Background Summary:
The City received a 10% Application for Annexation from Kathy and Tommy DeHart for the annexation of
a single parcel that they own in the Pierce County portion of Auburn's potential annexation area. The
parcel is located at 17311 2nd Street East. It is approximately 4.91 acres. The DeHarts plan to subdivide
their property and would like to connect to the City sewer system. Comprehensive Planning Policy C-3
requires annexation as a condition to the extension of the City's utility services.
Based on State annexation laws, the Council is asked at this time to consider the attached 10%
application for annexation. RCW 35A.14.120 requires the Council meet with the initiating parties of the
annexation to determine whether to accept, reject or modify the proposed annexation. The applicants
have been notified that the Planning and Community Development Committee will consider their
application at their meeting on April 1 Oth and have been invited to attend the meeting.
Staff recommends that the Planning and Community Development Committee recommend to City Council
that the application to annex the DeHart property be rejected. The property lacks public access.
Presently access to the property is from 2nd Street East, which is a private road. The Pierce County
Assessor's map does not indicate the presence of any public right-of-way to the property. The Auburn
Fire Dept. stated providing services to the property would be challenging due to the lack of public access.
If the Planning and Community Development Committee instead chooses to recommend to City Council
acceptance of the 10% application for annexation, then staff will prepare a resolution asking the City
Council to concur with the Committee recommendation. If the Council passes the resolution, then City
staff will request the property owners consider and submit a petition for annexation. Upon receipt of the
petition, the City Council will be asked to consider accepting the petition and, if accepted, call for a public
hearing. The Council will then be asked to file the petition and their intent to annex with the Pierce
County Boundary Review Board. If approved by the Boundary Review Board, the Council will then be
asked to consider and pass an ordinance to effect the annexation.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
AUBURN, WASHINGTON, TO DECLINE THE ACCEPTANCE OF
AN APPLICATION TO ANNEX CERTAIN PROPERTY LOCATED
IN PIERCE COUNTY ADJACENT TO THE CITY'S SOUTHERN
BOUNDARY
WHEREAS, the City of Auburn, Washington, received an application (City
File No. ANX06-0002) to annex a single parcel (Pierce County Assessor's Tax
Parcel Number 0520052007) of land located in King County adjacent to the City's
southern boundary; and
WHEREAS, RCW 35A.14.120 requires the City Council to determine
whether to accept, reject or modify the proposed annexation; and
WHEREAS, City staff reviewed the application for annexation and found
that the proposed annexation area does not have any direct public street access
raising concerns regarding the City's ability to provide adequate emergency
services to the site.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, IN A REGULAR MEETING DULY ASSEMBLED DOES
HEREBY RESOLVE THAT:
Section 1. The City of Auburn hereby declines to accept the 10%
application for the annexation of land identified as Pierce County Assessor's tax
parcel number 0520052007.

Section 2. In accordance to RCW 35A.14.120, the City Council's action
on this resolution is final and not subject to appeal.
Section 3. The Mayor is hereby authorized to implement such
administrative procedures as may be necessary to carry out the directives of this
legislation.
Section 4. This resolution shall take effect and be in full force upon
passage and signatures thereon.
