Lewis called the meeting to order at 7:30 p.m. and led those in attendance in the Pledge of Allegiance. B. Roll Call Mayor Lewis and the following Councilmembers were present: Rich Wagner, Gene Cerino, Nancy Backus, Bill Peloza, Roger Thordarson, and Lynn Norman. Councilmember Sue Singer was excused. Staff members present included: City Attorney Daniel B. Heid, Public Safety Chief Jim Kelly, Planning, Building and Community Director Paul Krauss, Community Development Administrator David Osaki, Parks, Arts and Recreation Director Daryl Faber, Transportation Planner Joe Welsh, Human Services Director Brenda Heineman, Information Services Director Lorrie Rempher, Public Works Director Dennis Dowdy, Finance Director Shelley Coleman, Economic Development Planner Al Hicks, and Deputy City Clerk Cathy Richardson. C. Announcements and Appointments 1. Appointments a) Parks and Recreation Board City Council confirm the appointment of Stephanie McPhail to the Parks and Recreation Board to fill an unexpired term expiring December 31, 2006. MOTION CARRIED UNANIMOUSLY. 6-0. 2. Announcements a) Proclamation — National Police Week Mayor Lewis declared the week of May 14 - 20, 2006 as National Police Week in the city of Auburn. Mayor Lewis read and presented the proclamation to Public Safety Chief Jim Kelly. Mayor Lewis expressed his gratitude for the services provided by the Auburn Police Department. D. Agenda Modifications Agenda modifications included the transmittal of revised Ordinance No. 6030 and revised Resolution No. 4026. II. CITIZEN INPUT, PUBLIC HEARINGS & CORRESPONDENCE A. Public Hearings There were no public hearings scheduled for this evening. B. Audience Participation This is the place on the agenda where the public is invited to speak to the City Council on any issue. Those wishing to speak are reminded to sign in on the form provided. John Ahlers, 999 3rd Avenue, Seattle Mr. Ahlers indicated that he is an attorney and spoke on behalf of Pivetta Brothers Construction regarding City of Auburn Project No. C516A. Mr. Ahlers indicated that a bid protest has been raised in connection with the project and spoke in opposition to awarding the project to Rodarte Construction. Mr. Ahlers stated that the Rodarte Construction bid is non-responsive. His client's opposition is related to the trench/shoring portion of the bid. Mr. Ahlers spoke regarding requirements for shoring and trench safety requirements and related costs as listed in the bids. In Mr. Ahlers opinion, the Rodarte Construction bid violates state statute and is therefore non-responsive, whereas Pivetta Brothers bid conforms to the statute. Mr. Ahlers requested that Council award the bid to the most responsible bidder, which in his opinion is Pivetta Brothers. Page 2 City of Auburn Council Meeting Minutes May 11 .2006 Mr. Ahlers distributed West's Revised Code of Washington Unannotated Title 39, Section 39.04.180 entitled Trench excavations—Safety systems required, and Article 8, Subsection 7 entitled Credit not to be Loaned. Public Works Director Dowdy stated that all bids were reviewed and all bidders met the intent of the state statute by including a bid price for the shoring as referenced by Mr. Ahlers. All bidders understand that shoring is required, including the apparent low bidder. Director Dowdy expressed the City's support of the award to Rodarte Construction as indicated by the recommendation from the Public Works Committee. C. Correspondence No correspondence was received. III. COUNCIL COMMITTEE REPORTS A3.7.6 A. Municipal Services Chair Cerino reported that Municipal Services Committee met this evening at 5:00. The Committee discussed and recommends approval of Ordinance No. 6030 with minor amendments regarding the definitions of a recreational vehicle and regulations regarding parking limits as distributed prior to the Council meeting. The Committee also discussed and recommends approval of Resolution Nos. 4027, 4028, 4032, and 4034. The Committee also received a report on specialized rescue services and Fire Department levels of service. The next regular meeting of the Municipal Services Committee is scheduled for June 5, 2006 at 5:00 p.m. B. Planning & Community Development Chair Norman reported that the Planning and Community Development Committee met May 8, 2006 at 5:00 p.m. The Committee held a public hearing on and recommends approval of Resolution No. 4023. The Committee also discussed and recommends approval of Ordinance No. 6020 and Resolution No. 4029. The Committee also discussed homeless encampments, 'A' Street SE zoning, park impact fees, renaming Bicentennial Park, Les Gove Community Center, Latino Center, and Auburn Environmental Park Interpretive Center. The next regular meeting of the Planning and Community Development Committee is scheduled for May 22, 2006 at 5:00 p.m. Page 3 City of Auburn Council Meeting Minutes May 11 .2006 C. Public Works Chair Wagner reported that the Public Works Committee met on May 8, 2006 at 3:30 p.m. The Committee discussed and recommends approval of contract administration items. The Committee also discussed the downtown drainage water detention facility in relationship to the Auburn Environmental Park and other drainage issues and King County's ballot proposal to develop transit. The Committee will receive a King County presentation regarding their ballot proposal at the next Public Works meeting. The next regular meeting of the Public Works Committee is scheduled for May 22, 2006 at 3:30 p.m. D. Finance Chair Backus reported that the Finance Committee met this evening at 6:30. The Committee discussed and recommends approved of claims and payroll vouchers. The Committee also received a quarterly report on revenues and expenditures and discussed Resolution Nos. 4028, 4032, and 4034, and Ordinance No. 6030. The next regular meeting of the Finance Committee is scheduled for June 5, 2006 at 6:30 p.m. IV. COUNCILMEMBER REPORTS At this time Councilmembers may report on items not specifically described on the agenda, which are of interest to the community. Councilmember Wagner reported that he attended Family Fun Night hosted by the YMCA which was a huge success. Over 1,000 individuals attended. Councilmember Wagner also attended a Regional Access Mobility Partnership meeting. Discussion centered on toll roads and related educational efforts by the Washington State Department of Transportation. Councilmembers Backus and Norman abstained from reporting due to the large agenda this evening. Councilmember Cerino reported that he and Mayor Lewis attended a Pierce County Cities and Town meeting at which they received a report from the Tacoma Police Department on youth gang activity in the Tacoma area. Councilmember Thordarson reported that he represented Mayor Lewis at the Auburn Police Department Citizens Academy Graduation ceremony. There were twenty-four graduates in the group. Page 4 City of Auburn Council Meeting Minutes May 11 2006 Councilmember Peloza reported that he attended a Metropolitan Water Pollution Abatement Advisory Committee meeting at which they discussed the King County proposal to recommend sewage disposal agreement extensions for cities and special districts currently under contract. Councilmember Peloza also reported that he, Mayor Lewis, and Councilmember Wagner attended the 2006 King County Executives Award Program at which the White River Valley Museum received an award for the Mary Olson Farm barn preservation and farm restoration project. Councilmember Peloza also attended Water Resource Inventory Area (WRIA 9) Management meetings to discuss extension of the current interlocal agreement. He also announced that he will be attending the National League of Cities Energy, Environment, and Natural Resources Steering Committee meeting in Cambridge, Massachusetts. Also, the Lea Hill area will be receiving improved lighting for public safety purposes in the near future. Mayor Lewis reported that he attended the Annual Chamber of Commerce Golf Tournament at the Auburn Municipal Golf Course. Mayor Lewis also chaired the Suburban Cities Public Issues Committee meeting. Twenty- eight of the thirty-seven member cities were in attendance and concluded that all cities could adhere to the policy decisions on their agenda. This is the first time in the history of the organization that all the cities were in concurrence on these issues. Mayor Lewis also reported that he spoke and presented a proclamation this evening at the Elks Club (BPOE 1808) Annual Scholarship Dinner at which scholarships are awarded to youths in the Auburn area. Public Works Project Number MS 797 04.9.1 MS 797 City Council approve Final Pay Estimate No. 4 to Small Works Contract 05-22 with Road Runner Striping Inc, and accept construction of Project No. MS 797, 2005 Citywide Channelization Project. MOTION CARRIED. 5-1. Councilmember Wagner voted no. 3. Ordinance No. 6026 03.6 PUD05-0001, REZ05-0001 An Ordinance of the City Council of the City of Auburn, Washington, approving a request to rezone approximately 50.85 acres from Single Family Residential (R1) to Planned Unit Development (PUD) and approving the request for a planned unit development Councilmember Norman moved and Councilmember Cerino seconded to introduce and adopt Ordinance No. 6026. MOTION CARRIED UNANIMOUSLY. 6-0. 6. Ordinance No. 6030 01.2 An Ordinance of the City Council of the City of Auburn, Washington amending Section 10.36.190 of the Auburn City Code relating to oversize or commercial vehicles on residential or non -arterial streets Councilmember Cerino moved and Councilmember Peloza seconded to introduce and adopt Ordinance No. 6030 as amended and presented prior to the Council meeting. MOTION CARRIED UNANIMOUSLY. 6-0. B. Resolutions Resolution No. 4021 03.5 PLT05-0001 A Resolution of the City Council of the City of Auburn, Washington, approving a Preliminary Plat Application to subdivide 50.85 Acres into 167 lots and various tracts for future single family residential development, within the City of Auburn, Washington Councilmember Norman moved and Councilmember Cerino seconded to adopt Resolution No. 4021. MOTION CARRIED UNANIMOUSLY. 6-0. 3. Resolution No. 4024 03.5 PLT05-0002 A Resolution of the City Council of the City of Auburn, Washington, approving a Preliminary Plat Application to subdivide 38.46 acres into 201 lots and various tracts for future single family residential development, within the City of Auburn, Washington Councilmember Norman moved and Councilmember Cerino seconded to adopt Resolution No. 4024. MOTION CARRIED. 5-1. Councilmember Wagner voted no. 4. Resolution No. 4028 02.7, A3.16.3 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk of the City of Auburn (City) and Brad Jurkovich Consulting to develop a Comprehensive Stakeholder Management Plan and other services related to the proposed Regional Fire Service Protection Authority Councilmember Cerino moved and Councilmember Peloza seconded to adopt Resolution No. 4028. Resolution No. 4032 A1.3 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk to enter into and execute an Interlocal Agreement with King County Fire Protection District No. 37 for the purpose of providing maintenance and repair of fire apparatus Councilmember Cerino moved and Councilmember Peloza seconded to adopt Resolution No. 4032. MOTION CARRIED UNANIMOUSLY. 6-0. 10. Resolution No. 4034 02.7 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk to execute an Agreement between the City of Auburn and Emergency Services Consulting Inc. for a Regional Fire Protection Service Authority Study Councilmember Cerino moved and Councilmember Peloza seconded to adopt Resolution No. 4034. MOTION CARRIED UNANIMOUSLY. 6-0. IX. MAYOR'S REPORT Page 12 City of Auburn Council Meeting Minutes May 11 2006 A. Executive Session At 8:10 p.m., Mayor Lewis recessed the meeting to executive session for approximately thirty minutes for the purpose of discussing property acquisition. Mayor Lewis reconvened the meeting at 8:55 p.m. X. ADJOURNMENT There being no further business to come before the Council, the meeting adjourned at 8:55 p.m. APPROVED THE DAY OF JUNE 2006. Peter B.
