City Council to approve Amendment No. 2 to Consultant Agreement No. AG-C-278 with Northwest Land
& Water, Inc. for Department of Ecology Phase 2 water rights investigation work.
Background Summary:
The City is currently involved in water rights investigations associated with a pending application with the
Department of Ecology. To date, Consultant Agreement No. AG-C-278 and Amendment No. 1A with
Northwest Land & Water, Inc. has lead to the completion of Phase 1 work for our water rights application.
This amendment provides for the technical support in evaluating potential impacts and mitigation
strategies for Phase 2 work of the water rights application. The specific scope of additional services
includes: Calibrating the existing groundwater model; running model simulations for proposed wellfield;
multiple meetings with the City, Ecology and Muckleshoot Tribe; ongoing review of cost-reimbursement
for Phase 2; ongoing review of Lake Tapps ROE; and preparation of report detailing potential impacts and
proposed mitigation strategy.
Amendment No. 2 adds approximately $200,000 in compensation to the agreement. The current not-to-
exceed amount will be raised from $66,701 to approximately $230,000. Budget line item
430.00.534.100.41 budgets $25,000 and $50,000 for Northwest Land & Water in 2007 and 2008
respectively. A budget adjustment will be needed in 2007 for the increased budget impact.
