Background Summary: Resolution No. 4121 fixes a time for a public hearing on July 2, 2007, on the petition from the City of Auburn for vacation of portions of I Street NE. This vacation is part of an agreement between the City of Auburn and the Port of Seattle for a land exchange in which the City will acquire new right of way to be used for new alignment of the future I Street NE. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, HEREBY RESOLVES as follows: Section 1. That a hearing on the vacation of a portion of I Street NE, located within the City of Auburn, Washington, legally described in Exhibit "A", and as shown on the document attached hereto, marked as Exhibit "B" and incorporated herein by this reference, is hereby set for 7:30 p.m., or as soon thereafter as the matter can be heard, on the 2nd day of July, 2007, at the City Council Chambers at 25 West Main Street, Auburn, Washington, 98001, with all persons wishing to speak to the vacation at the public hearing being invited to attend. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directives of this legislation, including posting notice of such public hearing as required by State law and City Ordinance. The City will vacate a portion of the existing, undeveloped I Street NE right-of-way to the Port, and in exchange the Port will dedicate a new right-of-way to the City. The right-of-way to be acquired by the City is consistent with the right-of-way alignment proposed for I Street NE. Also through the agreement, the City would obtain rights- of-way for the east-west roadway of 49tH/51St Street NE and for widening the south side of South 277tH Street. Advertising/Posting: The legal advertising and posting requirements for the proposed vacation have been met. Applicable Policies & Regulations: • RCW's applicable to this situation -meets requirements of RCW 35.79. • MUTCD standards -not affected by this proposal. • City Code or Ordinances -meets requirements of ACC 12.48. • Comprehensive Plan Policy -not affected. • City Zoning Code -not affected. Public Benefit: The City will gain the more advantageous right-of-way needed for the realignment of 1 Street NE consistent with the Comprehensive Transportation Plan. The revised right-of-way alignment of I Street NE allows the City to create a safer intersection connection to South 277tH Street and allows the Port of Seattle to enhance utilization of their property. Also, the vacation facilitates the land trade agreement that gains other necessary rights-of-way for the street network. Background: Both the existing and proposed right-of-way alignments are composed of flat undeveloped properties. The existing right-of-way was acquired by deed for $10.00 from P. Hendley and Associates, Inc. in 1989. The Port of Seattle is the owner of the property that encompasses the proposed right-of-way alignment. Discussion: The vacation application was circulated to Puget Sound Energy, Comcast, and Qwest. Qwest reported that it had placed six underground vaults in the city right-of-way in 1990. They are empty and not being used. The vacation application was circulated to City staff. City staff has commented that the vacation of the right-of-way should be contingent upon the execution of a real estate exchange agreement between the City and the Port of Seattle. Assessed Value: To facilitate the agreement and avoid additional financial contributions from either party, the agreement has been structured so the City of Auburn and the Port of Seattle will exchange approximately equal areas of land of 225,098 square feet. Recommendation: Staff recommends that if the street vacation is granted it needs to be subject to the following conditions: 1. The vacation of the portion of the I Street NE right-of-way should be contingent upon the execution of a real estate exchange agreement between the City and the Port of Seattle.
