City Council to introduce and adopt Ordinance No 6059.
Background Summary:
The City Council has previously adopted Ordinance No. 5957, setting out its red light photo enforcement
program. However, those provisions, codified in chapter 10.42 of the Auburn City Code accommodates,
as well, photo enforcement programs for speed in school zones. Because of the concerns relating to
excessive speed in school zones, it would be appropriate for the provisions of chapter 10.42 to be
amended to accommodate photo enforcement for school speed zones.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
AUBURN, WASHINGTON, AMENDING SECTION 10.42.060
OF THE AUBURN CITY CODE RELATING TO AUTOMATED
TRAFFIC ENFORCEMENT
WHEREAS, the Legislature of the State of Washington has added a new
section to RCW 46.63 regulating the use of automated traffic safety cameras,
and authorizing their use by municipalities; and
WHEREAS, the City Council of the City of Auburn, Washington,
recognizes the value of implementing an automated traffic enforcement program
in the furtherance of its goals in creating a safe environment for its citizenry; and
WHEREAS, pursuant to Ordinance No. 5957, and amendments thereto,
as well as the contracts negotiated in connection therewith, the City has
commenced a program of photo-stoplight enforcement; and
WHEREAS, the City is now ready to commence a program of photo-
school speed zone enforcement; and
WHEREAS, it is thus appropriate to amend Section 10.42.060 of the City
Code to provide for the fines for such photo-school speed zone violation'
enforcement; and
WHEREAS, it is also appropriate to build into such fines the escalation
provisions for late payments.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, DO ORDAIN as follows:

Section I. Amendment to City Code. That Section 10.42.060 of the
Auburn City Code shall be amended to read as follows:
10.42.060 Fines.
A. Stopliqht Violations and Railroad Crossinq Violations. The fine for
stopliqht violation and railroad crossing violation infractions committed pursuant
to the provisions of this chapter shall be $101.00 if paid within 15 days from the
date of issuance of such notice, or in the sum of $134.00 if not paid within 15
days from the date of issuance of such notice. Fines shall be paid directly to the
Auburn municipal court or as otherwise directed on the notice of infraction. It is
further provided that if the fine amounts are not paid before the amounts due are
sent to collection, or before the city or a contractor on the city's behalf take action
to collect the same, the costs of such collection efforts shall be added to the
amounts due and owing.
S. School Speed Zone Violations. The fine for school speed zone
violation infractions committed pursuant to the provisions of this chapter shall be
$177.00 if paid within 15 days from the date of issuance of such notice, or in the
sum of $235.00 if not paid within 15 days from the date of issuance of such
notice. Fines shall be paid directly to the Auburn municipal court or as otherwise
directed on the notice of infraction. It is further provided that if the fine amounts
are not paid before the amounts due are sent to collection, or before the city or a
contractor on the city's behalf take action to collect the same, the costs of such
collection efforts shall be added to the amounts due and owinq. (Ord. 6016 S 1,
2006; Ord. 5957 S 1, 2005.).
Section 2. Implementation. The Mayor is hereby authorized to
implement such administrative procedures as may be necessary to carry out the
directions of this legislation.
Section 3. Severability. The provisions of this ordinance are declared to
be separate and severable. The invalidity of any clause, sentence, paragraph,
subdivision, section or portion of this ordinance, or the invalidity of the application
thereof to any person or circumstance shall not affect the validity of the
remainder of this ordinance, or the validity of its application to other persons or
circumstances.

Section 4. Effective date. This Ordinance shall take effect and be in
force five days from and after its passage, approval and publication as provided
by law.
