Background Summary:
ACC 10.12.090 is being amended with more concise language. The intent of this code section will not
change and is to designate all city streets as 25 mph, per state law, unless otherwise signed.
ACC 10.12.100 is being amended with more concise language. The intent of this code section will not
change and is to enable the city engineer or designee to modify the speed limit to between 20 mph and
50 mph, as long as the determination is based upon a traffic investigation. This practice is consistent with
the Washington Model Traffic Ordinance.
ACC 10.12.110 and 10.12.120 are being repealed because it is unnecessary to list corridor speed limits
in city code. Furthermore, state law requires speed limits be signed to be enforceable.
ACC 10.12.125 will be amended to add the words "and designee" after "city engineer". This minor
change will formalize the ability of the city engineer to designate another engineer to act in his/her place
as necessary. In addition, some modifications are proposed for discussion to assist with enforcement.
ACC 10.12.130 will be moved to the Traffic-Control Devices and Signals section of City Code because it
pertains more to the timing of traffic signals than to the regulation of speed as ACC.12.065. Its title will
also be amended to more closely reflect its purpose.

AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF AUBURN, WASHINGTON, AMENDING
SECTIONS 10.12.090, 10.12.100, AND 10.12.125 OF
THE AUBURN CITY CODE; REPEALING SECTIONS
10.12.110 AND 10.12.120 OF THE AUBURN CITY
CODE; AND RENUMBERING SECTION 10.12.130
OF THE AUBURN CITY CODE TO 10.12.065; ALL
RELATING TO SPEED LIMITS
WHEREAS, ACC Sections 10.12.090 through 10.12.130 set forth the
speed limits for public streets within the City of Auburn; and
WHEREAS, revisions to those sections would more clearly and concisely
state the speed limits within the City and. more closely match the Washington
Model Traffic Ordinance, which has been adopted by the City; and
WHEREAS, stating the hours within which school zones are to be
enforced will aid in the effective enforcement of those zones,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, DO ORDAIN as follows:
Section 1. Amendment to City Code. That Section 10.12.090 of
the Auburn City Code be and the same hereby is amended to read as follows:

Section 2. Amendment to City Code. That Section 10.12.100 of
the Auburn City Code be and the same hereby is amended to read as follows:
10.12.100 Speed limit decreases and increases --A~-t#ar+z-~cl~
A. Whenever the city engineer

limite permitted by state law upon the public streets, roads or sr

may determine and declare a reasonable and safe maximum speed

B. Any decreased ar increased speed limit as authorized by
subsection A of this section shall be effective when appropriate
signs giving notice thereof are erected. Such maximum speed limit
may be declared to be effective at all times or at such times as are
indicated upon such signs; and differing limits may be established
for different times of the day, different types of vehicles, varying
weather conditions, and other factors bearing on safe speeds,
which shall be effective when posted upon appropriate fixed or

Section 3. Repeal of City Code Sections. That Sections 10.12.110
and 10.12.120 of the Auburn City Code be and the same hereby are repealed:

Notwithstanding the speed limit that would otherwise apply
on a city street, road or other right-of-way, the speed limit in posted
school zones is 20 miles per hour when lights have been installed
in conjunction with any school zone sign and such lights are

10.12.125" or words to that effect. For the purposes hereof, "when

children are present" means: (1) children are occupying or walking
within the marked crosswalk in a posted school zone; (2) children
are occupying or waiting at the curb- or on the shoulder of the
roadway in a posted school zone and are about to cross. the
roadway by way of the marked crosswalk, or (3) children are
present on or walking along the roadway, either on the. adjacent
sidewalk or, in the absence of sidewalks, on the shoulder within the
posted school speed limit zone which extends 300 feet in either
direction from the marked crosswalk. Each of .the criteria defining
the speed limit in school zones (when children present, during the
ident~f~ed hours and locations, and when licthts flashing} are
separate, distinct and independent from each other. (Ord. 5915 §

Section 5. Amendment to City Code. That Section 10.12.130 of
the Auburn City Code be and the same hereby is renumbered to 10.12.065 and
amended to read as follows:

The city engineer or designee, where authorized by state
statute or as directed by action of the city council, shall regulate the
timing. of traffic signals so as to permit the movement of traffic in an
orderly and safe manner. (Ord. 5871 § 2, 2004; Ord. 5212 § 1 (Exh.
E), 1999; 1957 code § 9.04.180.)
Section 6. Implementation. The Mayor is hereby authorized to
implement such administrative procedures as may be necessary to carry out the
directions of this legislation.
Section 7. Severability. The provisions of this ordinance are
declared to be separate and. severable. The invalidity of any clause, sentence,
paragraph, subdivision, section or portion of this ordinance, or the invalidity of the
application thereof to any person or circumstance shall not affect the validity of
the remainder of this ordinance, or the validity of its application to other persons
or circumstances.

Section 8. Effective date. This Ordinance shall take effect and be
in force five. days from and after its passage, approval and publication as
provided by law.
