Background Summary: In June 2005 the City of Auburn accepted an "Application for Annexation" from James Stipp, 32810 56th Avenue South, for a single parcel that he owns located adjacent to the north-western boundary of the city limits up on West Hill. The parcel (King County Assessor's Parcel #9262800325) is approximately 4 acres. Mr. Stipp has indicated that he eventually plans to subdivide the property in conjunction with the proposed Nichols annexation. In August 2005 Mr. Stipp returned a signed 60% Petition and the King County Assessor certified it was sufficient to meet the statutory requirements for annexation. The City Council held a public hearing about the 60% annexation on September 19th and authorized staff to file the City's intention to annex the property with the King County Boundary Review Board (KCBRB). The KCBRB reviewed the annexation and approved it. Attached is an ordinance to effect the annexation on February 1, 2006. That there shall be annexed to the City of Auburn, Washington, the property situated in the County of King, State of Washington, legally described as follows: THAT PORTION OF THE NORTHWEST QUARTER AND THE SOUTHWEST QUARTER OF SECTION 14, TOWNSHIP 21 NORTH, RANGE 4 EAST, W.M. IN KING COUNTY WASHINGTON, DESCRIBED AS FOLLOWS: BEGINNING AT THE NORTHWEST CORNER OF THE LANDS ANNEXED TO THE CITY OF AUBURN IN ANNEXATION ORDINANCE 3242, ON THE EAST LINE OF 58TH AVENUE SOUTH, AND AT THE NORTHWEST CORNER OF TRACT 51 OF WEST AUBURN FIVE ACRE TRACTS AS RECORDED IN VOLUME 15 OF PLATS, PAGE 12, RECORDS OF KING COUNTY, WASHINGTON; THENCE SOUTH ALONG THE WEST LINE OF SAID LANDS ANNEXED TO THE CITY OF AUBURN IN ANNEXATION ORDINANCE 3242, ALONG THE EASTERLY LINE OF 58TH AVENUE SOUTH, AND ALONG THE WEST LINE OF TRACTS 51 AND 60 OF SAID PLAT TO THE EASTERLY EXTENSION OF THE SOUTH LINE OF TRACT 59, WEST AUBURN FIVE ACRE TRACTS AS RECORDED IN VOLUME 15 OF PLATS, PAGE 12, RECORDS OF KING COUNTY, WASHINGTON; THENCE WEST ALONG SAID EASTERLY EXTENSION AND ALONG THE SOUTH LINE OF SAID TRACT 59 TO THE SOUTHWEST CORNER OF SAID TRACT 59; Ordinance No. 5988 January 11, 2006 Page 2 THENCE NORTH ALONG THE WEST LINE OF SAID TRACT 59 AND ITS NORTHERLY EXTENSION TO THE NORTH LINE OF SOUTH 328TH STREET; THENCE EAST ALONG THE NORTH LINE OF SAID SOUTH 328TH STREET TO THE WEST LINE OF 58 r" AVENUE SOUTH; THENCE NORTH ALONG THE WEST LINE OF 58TH AVENUE SOUTH TO THE WESTERLY EXTENSION OF THE NORTH LINE OF THE LANDS ANNEXED TO THE CITY OF AUBURN IN ANNEXATION ORDINANCE 3242; THENCE EAST ALONG SAID WESTERLY EXTENSION TO THE POINT OF BEGINNING. Section 2. That the property hereby annexed shall be assessed and taxed at the same rate and on the same basis as other property within the City of Auburn is assessed and taxed to pay for any outstanding general indebtedness of the City to which the area was annexed. Section 3. That the annexation of the property will become effective at 12:01 AM on February 1, 2006 and the property shall become part of the City of Auburn, subject to all of the laws and ordinances of the City then otherwise provided by law. Section 4. Within ten (10) days after the effective date of the annexation referred to in this ordinance, the City Clerk of the City of Auburn shall send to the Office of the Clerk of the County Council one (1) certified copy of this Ordinance together with a copy of a letter from the Executive Secretary of the King County Boundary Review Board, which letter contains a copy of the decision of the Boundary Review Board relating to this annexation. Ordinance No. 5988 January11, 2006 Page 3 Section 6. The City Clerk of the City of Auburn shall record a certified copy of this Ordinance with the King County Auditor's Office. Section 6. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directions of this legislation. Section 7. The Boundary Review Board also provided a 45 -day public review period November 8 - December 23, 2005, as prescribed by RCW 36.93. The Board received no request for a public hearing of this proposed action during the public review period. The Boundary Review Board, therefore, hereby deems this proposed action approve effective: December 27, 2005. Final approval of the proposed action is also subject to the following actions, where applicable: 1. Sewer and Water District actions and some other actions are also subject to approval by the Metropolitan King County Council. If the Council makes changes to the proposal, the Board may then be required to hold a public hearing. 2. Filing with King County of franchise application(s), as required, accompanied by a copy of this letter. 3. Filing with King County of permit application(s), as required, accompanied by a copy of this letter. 4. Notification in writing of your intended effective date of annexation. This notification should be provided as early as possible.
