Background Summary: The City of Auburn is acquiring property in downtown Auburn that is commonly referred to as the Mecca Tavern and the Jade Tavern for the purpose of implementing Auburn City Council Resolution No. 3985, creation of a Town Center Plaza. RCW 8.26.035 through 8.26.115 require the payment of relocation expenses for businesses displaced by projects such as the Town Center Plaza, but only if federal funds are used in the acquisition of the property or the project constructed as part of the acquisition. The Town Center Plaza project is not receiving any federal funding, and RCW 8.26.010 enables the City to "opt out" of paying relocation expenses in such situations. If the City wishes to "opt out," the Council must take an official action to do so. If the Council chooses to take no action, the City must comply with the terms of RCW Chapter 8.26 and pay the businesses' "actual reasonable" relocation expenses. Should the City decide to pay relocation costs, Chapter 8.26 does not allow the City to set a cap on the amount it will pay, or to alter the terms of the chapter. The City either opts out completely or pays relocation costs per the terms of RCW Chapter 8.26.
