City Council introduce and adopt Ordinance No. 6050.
Background Summary:
Ordinance No. 6050 updates Auburn City Code Section 19.04.120 to allow the City to review and update
transportation impact fees at intervals appropriate to allow the city to continue to construct sufficient
transportation infrastructure to maintain the City's road capacity to serve the public.
ACC 19.04.120 originally prevented the City from updating impact fees any more frequently than every
two years. This limitation is not a requirement of state law.

AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF AUBURN, WASHINGTON, AMENDING
SECTION 19.04.120 OF THE AUBURN CITY CODE
RELATING TO REVIEW OF TRANSPORTATION
IMPACT FEES
WHEREAS, Auburn City Code Section 19.04.120 currently restricts
Council review of transportation impact fees to two-year intervals unless the
review is done in conjunction with the annual update of the capital facilities plan
element of the city's comprehensive plan; and
WHEREAS, this limitation is not required under state law; and
WHEREAS, the City Council finds that ACC 19.04.120 prevents the
Council from responding to the complex nature of the City's transportation
infrastructure,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, DO ORDAIN as follows:
Section 1. Amendment to City Code. That section 19.04.120 of
the Auburn City Code be and the same hereby is amended to read as follows:
19.06.120 Review and update of impact fees.
A. The fee rate schedules set forth in the fee schedule of
the city of Auburn shall be reviewed periodically by the council -444

B. The fee schedules set forth in the fee schedule of the
city of Auburn shall be reviewed by the council as it may deem
necessary and appropriate in conjunction with the annual update of
the capital facilities plan element of the city's comprehensive plan.

Section 2. Implementation. The Mayor is hereby authorized to
implement such administrative procedures as may be necessary to carry out the
directions of this legislation.
Section 3. Severability. The provisions of this ordinance are
declared to be separate and severable. The invalidity of any clause, sentence,
paragraph, subdivision, section or portion of this ordinance, or the invalidity of the
application thereof to any person or circumstance shall not affect the validity of
the remainder of this ordinance, or the validity of its application to other persons
or circumstances.
Section 4. Effective date. This Ordinance shall take effect and be
in force five days from and after its passage, approval and publication as
provided by law.
