Background Summary: In November 2005 the City of Auburn adopted an Economic Development Strategies document that encourages development of an area adjacent to the Auburn Environmental Park commonly referred to as the "Green Zone". On February 6, 2006, the Auburn City Council approved Resolution No. 3,982 and on March 15, 2006, approved Resolution No. 4003 establishing a six month moratorium on the filing of licenses and permits related to industrial development adjacent to the Auburn Environmental Park. (AEP) The purpose of the moratorium was to allow the City time to develop land use policies and/or regulations to promote development that would complement and benefit from the AEP. A six month extension on the moratorium was approved by the City Council on July 17, 2006 (Resolution No 4062), with a public hearing on that extension scheduled for August 21, 2006. To address this, the City has developed a proposed new zoning district referred to as the Environmental Park District (EP). The Environmental Park District is intended to allow uses in proximity to the AEP that benefit from that location and will complement the Park and its environmental focus. To support the AEP and its objectives, establishment of the Environmental Park District will require properties within the area to be rezoned from M1 "Light Industrial District' and R2 "Single Family Residential District' to EP "Environmental Park District'. These proposed changes would affect the type of uses that may be developed in the area. A public open house on the proposed Environmental Park District code amendment and rezoning of certain properties was held May 30, 2006 at Auburn City Hall. A total of seven people testified and six comment letters were received. Several individuals who submitted comment letters also gave testimony at the meeting. Comments covered various aspects of the proposal, including those that support the overall AEP concept, code amendments, and rezone, to those that believe the AEP should be located elsewhere. Concerns were expressed about uses allowed in the new zone and general questions about development and street improvements in the area were asked. Testimony was also received from several businesses that are located outside the proposed Environmental Park District but are concerned about being included in any subsequent phases of the project. At the June 6, 2006 meeting the Planning Commission made a recommendation to the City Council to approve the rezone. FINDINGS OF FACT: 1. Title 18 of the Auburn City Code (ACC), related to zoning, includes Chapter 18.68 (Amendments), which provides a process for amending the zoning map in the City of Auburn. ACC 18.68.030.6.2 addresses area wide rezones initiated by the City of Auburn, "2. Areawide Zoning and Rezoning, Initiated by the City. The planning commission shall conduct a public hearing and make a recommendation to the city council. If applicable, a comprehensive plan amendment may also be processed." 2. The rezone would apply to approximately 75 parcels which comprise approximately 272.98 acres within the area bounded by State Route 18 on the South, State Route 167 on the West, 15th Street NW on the North, and the Union Pacific Railroad tracks on the East. 3. Existing uses not permitted in the new Environmental Park District would become non -conforming, subject to ACC Ch. 18.54 (Nonconforming Structures, Land and Uses). 4. The rezone is supported by the City of Auburn Comprehensive Plan, which includes the following objectives and policies: • PR -14 The City shall pursue opportunities to provide active and passive recreational opportunities and enhance wetland and wildlife habitat within the Auburn Environmental Park generally located north of West Main Street, south of 15th Street NW between SR 167 and the Interurban Trail. Grant funding and cooperative relationships with recreational and wildlife organizations shall be pursued to implement this policy. • ED -15 Implement the recommendations of the City's 2005 Economic Development Strategies brochure. • Objective 9-5 Utilize the City's unique environmental opportunities and planned infrastructure to build on and support economic development efforts. • ED -18 Integrate the Auburn Environmental Park (AEP) into the City's economic development efforts by encouraging compatible high tech businesses to locate in its vicinity. Amend regulations to establish appropriate land uses for that area as well as develop strategies and incentives to promote the area as a "Green Zone" for economic development. • Ch. 14 (Comprehensive Plan Map) — Problems Related to Existing Uses - Western and Clay Streets Page 2 of 3 Agenda Subject: Ordinance No. 6037 Date: Julv 31. 2006 Area: Existing residential area north of West Main Street served by Western and Clay Streets. Problem: There is an established residential area in the middle of a designated industrial area. However, economic pressure, the desire to promote a "Green Zone" to complement the Auburn Environmental Park, combined with adjacent development patterns will ultimately convert this area to other uses. Policy 111.1. As long as this area remains viable as a residential area, City policy will try to protect that use in assessing the impact of industrial development of adjacent areas." 5. A final SEPA Determination of Non -Significance (DNS) was issued on the proposed rezone (attached) on June 13, 2006. 6. On May 25, 2006, notice of the proposed rezone was provided to the Washington State Department of Community, Trade and Economic Development and other State agencies, pursuant to RCW 36.70A.106, the 60 day state agency review period. No comments have been received from any agency on this proposal to date. 7. Page 3 of 3 ORDINANCE NO. 6 0 3 7 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, CHANGING THE ZONING O PROPERTIES FROM THE M1 "LIGHT INDUSTRIAL DISTRICT" AND R2 "SINGLE FAMILY RESIDENTIAL DISTRICT" TO THE EP "ENVIRONMENTAL PARK DISTRICT" AND AMENDING THE CITY'S ZONING MAPS ACCORDINGLY WHEREAS, a need has been identified to create a zone with appropriate uses in proximity to the Auburn Environmental Park that benefit from that location and will complement the Park and its environmental.focus; and WHEREAS, the City of Auburn has adopted an Economic Development Strategies document that encourages development of an area referred to as the Green Zone; and WHEREAS, establishment of the Environmental Park District will require approximately 75 parcels which comprise approximately 11,890,822 sq. ft. (272.98 acres) within the zone boundary to be rezoned from the M1 "Light Industrial District" and R2 "Single Family Residential District" to the EP "Environmental Park District"; and WHEREAS, the Auburn City Code provides that the Planning Commission shall consider area -wide zone changes; and WHEREAS, following public notice, the City of Auburn Planning Commission held a public hearing on June 6, 2006, on the proposed Environmental Park rezone; and WHEREAS, after fully considering the testimony and information presented at the public hearings, on June 6, 2006, the Planning Commission submitted its recommendations for the rezone to the City of Auburn City Council; and Ordinance No. 6037 July 13, 2006 Page 1 of 3 WHEREAS, the City Council has reviewed and considered the Planning Commission recommendations; and WHEREAS, environmental review on the proposal has been completed in accordance with the requirements of the State Environmental Policy Act (SEPA) with a final determination of non -significance (DNS) issued on June 13, 2006; and WHEREAS, the City Council finds that the proposal was received by State agencies for the 60 -day review period on May 25, 2006; also in accordance with state law, RCW 36.70A.106. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Section One APPROVAL OF REZONE. The properties in the area bounded by State Route 18 on the South, State Route 167 on the West, 15th Street NW on the North, and the Union Pacific Railroad tracks on the East is hereby rezoned from the M1 "Light Industrial District" and R2 "Single Family Residential District" to the EP "Environmental Park District," and the City of Auburn Zoning Map is amended to reflect the zoning change, as shown on the map attached hereto, marked as Exhibit "A," and incorporated herein -by this reference. Section Two CONSTITUTIONALITY OR INVALIDITY. If any section, subsection, sentence, clause, phrase or portion of this Ordinance, is for any reason held invalid or unconstitutional by any Court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision, and such holding shall not affect the validity of the remaining portions thereof. Section Three RECORDING. Upon passage, approval and publication of this Ordinance as provided by law, the City Clerk of the City of Auburn shall cause this Ordinance to be recorded in the office of the King County Auditor. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directions of this legislation. Section Five EFFECTIVE DATE. I represent the interests of Huttig Building Products, Inc., which owns property at 525 C Street NW in Auburn. Huttig's property is located partially within the potential Phase II of the AEP project, which is currently under an industrial moratorium. I understand this potential Phase II area will be the subject of review later in 2006 for possible rezone. Huttig is a nationwide distributor of building products,'with branches covering 46 stakes, and our Auburn facility is one of our largest branches. The rezoning of our property as part of Phase II of AEP would result in a significant diminution in the value of our property and its uses and would cause significant harm to Huttig. Huttig understands the value and interest that a project such as AEP would bring to Auburn as part of a long term plan to integrate downtown, the train station and related areas. The southern edge of Phase II is significantly residential and would potentially make sense to be part of this rezoned area in the future, but the northern edge, including our property, does not fit this mix. It appears that the northern edge was drawn simply where a commercial street happened to exist rather than coincident with existing properties and their uses. Huttig believes that its Auburn property is comparable to the UPS properties just north of the northern edge of Phase II, including in regards to impact on the area. In fact, we operate less than 20% of the tractors UPS employs daily onto C Street NW. We believe the northern edge of the potential Phase II should be drawn to the south of the old Seamans Mattress warehouse, which is directly south of our property. All of the buildings on C Street NW north of that warehouse are comparable and should be zoned similarly. X We have operated this business in its current location since 1972 and currently employ well over 100 people. We have been stable and solid members of the community and a good employer. The company provides building materials to the local and regional construction industry and directly employs 90 local individuals. Many more jobs are provided indirectly by way of the plant's purchases of services and materials, The area immediately surrounding the plant has been under a permit moratorium for industrial type activities as the City of Auburn evaluates possible zoning changes to the area, as part of the long-term plan for the proposed Environmental Park. U.S. Gypsum would prefer that the permit moratorium apply only to the area of the proposed Environmental Park and not to adjoining areas such as our plant site. In the alternative, we ask that the Resolution be modified to provide needed flexibility for improvements necessary to sustain existing businesses such as ours. The following clause could be added to the end of Section 1: "...or which are necessary to support businesses [or uses] existing on the date of the enactment of this moratorium." In U.S. Gypsum's case, such changes may include the addition of a maintenance and storeroom facility, external to the existing facility, and the addition of a covered area over an existing cement pad to expand the warehouse.
