Background Summary:
Chapter 42.56 Revised Code of Washington (RCW) requires all cities and public agencies to maintain
and make available a current index of public records. The state statute also states that if maintaining
such an index would be unduly burdensome or interfere with agency operation, a city must issue and
publish a formal order specifying the reasons why and the extent to which compliance would be unduly
burdensome. The magnitude and diversity of seven City departments with an even greater number of
divisions, has resulted in the creation and use of many different computer systems, formats and/or
databases, programs and information retaining systems which would be extremely difficult, if not
impossible, to compile into a single index
Resolution No. 4222 finds that the City of Auburn is not required to maintain an all-inclusive index of
public records, due to findings of the City Council that the requirement is unduly burdensome and such a
list is nearly impossible to create and/or maintain.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
AUBURN, WASHINGTON, ADOPTING A FORMAL POSITION
AND DECLARING THE MAINTENANCE OF AN ALL-INCLUSIVE
INDEX OF EVERY PUBLIC RECORD TO BE UNDULY
BURDENSOME, AS REQUIRED BY RCW 42.56.070
WHEREAS, Chapter 42.56 Revised Code of Washington (RCW) requires
all cities and public agencies to maintain and make available a current index of
public records; and
WHEREAS, the state statute also states that if maintaining such an index
would be unduly burdensome or interfere with agency operation, a city must
issue and publish a formal. order specifying the reasons why and the extent to
which compliance would be unduly burdensome; and
WHEREAS, the state statute further provides that in spite of such an
unduly burdensome order, all indexes maintained by the city must be made
available to provide identifying information on those records which are to be
made available for public inspection; and
WHEREAS, the City of Auburn is a municipal corporation of the State of
Washington which provides general municipal and utility services to its residents
and others; and
WHEREAS, the magnitude and diversity of seven City departments with
an even greater number of divisions, has resulted in the creation and use of
many different computer systems, formats and/or databases, programs and
information retaining systems which would be extremely difficult, if not
impossible, to compile into a single index; and

WHEREAS, anticipated City revenues do not allow for additional staff
members for the sole purpose of creating and maintaining such an all-inclusive
index.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
HEREBY resolves as follows:
Section 1. The City of Auburn is not required to maintain an all-inclusive
index of public records, due to findings of the City Council that the requirement is
unduly burdensome and such a list is nearly impossible to create and/or
maintain.
Section 2. The City of Auburn shall make available all public records and
any indexes created for internal use upon receipt of a public record request to the
extent the records and indexes are not exempt from inspection and/or copying
pursuant to the Public Records Act (Chapter 42.56 RCW) or other applicable law.
Section 3. That the Mayor is authorized to implement such
administrative procedures as may be necessary to carry out the directives of this
legislation.
Section 4. That this Resolution shall take effect and be in full force
upon passage and signatures hereon.
