Background Summary: Over the past year, the Planning staff, Planning Commission and Planning and Community Development Committee of the City Council have spent many hours developing a new zone district to replace the existing C2 Central Business District. The new district, entitled "Downtown Urban Center District," would apply to all properties currently zoned C2, essentially replacing the existing zone district. The DUC zone will allow any type of land use, except for those specifically prohibited. Greater building heights and sizes will be encouraged, with minimum FAR (Floor Area Ratio) and building height requirements to ensure a denser urban environment in the downtown area. A variety of incentives are included to allow for increases in FAR and building height and to create a higher quality urban environment. For the most part, existing uses within the C2 zone will remain as legally conforming. Some auto-oriented uses (such as automotive repair) will only be allowed to expand through the granting of a conditional use permit. Minor new construction activities will be exempt from the need to comply with the development/design standards of the new zone. The Planning Commission hosted a public open house in August 2006, which was attended by approx. one dozen interested citizens and downtown property owners. A public hearing on the proposed new zone district and rezone was subsequently considered in September 2006, at which only one individual testified. At the conclusion of the public hearing, the Commission voted to recommend approval of the new zone district and accompanying rezone to the City Council. Other Public Works esources uman Action: Committee Approval: BYes BNo / / P bli H in ll f Y N C _ ear g _ or u c a es o Council Approval: Referred to Until / / Tabled UntTf-_T 7- ~, Councilmember: Norman Staff: Davolio Meetin Date: Januar 16, 2007 Item Number: VIII.A.2 ~~J$UR1~1 MORE THAN YOU IMAGINED ORDINANCE NO. 6072 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, CHANGING THE ZONING OF PROPERTIES FROM THE C2 "CENTRAL BUSINESS DISTRICT" TO THE DUC "DOWNTOWN URBAN CENTER DISTRICT" AND AMENDING THE CITY'S ZONING MAPS ACCORDINGLY WHEREAS, in May 2001, the City of Auburn adopted the Downtown Plan as an element of the Auburn Comprehensive Plan to encourage higher intensity development within the downtown area of Auburn; and WHEREAS, the C2 Central Business District zone has been partially amended since that time to implement some of the policies of the Downtown Plan, but much of the policy direction of the Plan has yet to be implemented; and WHEREAS, in 2004, the City of Auburn's downtown was also recognized as a designated Urban Center by the Puget Sound Regional Council and by King County; and WHEREAS, the City desires to encourage continued growth in the downtown that strengthens its position as a focal point for housing, commerce and the community and encourages more individuals to live in proximity to high capacity transit; and WHEREAS, the City of Auburn has adopted a new zoning district known as the "Downtown Urban Center District" to foster- development consistent with that vision; and WHEREAS, establishment of the Downtown Urban Center District will require rezoning all parcels currently zoned C2 "Central Business District" to the DUC "Downtown Urban Center District"; and Ordinance No. 6072 January 16, 2007 Page 1 of 4 WHEREAS, the Auburn City Code provides that the Planning Gommission shall consider area-wide zone changes; and WHEREAS, following public notice, the City of Auburn Planning Commission held a public hearing on September 6, 2006, on the proposed Downtown Urban Center rezone; and WHEREAS, after fully considering the testimony and information presented at the public hearings, on September 6, 2006, the Planning Commission submitted its recommendations for the rezone to the City of Auburn City Council; and WHEREAS, the City Council has reviewed and considered the Planning Commission recommendations; and WHEREAS, environmental review on the proposal has been completed in accordance with the requirements of the State Environmental Policy Act (SEPA) with a final determination of non-significance (DNS) issued. on August 22, 2006; and WHEREAS, the City Council finds that the proposal was received by State agencies for the 60-day review period in accordance with State law, RCW 36.70A.106, and that no comments were received. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Section One APPROVAL OF REZONE. All properties within the City of Auburn currently zoned C2 Central Business District, as shown on the map attached hereto, marked as Exhibit "A," and incorporated herein by this reference, are hereby rezoned to the DUC "Downtown Urban Center District" and the City of Auburn Zoning Map is amended to reflect the zoning change. Ordinance No. 6072 January 16, 2007 Page 2 of 4 Section Two CONSTITUTIONALITY OR INVALIDITY. If any section, subsection, sentence, clause, phrase or portion of this Ordinance, is for any reason held invalid or unconstitutional by any Court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision, and such holding shall not affect the validity of the remaining portions thereof. Section Three RECORDING. Upon passage, approval and publication of this Ordinance as provided by law, the City Clerk of the City of Auburn shall cause this Ordinance to be recorded in the office of the King County Auditor, Section Four IMPLEMENTATION. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directions of this legislation. Section Five EFFECTIVE DATE.
