The storm water ordinance needed to be revised to implement monthly utility billing. The proposed language change went to the Public Works Committee on April 9, 2007 and the Finance Committee on April 16, 2007. Both committees accepted proposed language change. NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Amendment to City Code. That Section 13.48.120 of the City of Auburn City Code is amended to read as follows: 13.48.120 Billing and collection. Storm drainage utility rates shall be billed on a ~i~rae~+thty monthly basis. Storm drainage charges shall start from the day water meter serving the property is installed by the city. Incases where the property does not receive water service from the city of Auburn, storm drainage charges shall start from the day that the storm drainage permit is finalized by the city. A. Order of Payment. Payments received for utility bills shall be applied towards the following bills in the order of priority shown: 1. Late charges; 2. Additional Fees 2.3. Storm; ~-4. Garbage; 45. Sewer; 5-6. Water. B. Service Charges -Payment Delinquencies. Payment for storm drainage service charges shall be due and payable to the finance department office 2815 days after the Ordinance No. 6100 Page 1 of 3 May 30, 2007 billing date appearing on the bill, and shall be delinquent as identified in ACC 13.06.300. A late charge as listed in ACC 13.06.511 will be addressed if the account is delinquent. C. Charges Constitute Lien. All storm drainage utility rates referred to in this article shall constitute a lien upon the property from which such charges are due, superior to all other liens and encumbrances whatsoever, except for general taxes and local special assessments. Enforcement of such lien shall be in the manner provided by law. (Ord. 6034 § 4, 2006; Ord. 5853 § 1, 2004; Ord. 5293 § 2, 1999; Ord. 5212 § 1 (Exh. J), 1999; Ord. 4492 § 4, 1991.) Section 2. Implementation. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directives of this legislation. Section 3. Effective Date.
