Background Summary:
On November 20, 2006 the Auburn City Council approved Resolution No. 4113 authorizing the
Mayor and City Clerk to enter into an interlocal agreement with King County relating to the
annexation of the Lea Hill and West Hill potential annexation areas. That interlocal agreement,
which was approved by the King County Council on December 11, 2006, established
commitments and timelines for the annexation of these areas using the election method.
In addition, the interlocal agreement notes that there would be a collaborative effort to annex
remaining unincorporated islands within the City limits. "Totem", located south of 29th Street SE
and west of D Street SE, is one such remaining area.
The attached resolution would initiate the process for annexation by election. The resolution
must describe the particular annexation area including its legal description, the estimated
number of registered voters and that the City will pay for the costs of the election.
Should the City Council approve this resolution then the proposed annexation would be subject
to, after the City's filing of a Notice of Intent to Annex application, the minimum 45 day review
period with the King County Boundary Review Board which may approve, approve with
modifications or deny the annexation. If the BRB approves the proposal, then the City may then
file the annexation with the King County and request an election date at least 60 days later.
The earliest possible election date would be May 15, 2007. For the City to be in a position to
even consider that as an election date then City Council action on the attached resolution would
be necessary at the January 16, 2007 City Council meeting.
On January 8, 2007 the PCD Committee reviewed the proposed resolution and recommended
approval.

RESOLUTION NO. 4140
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
AUBURN, WASHINGTON, REQUESTING THAT THE
ANNEXATION OF AN UNINCORPORATED AREA (ISLAND)
CONTIGUOUS TO THE CORPORATE LIMITS OF THE CITY BE
PLACED BEFORE THE VOTERS OF THE PROPOSED
ANNEXATION AREA -SOUTH OF 29TH STREET SE AND WEST
OF D STREET SE KNOWN AS THE "TOTEM DISTRICT"
WHEREAS, the City of Auburn has areas of unincorporated territory contiguous
to the corporate limits of the City, which includes unincorporated territory (island)
south of 29th Street SE and west of D Street SE commonly known as the "Totem
District"; and,
WHEREAS, the City is authorized to initiate annexations via election pursuant
to RCW 35A.14.015; and,
WHEREAS, when the Auburn City Council determines that the best interests
and general welfare of the City would be served by the annexation of the
unincorporated territory contiguous to such city, it would thusly be appropriate to call
for an election to be held to submit to the voters of such territory the proposal for
annexation.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, HEREBY RESOLVES as follows:
Section 1. That the Auburn City Council has determined that the best interests
and
general welfare of the City would b~ served by the annexation of the unincorporated
territory contiguous to such city, and that it is appropriate to call for an election to be
held to submit to the voters of such territory the proposal for annexation.
Section 2. That the description of the boundaries of the area to be annexed,
hereinafter identified and known as the "TOTEM DISTRICT" annexation area, is as
follows:
That portion of Government Lot 2 in the northwest quarter of Section 30 Township 21
North, Range 5 East, Willamette Meridian, King County, Washington described as
follows:
Beginning at the southwest corner of Lot 6 Block 1 of the plat of South Auburn Garden
Tracts recorded in Volume 20 of Plats at Page 76, records of King County,
Washington, said corner also being the southwest corner of the lands annexed to the
City of Auburn by ordinance number 3726;
Thence east along the south line of said Lot 6 and the south boundary of said lands
annexed to the City of Auburn by ordinance number 3726 a distance of 170 feet to the
southeast corner of said lot 6;
Thence north along the east line of lots 6, 5 and 4 of said plat and along the east
boundary of said lands annexed to the City of Auburn by ordinance number 3726 a
distance of 200.25 feet to the south line of Lot 10, Block 1 of said plat;
Thence west along said south line of said Lot 10 a distance of 2.00 feet to the
southwest corner of said Lot 10;
Thence north along the west line of said Lot 10 a distance of 1.75 feet to the most
northerly line of said Lot 4, Block 1, the most northerly boundary of the lands annexed
to the City of Auburn by ordinance number 3726 and the southeast corner of the lands
annexed to the City of Auburn by ordinance number 4138;
Thence north along the west line of Lots 10 and 11, Block 1 of said plat and along the
east boundary of the lands annexed to the City of Auburn by ordinance number 4138
a distance of 103 feet to the southeast corner of the lands annexed to the City of
Auburn by ordinance number 4665;
Thence north along the west line of Lots 11 and 12, Block 1 of said plat and along the
east line of the lands annexed to the City of Auburn by ordinance number 4665 a
distance of 95 feet to the northwest corner of said Lot 12;
Thence east along the north line of said Lot 12 a distance of 2.00 feet to the southeast
corner of Lot 3, Block 1 of said plat;
Thence north along the east line of Lots 3, 2 and 1, Block 1 of said plat and along the
east line of the lands annexed to the City of Auburn by ordinance number 4665 a
distance of 200.97 feet to the south marginal line of 29tH Street Southeast (S. 356tH
Street) and the south boundary of the lands annexed to the City of Auburn by
ordinance number 1279;
Thence east along said south marginal line of 29tH Street SE (S. 356tH Street) and the
south boundary of the lands annexed to the City of Auburn by ordinance number 1279
a distance of 630 feet to the northwest corner of Lot 1, Block 3 of the plat of South
Auburn Garden Tracts recorded in Volume 20 of Plats at Page 76, records of King

Thence south along last said west line and the west boundary of the lands annexed to
the City of Auburn by ordinance 1225 to a line parallel with and 128 feet northerly of
the south line of said northwest quarter of said Section 30, and an angle point in the
northerly boundary of the lands annexed to the City of Auburn by ordinance 3839;
Thence westerly along said parallel line and the northerly boundary of said lands
annexed to the City of Auburn by ordinance 3839 a distance of 189.75 feet;
Thence north along said boundary of said lands annexed to the City of Auburn by
3839 a distance of 128 feet to the south right of way line of 32"d Street SE (S 359t"
Street);
Thence west along said south right of way line and said northerly boundary of said
lands annexed to the City of Auburn by ordinance 3839 to the southeast corner of the
lands annexed to the City of Auburn by ordinance number 6048;
Thence north along the east boundary of said lands annexed to the City of Auburn by
ordinance 6048 and along the west right of way line of 85t"Avenue South to the
northeast corner of Lot 9, Block 6 of said plat;
Thence west along the north boundary of said lands annexed to the City of Auburn by
ordinance 6048 and along the north line of Lots 9 and 2, Block 6 of said plat to the
east marginal line of "A" Street SE (East Valley Road) and the east boundary of the
lands annexed to the City of Auburn by 1171;
Thence north along said east marginal line of "A" Street SE and the east boundary of
the lands annexed to the City of Auburn by City of Auburn ordinance 1171 a distance
of 129 feet more or less to the point of beginning.

Section 3. That the number of voters residing therein as nearly as may be
determined is 74.
Section 4. That the City shall pay the cost of the annexation election.
Section 5. That, in light of the small size of the annexation area (less than 50
acres), pursuant to RCW 35A.14.220, it is requested that the King County Boundary
Review Board waive or decline review.
Section 6. That a certified copy of the resolution shall be filed with the
legislative authority for King County, and with the King County Boundary Review
Board.
Section 7. That the Mayor is authorized to implement such administrative
procedures as may be necessary to carry out the directives of this legislation,
including providing notices pursuant to RCW 35A.14.070, and filing a Notice of Intent
to Annex to the King County Boundary Review Board, and communicate the City's
request that the King County Boundary Review Board waive or decline review. The
Mayor, or designee, is further authorized to take such other steps as is reasonably
necessary to have the
annexation placed on the ballot before the appropriate voters.
Section 8. That this Resolution shall take effect and be in full force upon
passage and signatures hereon.
