Background Summary: RCW 35.21.684 requires that all jurisdictions treat manufactured housing no differently than site -built housing. However, that law does allow communities to restrict or prohibit the location or placement of used manufactured homes. Current city regulations place no restriction on the location or placement of manufactured homes. Staff is concerned that the placement of used manufactured homes in existing neighborhoods can have negative impacts on property values, and can lead to deterioration, disinvestment, and blight in neighborhoods. The proposed moratorium would give staff the time to more thoroughly review the issue and provide the Council with recommended measures that will protect neighborhood values while remaining in compliance with RCW 35.21.684. The moratorium would not affect the placement of used manufactured homes within mobile home parks. Establishment of Moratorium. The City Council hereby establishes a moratorium for an initial six months period of time on the siting, placement or installation of used manufactured homes within the City of Auburn, other than in mobile home parks. Section 2. Term of Moratorium. The moratorium established by this Resolution shall become effective on the 18th day of December 2006 and shall continue in effect for a period of six 6 months to the 17th day of June 2007 unless repealed, extended or modified by the City Council after subsequent public hearing and entry of appropriate findings of fact pursuant to RCW 35A63 220. Section 3. Public Hearing Scheduled. That a public hearing on the moratorium on for the siting, placement or installation of used manufactured homes within the City of Auburn be and the same hereby is set for 7:30 p.m. or as soon thereafter as the matter can be heard the 2nd day of January 2007 at the City of Auburn City Council Chambers 25 West Main Street Auburn Washington Section 4. Severability. If any sections sentence clause or phrase of this Resolution shall be held to be invalid or unconstitutional by a court of component jurisdiction or its application held inapplicable to any person property or circumstance such invalidity or unconstitutionality or inapplicability shall not effect the validity or constitutionality of any other section sentence clause or phrase of this Resolution or its application to any other person property or circumstance ----------------- Resolution No. 4128 December 18, 2006 Page 2 of 3 Section 5.
