Background Summary:
The City of Auburn is acquiring property in downtown Auburn that is commonly referred to as the Mecca
Tavern and the Jade Tavern for the purpose of implementing Auburn City Council Resolution No. 3985,
creation of a Town Center Plaza.
RCW 8.26.035 through 8.26.115 require the payment of relocation expenses for businesses displaced by
projects such as the Town Center Plaza, but only if federal funds are used in the acquisition of the
property or the project constructed as part of the acquisition. The Town Center Plaza project is not
receiving any federal funding, and RCW 8.26.010 enables the City to "opt out" of paying relocation
expenses in such situations.
If the City wishes to "opt out," the Council must take an official action to do so. If the Council chooses to
take no action, the City must comply with the terms of RCW Chapter 8.26 and pay the businesses' "actual
reasonable" relocation expenses. Should the City decide to pay relocation costs, Chapter 8.26 does not
allow the City to set a cap on the amount it will pay, or to alter the terms of the chapter. The City either
opts out completely or pays relocation costs per the terms of RCW Chapter 8.26.

RESOLUTION NO. 4057
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF AUBURN, WASHINGTON, REGARDING
TENANT RELOCATION COSTS FOR THE CITY
HALL ANNEX, EXPANSION OF THE DOWNTOWN
TOWN CENTER PLAZA, AND IMPROVEMENTS TO
CITY OF AUBURN DOWNTOWN PARKING
FACILITIES
WHEREAS, the Auburn City Council enacted City of Auburn Ordinance
No. 6011, authorized the condemnation of property for a City Hall Annex, an
expansion of the Downtown Town Center Plaza, and improvements to City of
Auburn Downtown Parking facilities; and
WHEREAS, state and federal law require that any local government
receiving federal funding for a specific project shall pay the relocation costs of
those residents and businesses displaced by that project; and
WHEREAS, RCW 8.26.010 exempts a local government from paying such
relocation costs for non-federally funded projects upon action by the governing
body of that government to exercise that option; and
WHEREAS, the City of Auburn is not receiving any federal funding for the
above-described project.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
HEREBY RESOLVES as follows:
Section 1. Pursuant to RCW 8.26.010(2), the City of Auburn elects not
to comply with the provisions of RCW 8.26.035 through 8.26.115 in connection
with its acquisition of property for a City Hall Annex, an expansion of the

Downtown Town Center Plaza, and improvements to City of Auburn Downtown
Parking facilities.
Section 2. That the Mayor is authorized to implement such
administrative procedures as may be necessary to carry out the directives of this
legislation.
Section 3. That this Resolution shall take effect and be in full force
upon passage and signatures hereon.
