City Council introduce and adopt Ordinance No. 6016.
Background Summary:
The City Council recognizes the value of implementing automated traffic enforcement programs in the
furtherance of its goals in creating a safe environment for its citizens and those traveling upon its
roadways, and to take advantage of the opportunity availed by the statute, adopted its ordinance number
5957, authorizing an automated traffic enforcement program
The program, codified as chapter 10.42 of the Auburn City Code (ACC) currently provides for fines in the
amount of $101.00 for violations of the program, however, the current provisions do not include a penalty
for late payment nor do they specify that collection efforts are in addition to the fine amounts.
Other provisions of the city code specify that late payments do incur a penalty of up to 30 percent of the
original amount, and collection efforts incur costs that would be due in addition to the amount fines or
penalties otherwise payable.
It is reasonable and appropriate to provide for those late payment penalties and collection costs for the
automated traffic enforcement program.

AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF AUBURN, WASHINGTON, AMENDING
SECTION 10.42.060 OF THE AUBURN CITY CODE
RELATING TO FINES FOR INFRACTIONS
COMMITTED IN CONNECTION WITH THE CITY'S
AUTOMATED TRAFFIC ENFORCEMENT
PROGRAM
WHEREAS, the legislature has recently added new sections to Chapter
46.63 of the Revised Code of Washington, regulating the use of automated traffic
safety cameras and authorizing their use by municipalities; and
WHEREAS, the City Council of the City Df Auburn, WashingtDn recognizes
the value of implementing automated traffic enforcement programs in the
furtherance of its goals in creating a safe environment for its citizens and those
traveling upon its roadways, and to take advantage of the opportunity availed by
the statute, adopted its Ordinance Number 5957, authorizing an automated traffic
enforcement program; and
WHEREAS, the program, codified as Chapter 10.42 of the Auburn City

WHEREAS, other provisions of the City Code specify that late payments

WHEREAS, it is reasonable and appropriate to provide for those late
payment penalties and collection costs for the automated traffic enforcement
program.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, DO ORDAIN as follows:
Section 1. Amendment to City Code.
That section 10.42.060 of
the Auburn City Code be and the same hereby is amended to read as follows:
10.42.060 Fines.
The fine for infractions committed pursuant to the provisions of this
Chapter shall be One Hundred one Dollars ($101.00) if paid within 15 days from
the date of issuance of such notice, or in the sum of One Hundred Thirty-four
Dollars ($134.00) if not paid within 15 days from the date of issuance of such
notice. Fines shall be paid directly to the Auburn Municipal Court or as otherwise
directed on the Notice of Infraction. It is further provided that if the fine amounts
are not paid before the amounts due are sent to collection, or before the City or a
contractor on the City's behalf take action to collect the same, the costs of such
collection efforts shall be added to the amounts due and owinq. (Ord. 5957 ~ 1,
2005.)
Section 2. Implementation. The Mayor is hereby authorized to
implement such administrative procedures as may be necessary to carry out the
directions of this legislation.

Section 3. Severabilitv.
The provisions of this ordinance are
declared to be separate and severable. The invalidity of any clause, sentence,
paragraph, subdivision, section or portion of this ordinance, or the invalidity of the
application thereof to any person or circumstance shall not affect the validity of
the remainder of this ordinance, or the validity of its application to other persons
or circumstances.
Section 4. Effective date.
This Ordinance shall take effect and be
in force five days from and after its passage, approval and publication as
provided by law.
