Background Summary:
The City of Auburn received an application from James and Janet Hyatt for two parcels (King County
Assessor Parcel Number 9262800320 and Parcel Number 9262800295) that they own on West Hill.
Parcel Number 9262800320 is 3.10 acres of unimproved land. Parcel Number 9262800295 is located at
32727 56th Avenue South and is 4.28 acres with a single family house on it.
The total assessed value of these two parcels is $507,000 which is sufficient to consider the ten percent
annexation petition of the area indicated on the attached map. The total area of the proposed annexation
boundaries is 17.75 acres with a total assessed value of $4.2 million and an estimated population of 50
people living in fifteen households.
The Hyatts plan to eventually subdivide the parcels, both of which are located within the Lakehaven Utility
District (which would provide water and sewer service). Even if the parcels are annexed into the City of
Auburn, they will remain in the Lakehaven Utility District. Ken Shersty, branch manager of PPI Group
who is representing the Hyatts, explains they are applying for annexation because they prefer to work
with the City of Auburn with their eventual subdivision and development of the Hyatt property.
City staff has reviewed the annexation petition and determined that a logical boundary would be to
include all properties along both sides of South 328th Street between 51st Avenue South and 56th
Avenue South into the boundaries of the proposed annexation. The portion of South 328th Street
between 56th Avenue South and 58th Avenue South was recently annexed into the City through the Stipp
Annexation. The properties along the cul-de-sac of 57th Avenue South were added to the proposed
annexation to avoid creating an area surrounded on three sides by the City of Auburn.
South 328th Street, between 51st Avenue South and 56th Avenue South, is a public right-of-way of sixty
(60) feet that is partially developed. Heading eastbound off 51st Avenue South toward 56th Avenue
South, South 328th Street is a paved roadway (less than 20 feet wide with no curbs) that turns into a
gravel road.

The gravel road ends roughly halfway between 51st Avenue South and 56th Avenue South. The
remainder of South 328th Street is undeveloped to the intersection with 56th Avenue South.
The proposed annexation of South 328th Street was circulated among City staff for review and comment.
The only comment received was from the Fire Department. The Fire Department found no operational
issues that they would need to address as a result of the proposed annexation.
Based on State annexation laws, the Council is asked at this time to consider accepting the attached 10%
application for annexation. If the Council accepts the application, then City staff will prepare and
distribute a 60 percent petition for annexation to the affected property owners. Upon receipt of petitions
representing 60% or more of the assessed valuation of the annexation area, the City Council will then be
asked to consider accepting the petition, call for a public hearing and, if approved, file their intent to annex
with the King County Boundary Review Board. City staff will post the necessary public notices
announcing the public hearing in and around the proposed annexation area. If approved by the Boundary
Review Board, the Council will then be asked to consider and pass an ordinance to effect the annexation.
The proposed annexation of South 328th Street was circulated among City staff for review and comment.
The only comment received was from the Fire Department. The Fire Department found no operational
issues that they would need to address as a result of the proposed annexation.
If the City does not receive enough petitions to satisfy the 60% assessed valuation threshold, then the
proposed annexation will fail. The applicants may then submit a new application for annexation with
revised boundaries. In such a case, the above process will then start all over again.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF AUBURN, WASHINGTON, ACCEPTING AN
APPLICATION TO ANNEX CERTAIN PROPERTIES
LOCATED IN KING COUNTY ADJACENT TO THE
CITY'S NORTHWESTERN BOUNDARY AND
AUTHORIZING STAFF TO PREPARE THE
NECESSARY SIXTY PERCENT PETITION FOR
APPLICATION AS REQUIRED BY STATE LAW
WHEREAS, the City of Auburn, Washington, received an application
(ANX06-0001) to annex two parcels of land located in King County adjacent to
the City's northwestern boundary; and
WHEREAS, the total assessed value of the applicant's parcels is sufficient
to consider the annexation of additional properties that are within the immediate
vicinity of the applicant's property and adjacent to the Auburn city limits; and
WHEREAS, City staff reviewed the application for annexation and
determined that a logical boundary of the proposed annexation include all the
properties along both sides of South 328th Street between 51st Avenue South
and 56th Avenue South and the properties north of South 328th Street between
56th Avenue South and 58th Avenue South.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, HEREBY RESOLVES as follows:
Section 1. The City of Auburn hereby accepts the Ten Percent
Application for Annexation and authorizes City staff to prepare the necessary

Sixty Percent Petition for Annexation for consideration by the affected property
owners as required by state law (RCW 35A.14.120).
Section 2. The Mayor is hereby authorized to implement administrative
procedures necessary to carry out the directives of this legislation.
Section 3. That this Resolution shall take effect and be in full force
upon passage and signatures hereon.
