Background Summary: NW Hangars has constructed new hangars on their land lease dated 8/15/05, Resolution No. 3894 area at the Auburn airport. They are planning on installing gas service to the hangars. PSE requires the city to grant a 10' easement for the gas line. This resolution allows the Mayor to sign the agreement with PSE. The easement will be located on the northern 10' of the Auburn Flight Service land lease, amended on 8/15/05 via Resolution No. 3893. Auburn Flight Services is in agreement with this easement. NOW, THEREFORE, THE COUNCIL OF THE CITY OF AUBURN, WASHINGTON HEREBY RESOLVES as follows: Section 1. The Mayor and City Clerk of the City of Auburn are herewith authorized to execute an Easement in substantially the form of the agreement, Resolution No. 4079 August17,2006 Page 1 of 2 a copy of which is attached hereto, denominated as Exhibit "1" and made a part hereof as though set forth in full herein. Section 2. Implementation. The Mayor of the City of Auburn is hereby authorized to implement such administrative procedures as may be necessary to carry out the directions of this legislation. Together with the right of access over and across said Property to enable Grantee to exercise its rights hereunder. As used herein, the term "systems" shall include all appurtenances and facilities as are necessary, in the judgment of Grantee, for the operation and maintenance of said systems. 2. Grantor's Use of Easement Area. Grantor agrees not to erect any structures on said Easement Area, and further agrees not to place trees, rockeries, fences or other obstructions on the Property that would interfere with the exercise of Grantee's rights herein.
