures of those property owners having an assessed
valuation of more than sixty (60) percent of the assessed valuation of the
annexation area; and
WHEREAS, the City of Council of the City of Auburn called for and
conducted a public hearing on the proposed annexation on August 1, 2005 and
September 19, 2005, and thereafter authorized filing Auburn's intent to annex said
property with the King County Boundary Review Board; and
WHEREAS, the notice of intention to annex was filed with the King County
Boundary Review Board and subsequently approved; and

WHEREAS, it appears to the City of Auburn that said annexation meets the
requirements specified by law; to and including the consideration of the passage of
this ordinance also meets the requirements specified by law; and the lands
proposed to be annexed are contiguous to the City of Auburn and have not
heretofore been incorporated in as a city or town.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1. That there shall be annexed to the City of Auburn, Washington,
the property situated in the County of King, State of Washington, legally described
as follows:
THAT PORTION OF THE NORTHWEST QUARTER OF SECTION 14,
TOWNSHIP 21 NORTH, RANGE 4 EAST, W.M. IN KING COUNTY
WASHINGTON, DESCRIBED AS FOLLOWS:
BEGINNING AT THE NORTHEAST CORNER OF THE LANDS ANNEXED
TO THE CITY OF AUBURN IN ANNEXATION ORDINANCE 3242, ON THE
WEST LINE OF THE LANDS ANNEXED TO THE CITY OF AUBURN IN
ANNEXATION ORDINANCE NUMBER 1387 AND ON THE EAST LINE OF
THE NORTHWEST QUARTER OF SAID SECTION 14;
THENCE WEST ALONG THE NORTH LINE OF SAID LANDS ANNEXED
TO THE CITY OF AUBURN IN ANNEXATION ORDINANCE 3242, ALONG
THE EASTERLY EXTENSION OF THE NORTH LINE OF TRACT 51,
WEST AUBURN FIVE ACRE TRACTS AS RECORDED IN VOLUME 15 OF
PLATS, PAGE 12, RECORDS OF KING COUNTY, WASHINGTON, ALONG
THE NORTH LINE OF SAID TRACT 51, AND ALONG THE WESTERLY
EXTENSION OF THE NORTH LINE OF SAID TRACT 51 TO THE WEST
LINE OF 58TH AVENUE SOUTH;
THENCE NORTH ALONG WEST LINE OF 58TH AVENUE SOUTH TO THE
WESTERLY EXTENSION OF THE NORTH LINE OF TRACT 40, WEST
AUBURN FIVE ACRE TRACTS AS RECORDED IN VOLUME 15 OF
PLATS, PAGE 12, RECORDS OF KING COUNTY, WASHINGTON;

THENCE EAST ALONG THE WESTERLY EXTENSION OF THE NORTH
LINE OF SAID TRACT 40, ALONG THE NORTH LINE OF SAID TRACT 40
AND THE EASTERLY EXTENSION OF THE NORTH LINE OF SAID
TRACT 40 TO THE EAST LINE OF THE NORTHWEST QUARTER OF
SAID SECTION 14 AND THE WEST LINE OF THE LANDS ANNEXED TO
THE CITY OF AUBURN IN ANNEXATION ORDINANCE NUMBER 1387;
THENCE SOUTH ALONG SAID EAST LINE OF THE NORTHWEST
QUARTER OF SAID SECTION 14 AND THE WEST LINE OF THE LANDS
ANNEXED TO THE CITY OF AUBURN IN ANNEXATION ORDINANCE
NUMBER 1387 TO THE POINT OF BEGINNING.
Section 2. That the property hereby annexed shall be assessed and taxed
at the same rate and on the same basis as other property within the City of Auburn
is assessed and taxed to pay for any outstanding general indebtedness of the City
to which the area was annexed.
Section 3. That the annexation of the property will become effective at 12:01
AM on February 1, 2006 and the property shall become part of the City of Auburn,
subject to all of the laws and ordinances of the City then otherwise provided by law.
Section 4. Within ten (10) days after the effective date of the annexation
referred to in this ordinance, the City Clerk of the City of Auburn shall send to the
Office of the Clerk of the County Council one (1) certified copy of this Ordinance
together with a copy of a letter from the Executive Secretary of the King County
Boundary Review Board, which letter contains a copy of the decision of the
Boundary Review Board relating to this annexation.

Section 5. The City Clerk of the City of Auburn shall record a certified copy
of this Ordinance with the King County Auditor's Office.
Section 6. The Mayor is hereby authorized to implement such
administrative procedures as may be necessary to carry out the directions of this
legislation.
Section 7. This Ordinance shall take effect and be in force five days from
and after its passage, approval and publication as provided by law.

Nichols Annexation
Dear Mr. Mandeville:
We are writing to advise you that the Boundary Review Board has now completed the required
Evaluation, as specified in RCW 36.93, for the above -referenced proposed action filed with the
Board effective: November 3, 2005 .
The Boundary Review Board also provided a 45 -day public review period November 3 -
December 18, 2005, as prescribed by RCW 36.93. The Board received no request for a public
hearing of this proposed action during the public review period.
The Boundary Review Board, therefore, hereby deems this proposed action approved effective:
December 27, 2005. Final approval of the proposed action is also subject to the following
actions, where applicable:
1. Sewer and Water District actions and some other actions are also subject to approval by the
Metropolitan King County Council. If the Council makes changes to the proposal, the Board
may then be required to hold a public hearing.
2. Filing with King County of franchise application(s), as required, accompanied by a copy of
this letter.
3. Filing with King County of permit application(s), as required, accompanied by a copy of this
letter.
4. Fulfillment of all other statutory requirements and/or procedures specified in your Notice of
Intention.

5. Notification in writing of your intended effective date of annexation. This notification should
be provided as early as possible. Please send this information to Elissa Benson, Bank of

6. Filing with King County Council of. (1) one certified copy of final resolution or ordinance
accomplishing this proposed action; and (2) a copy of this letter. This document should be
filed with the Clerk of the Council (Attn: Anne Noris), King County Courthouse, Room
1025, Seattle, Washington 98104
