Ordinance 6034 July 10, 2006 Page 1 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN as follows: Section 1. Amendment to City Code. That Section 13.06.340 of the Auburn City Code is amended to read as follows: 13.06.340 Meter testing. Any owner/operator who requests a water meter accuracy test may make application to the City to have their meter tested. The City shall test. repair or replace the meter to ensure that the meter functions properly. If the test shows that the meter was over registering, the City shall refund to the owner/operator illJY.owed amount... If the test shows that the meter was under registering, the City shall bill the owner/operator for any due amount. The refund or due amount shall be based on the City's analysis of the property's past billing records. If additiQDal water meter accuracy tests are requested by the owner/operator within a twelve month period, a deposit of the amount listed in the City of Auburn Fee Schedule shall apply. The City shall test, repair or replace such meter to ensure that the meter functions properly. If the test shows that the meter was over registering, the deposit shall be returned by the City to the owner/operator along with a refunct for any over billjrrg that the City can establish has occurred. If the test shows that .the meter was properly functioning or under-registering, then the deposit shall be at once transferred into the water fund of the City. Section 2. Amendment to City Code. That Section 13.20.390 of the Auburn City Code is amended to read as follows: 13.20.390 Sewage conveyance and disposal service charge - Payment dates - Payment delinquency. Amendment to City Code. That Section 13.20.440 of the Auburn City Code is amended to read as follows: 13.20.440 Rates and charges. A. Sewer Rates. The monthly sewer charge to city of Auburn sanitary sewer customers consists of two separate fees. Auburn sanitary sewer utility imposes a charge to maintain, expand and operate the utility's sewer conveyance facilities, and King County imposes a separate fee for the service King County provides. No charge shall be imposed by the city on the amount charged by King County, which amount the city shall pass directly onto the customer as the cost of the service that King County is providing. Commercial accounts will be allowed to average winter water consumption for the billing dates falling between December through May to determine the summer sewer rates for the billing dates falling between July and October. Said allowance shall be upon application and with appropriate justification that Ordinance 6034 July 10, 2006 Page 5 additional summer usage does not enter the sewer system. The months of November through June shall be billed per water used, at the rates noted above. Commercial accounts without city water service shall be charged at the rate as noted above for inside-the-city or outside-the-city commercial customers. The customer shall have installed an approved city water meter or other acceptable means of recording water use, by applying for a permit under ACC 13.06.050, which shall be read by the city to determine sewage charges on commercial private water systems. Commercial accounts that have industrial use of domestic water, and which water is not discharged into the sanitary sewer system, may request a deduct meter for the water that is not discharged to the sewer system. Sewer rates will not be applied to the water usage that is not discharged to the sanitary sewer system. Irrigation meters shall not be billed for sanitary sewer service. B. Permit Fees. Permit fees for side sewer repair, replacement, inspection, or tapping side sewers shall be as shown in the city of Auburn fee schedule. Section 4. Amendment to City Code. That Section 13.48.120 of the Auburn City Code is amended to read as follows: 13.48.120 Billing and collection. In cases where the_ property does not receive water service from the city of Auburn. storm drainage charges shall start from the day that the Storm Drainage Permit is finalized by the city. A. Order of Payment. Payments received for utility bills shall be applied towards the following bills in the order of priority shown: 1. Late charges; 2. Storm; 3. Garbage; 4. Sewer; 5. Water. B. Service Charges - Payment Delinquencies. All storm drainage utility rates referred to in this article shall constitute a lien upon the property from which such charges are due, superior to all other liens and encumbrances whatsoever, except for general taxes and local special assessments. Creation of new section to City Code. That a new section 13.20.075 of the Auburn City Code is created to read as follows: 13.20.075 Sewer service - Effective date. Sewer service charges shall start from the day water meter serving the property is installed by the city. In cases where the property is not served water by the City of Auburn Water Utility, sewer service charges shall start from the day the Sewer Permit is finalized by the city. At the time that sewer service charges begin, service charges for storm drainage shall also begin, if applicable. Section 6. Implementation. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directions of this legislation. Section 7. Severability. The provisions of this ordinance are declared to be separate and severable. The invalidity of any clause, sentence, paragraph, subdivision, section or portion of this ordinance, or the invalidity of the application thereof to any person or circumstance shall not affect the validity of the remainder of this ordinance, or the validity of its application to other persons or circumstances.
