N1120-1 F6.6.3, F3.21 Reviewed by Council & Committees: Reviewed by Departments & Divisions: D Arts Commission COUNCIL COMMITTEES: o Building o M&O D Airport 1:81 Finance o Cemetery o Mayor D Hearing Examiner o Municipal Servo 1:81 Finance o Parks D Human Services o Planning & CD o Fire o Planning D Park Board OPublic Works o Legal o Police o Planning Comm. o Other o Public Works D Human Resources D Information Services Action: Committee Approval: DYes ONo Council Approval: DYes ONo Call for Public Hearing ---1---1_ Referred to Until _/_/- Tabled Until _/_/- Councilmember: Backus I Staff: Coleman Meeting Date: November 20, 2006 I Item Number: VIlI.A.3 AUBURN * MORE THAN YOU IMAGINED ORDINANCE NO.6 0 6 2 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, AUTHORIZING THE LEVY OF REGULAR PROPERTY TAXES BY THE CITY OF AUBURN FOR COLLECTION IN 2007 WHEREAS, the City Council of the City of Auburn has met and considered its budget for the calendar year 2007; and WHEREAS, pursuant to RCW 84.55.120 the City Council held public hearings on September 17, 2005 and November 6, 2005 after proper notice was given, to consider the City of Auburn's 2007 budget and the regular property tax levy to support it; and WHEREAS, the City Council of the City of Auburn, after public hearing, and after duly considering all relevant evidence and testimony presented, has determined that the City of Auburn requires an increase in property tax revenue from the previous year, in addition to the increase resulting from the addition of new construction and improvements to property, any increase in the value of state-assessed property, annexations, and any refund levies in order to discharge the expected expenses and obligations of the City and in its best interest; and WHEREAS, the citizens of Auburn approved Proposition No. 1 in the November 2004 General Election which sets the levy limit factor for computing the maximum levy amount in 2006 - 2010 at 103%. Ordinance No. 6062 November 8, 2006 Page 1 of 3 NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Regular property taxes for collection in the City of Auburn for the year 2006 are authorized in the amount of $16,500,000. Not including increases resulting from the addition of new construction and improvements to property, any increase in the value of state assessed property, any increases resulting from annexation and any refund levies available, the regular property tax levy for 2007 collection represents an increase from regular property taxes levied for collection in 2006 of Four Hundred Thirty Six Thousand One Hundred Ninety Two Dollars ($436,192), which is a one hundred three percent (103%) increase from the previous year. Section 2. In order to avoid unnecessary interfund loans caused by uneven cash flow requirements for tax-supported funds, the Finance Director is hereby authorized to allocate individual property tax receipts in a manner that eliminates interfund loans. Section 3. If any section, subsection, sentence, clause or phrase of this Ordinance is for any reason held to be invalid or unconstitutional, such invalidity or unconstitutionality shall not affect the validity or constitutionality of the remaining portions of the Ordinance, as it being hereby expressly declared that this Ordinance and each section, subsection, sentence, clause or phrase hereof would have been prepared, proposed, adopted and approved and Ordinance No. 6062 November 8, 2006 Page 2 of 3 ratified irrespective of the fact that anyone or more section, subsection, sentence, clause or phrase be declared invalid or unconstitutional. Section 4. Implementation. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directives of this legislation. Section 5. Effective Date. This Ordinance shall take effect and be in force five (5) days from and after its passage, approval and publication as provided by law. INTRODUCED: PASSED: APPROVED: PETER B.
