Background Summary: On December 30, 2006, Maintenance and Operations staff responded to an emergency call from the Fire Department about a fire hydrant at 3~d and 'B' Streets NE. The fire hydrant had been struck by an errant vehicle, causing a 20' sink hole. Upon investigation by City staff, it was determined that the impact upon the hydrant had broken the underlying water main. The excessive force of the water from the broken water main and fire hydrant pipe had washed out the subgrade beneath the sidewalk and roadway, causing the sink hole and exposing a utility gas main and power conduit. Upon assessment of the required repairs and impact to pedestrians and drivers, the Public Works Director determined that the situation demanded an immediate response and that the required work was outside the scope and capabilities of in-house forces. Upon notification of the Mayor, an emergency condition was determined to exist and VLS Construction, Inc., was called out to make repairs. The contractor was called upon to perform the work in accordance with RCW 39.04.280(1)(c), which allows for waiver of competitive bidding requirements in emergency situations, and Auburn City Code 13.10.050, which authorizes the Mayor to enter into emergency contracts. The scope of work includes removal of the broken concrete sidewalk panels, repair of the water main, replacement of the fire hydrant and pipe, replacement of the subgrade, backfilling, replacement of the concrete sidewalk, and repair of the roadway and lawn. Costs are estimated to be approximately $15,000. The Water Utility has $1,000,000 budgeted in 2007 for the Annual Repair & Replacement Program. This work will be paid from that project budget and restitution from the driver will be sought. Resolution No. 4137 January 3, 2007 Page 1 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, HEREBY RESOLVES as follows: Section 1. That the City Council ratifies the Mayor's determination and declaration that an emergency exists in this case, and finds the need for the City to enter into a contract for the repair of a water main, sidewalk, and roadway at 3~d and 'B' Streets NE, without going through typical bidding procedures in an emergency that relieves the City of the requirement to engage in a more lengthy competitive bidding process for this equipment. Section 2. That the Mayor or his designee is authorized to negotiate and enter into a contract with VLS Construction, Inc., to address the needed repairs at 3`d and `B' Streets NE. Section 3.
