Lewis was not in attendance, Mayor Pro Tem Sue Singer presided over the meeting. Mayor Pro Tem Singer called the meeting to order at 7:30 and led those in attendance in the Pledge of Allegiance. B. Roll Call Mayor Pro Tem Singer and the following Councilmembers were present: Rich Wagner, Gene Cerino, Nancy Backus, Bill Peloza, Lynn Norman, and Virginia Haugen. Announcements and Appointments 1. Announcements Mayor Pro Tem Singer announced that Mayor Lewis was in Washington DC attending the National Mayors Conference. 2. Agenda Modifications Agenda modifications included transmittal of revised Ordinance No. 6158 which was distributed prior to the Council meeting, corrected page 12 of the January 7, 2008 City Council minutes, revised Resolution No. 4289, and the addition of Resolution No. 4301. II. CITIZEN INPUT, PUBLIC HEARINGS 8~ CORRESPONDENCE A. Public Hearings No public hearing was scheduled for this evening. B. Audience Participation This is the place on the agenda where the public is invited to speak to the City Council on any issue. Those wishing to speak are reminded to sign in on the form provided. Norm Johnson, 32338 109th Place SE, Auburn Mr. Johnson inquired regarding recent real estate purchases by the City and stated that the City should not own private property. Mr. Johnson also expressed his displeasure regarding traffic revisions on Auburn Way South and stated that he believes the City should reduce the number of City employees. Mr. Johnson distributed a letter related to his statements and requested a response from City staff regarding his concerns. Mr. Johnson also stated that the contractor selected for the Auburn Way South sewer project is doing a poor job. It is his belief that they are not complying with state regulations. Steve Williams, 604 22"d Street SE, Auburn Mr. Williams stated that he is a parent of a child with mental health concerns and an advocate for parents with similar concerns. Mr. Williams read and distributed a letter he wrote promoting mental health programs. In an effort to help children in the Auburn community, Mr. Williams urged cooperation between elected officials and mental health providers to provide the best services available. C. Correspondence No correspondence was received. Page 2 City of Auburn Council Meeting Minutes January 22, 2008 III. COUNCIL COMMITTEE REPORTS A3.7.6 A. Municipal Services Chair Cerino reported that the Municipal Services Committee met on January 14, 2008 at 3:15 p.m. The Committee discussed Resolution Nos. 4287, 4288, 4289, 4290, and 4293. .The Committee also received an overview of the Valley Cities Broadband Report and discussed health benefits, Ordinance No. 6155 relating to fireworks, a towing ordinance, Airport concerns and problems, and the Municipal Services Committee matrix. The next meeting of the Municipal Services Committee is scheduled for January 28, 2008 at 3:30 p.m. B. Planning & Community Development Chair Norman reported that the Planning and Community Development Committee met on January 14, 2008 at 5:00 p.m. The Committee discussed and recommends approval of Ordinance No. 6153 and Resolution No. 4297. The Committee also discussed wayfinding signage, Resolution No. 4294, and potential zoning code amendments. The Committee also received a report on the 2008 Legislative agenda by Government Relations Manager Carolyn Robertson and Consultant Tom Dooley. Councilmember Wagner reported on the formation of the Community Center Committee and progress of Les Gove Community Center. The next regular meeting of the Planning and Community Development Committee is scheduled for January 28, 2008 at 5:00 p.m. C. Public Works Chair Wagner reported that the Public Works Committee met this afternoon at 3:30. The Committee discussed and recommends approval of contract administration items, Ordinance Nos. 6157 and 6158, and Resolution No. 4298 and 4301. The Committee also discussed amendments to fireworks Ordinance No. 6155, Corp of Engineers Design Agreement for Mill Creek ecosystem improvements, selection of 2008 street preservation candidates, candidates for the 2008 Save Our Streets (SOS) program, radar speed sign locations, gateway signage, repair of the 15th Street bridge railing, and Ordinance No. 6154 to establish a loading zone for Cascade Orthopedics. The Committee also received a briefing on the Fats, Oils and Grease (FOG) program, reviewed c-curbing installation on West Valley Highway, the Rio Verde Mobile Home Park water system, and discussed the orientation process for the Page 3 City of Auburn Council Meeting Minutes January 22, 2008 Public Works Committee. The next regular .meeting of the Public Works Committee is scheduled for February 4, 2008 at 3:30 p.m. D. Finance Chair Backus reported that the Finance Committee met this evening at 6:30. The Committee discussed and recommends approval of claims and payroll vouchers, Ordinance No. 6156, and Resolution Nos. 4293 and 4301. The Committee also discussed addressing zoning standards for the West Hill Annexation Area, Resolution No. 4297, Qwest parking lot lease, Auburn on First addendum to the Purchase and Sale Agreement, banking services contract extension, and Ordinance No. 6160. The next regular meeting of the Finance Committee is scheduled for February 4, 2008 at 6:30 p.m. E. Community Center Chair Wagner reported that the Community Center Committee will meet on January 25, 2008 at 8:45 a.m. The meeing will include a field trip with BLRB Architects to visit various community centers. F. Downtown Redevelopment Chair Norman reported that the first meeting of the Downtown Redevelopment Committee is scheduled for February 5, 2008 at 11:30 a.m. IV. REPORTS At this time the Mayor and City Council may report on significant items associated with their appointed positions on state, regional and local organizations. A. From the Council Mayor Pro Tem Singer explained the new format regarding Councilmember reports which will focus on regional and non-city related Councilmember committee assignments and meetings. Councilmember Wagner reported that he attended the Regional Access Mobility Project (RAMP) meeting at which he heard a presentation by John Stanton who represents a group that is proposing a regional transportation governance system that would replace Puget Sound .Regional Council (PSRC) with regards to transportation planning. The proposal was not well received by attendees. Page 4 City of Auburn Council Meeting Minutes January 22, 2008 Councilmember Norman reported that she attended the Business Journal's Legislative reception at which Governor Christine Gregoire was present. Governor Gregoire spoke regarding the condition of the business climate in the state of Washington. Councilmember Norman also met with City of Auburn diversity consultants and the project will proceed to phase two, which consists of meeting with small community groups. Councilmember Peloza reported that he attended the Suburban Cities Association's Regional Caucus Orientation at which he was appointed a continued member and was elected caucus chair for the Regional Water Quality Committee. He also attended the Metropolitan Solid Waste Advisory Committee. The main topic of the meeting was to stress to the public the importance of recycling and promoting waste reduction. He also attended the Water Resource Inventory Area (WRIA 9) Management and Forum meetings at which the Corp of Engineers reported that $6,000,000 was authorized for Green River levy rehabilitation in the Kent and Tukwila areas due to the November 2006 storm event. Mayor Pro Tem Singer announced that Councilmember Haugen was elected unanimously by the Suburban Cities Association as their representative on the King County Solid Waste Committee. Councilmember Haugen reported that she attended the Suburban Cities Association meeting at which she sat in on a committee meeting on homelessness. B. From the Mayor Mayor Pro Tem Singer reported that she, Mayor Lewis and Councilmember Norman attended the Puget Sound Business Journal's reception for regional leaders, including elected officials and business leaders. Mayor Pro Tem Singer also attended the Puget Sound Regional Council (PSRC) Economic Development Board and Scoping meetings. The PSRC Scoping meeting provided an opportunity for the public to comment on the long range transportation plan for the four-county region. Mayor Pro Tem Singer invited the public to attend the PSRC Scoping meeting which will be hosted by the City or Auburn in the Council Chambers on January 24, 2008 from 3:00 to 6:00 p.m. and will be open for public comment. Page 5 City of Auburn Council Meeting Minutes January 22, 2008 Mayor Pro Tem Singer also spoke at the Suburban Cities Association's Regional Caucus Orientation and Training regarding PSRC committee goals for year 2008 and provided an introduction on the functions of PSRC and also attended the PSRC audit. She also attended the Suburban Cities Public Issues Committee meeting and chaired the Auburn Tourism Board meeting. In addition, she had dinner with the Prime Minister of Finland as a representative of the elected officials in the Puget Sound region. She will be part of a delegation which will be going to Finland in May 2008. V. CONSENT AGENDA All matters listed on the Consent Agenda are considered by the City Council to be routine and will be enacted by one motion in the form listed. A. Ordinance No. 6157 04.9 An Ordinance of the City Council of the City of Auburn, Washington, amending Section 12.04.010 of the Auburn City Code relating to highway access management Councilmember Wagner moved and Councilmember Cerino seconded to introduce and adopt Ordinance No. 6157. Ordinance No. 6158 A3.8.26 An Ordinance of the City Council of the City of Auburn, Washington, establishing a citizen's committee to advise the Mayor and City Council on matters relating to transportation, transit and trails Councilmember Wagner moved and Councilmember Cerino seconded to introduce and adopt Ordinance No. 6158. MOTION CARRIED UNANIMOUSLY. 7-0. 5. Ordinance No. 6159 A3.8.14 Page 8 City of Auburn Council Meeting Minutes January 22, 2008 An Ordinance of the City Council of the City of Auburn, Washington, amending Section 2.45.010 of the Auburn City Code, relating to membership for the Planning Commission Councilmember Norman moved and Councilmember Backus seconded to introduce and adopt Ordinance No. 6159. Resolutions Resolution No. 4284 A3.16.6 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk to execute an Agreement between the City of Auburn and Pearl Building Services for janitorial services Councilmember Cerino moved and Councilmember Peloza seconded to adopt Resolution No. 4284. MOTION CARRIED UNANIMOUSLY. 7-0. 2. Resolution No. 4285 A3.16.6 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk to execute an Agreement between the City of Auburn and Pacific Power Generation for generator maintenance work Councilmember Cerino moved and Councilmember Peloza seconded to adopt Resolution No. 4285. Resolution No. 4287 04.7 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and the City Clerk to execute an amendment to the Comprehensive Garbage, Recyclables, and Yard Debris Collection Contract between the City of Auburn and Waste Management of Washington, Page 9 City of Auburn Council Meeting Minutes January 22, 2008 Inc., DBA RST Disposal, adopted by Resolution No. 3362 on July 16, 2001 Councilmember Cerino moved and Councilmember Peloza seconded to adopt Resolution No. 4287. Councilmember Haugen inquired if this contract was advertised for bids. Director Coleman explained that the contracts for garbage collection services in the City of Auburn are provided by contractors that have a franchise in these areas. The City advertises for bids for the City of Auburn franchise area when contracts terms are due to expire. Resolution No. 4287 represents an amendment to the agreement with Waste Management who currently provides services in the newly annexed West Hill area. MOTION CARRIED. 6-1. Councilmember Haugen voted no. 4. Resolution No. 4288 F5.3 A Resolution of the City Council of the City of Auburn, Washington, authorizing the acceptance and appropriation of grant funds in the amount of One Hundred Three Thousand Two Hundred Sixty-one Dollars ($103,261.00), and authorizing the Mayor and City Clerk to execute an Interlocal Agreement between King County and the City of Auburn to accept said funds for implementation of the 2008- 2009 Waste Reduction and Recycling Grant Program Councilmember Cerino moved and Councilmember Peloza seconded to adopt Resolution No. 4288. MOTION CARRIED UNANIMOUSLY. 7-0. 5. Resolution No. 4289 F5.2.7, 04.7.3 A Resolution of the City Council of the City of Auburn, Washington, authorizing the acceptance and appropriation of grant funds in the amount of Sixty Six Thousand One Hundred Seventy Five Dollars ($66,175), and authorizing the Mayor and City Clerk to execute an Interlocal Agreement Page 10 City of Auburn Council Meeting Minutes January 22, 2008 between the State of Washington Department of Ecology and the City of Auburn to accept said funds for implementation of the 2008-2009 coordinated prevention grant program Councilmember Cerino moved and Councilmember Peloza seconded to adopt Resolution No. 4289. Resolution No. 4297 03.4.2.1.2 A Resolution of the City of Auburn, Washington, acknowledging and accepting the 2007 Pierce County Buildable Lands Report Councilmember Norman moved and Councilmember Backus seconded to adopt Resolution No. 4297. Resolution No. 4300 03.4.2.1.2, 03.1 A Resolution of the City Council of the City of Auburn, King County, Washington, establishing a moratorium on the filing of land use applications; building, and grading permit applications in the drainage area contributing surface flows to Mill Creek Tributaries 0045, 0047, 0048 and 0053 as identified by King County and as defined within this Ordinance, to be effective for a period of six months and setting a date for a public hearing Director Dowdy reported that this is a relatively old issue which is being brought forward this evening due to the recently annexed West Hill area. Some of the recently annexed area includes lands that have been under study by King County referred to as the Mullen Slough Area. King County is in the process of finalizing their study on the Mullen Slough Area within the next few months. The moratorium would provide a period of time for the City of Auburn staff to coordinate with King County Department of Natural Resources staff to find a solution with regard to drainage areas which fall within both jurisdictions. Storm Drainage Engineer Tim Carlaw distributed and reviewed a colored map of the proposed moratorium area which he also displayed for the benefit of the audience. The proposed area is located on the north hills of the West Hill Annexation Area and entails the four tributary drainage ways for the area. The tributaries are identified as King County Tributary 0053, 0048, 0047, and 0045. The proposed moratorium area is comprised of approximately 748 acres. Drainage problems previously reported were from citizens that live primarily in the north valley floor area and are within the confluences of some of the tributaries. Problems cited are generally due to erosion associated with steep ravine drainage ways, primarily for Tributaries 0053 and 0045. When the erosion occurs, sedimentation accumulates in the flats of the valley. This causes associated flooding, from time to time, when the channels diverge from one drainage course to another. Staff has participated in a number of coordination meetings with King County Department of Natural Resources Management technical staff in an effort to keep them engaged in this issue and to hold them Page 12 City of Auburn Council Meeting Minutes January 22, 2008 accountable for the implementation of possible solutions. To address the City's concerns, King County staff has completed a number of studies and are currently preparing an alternative study, primarily for Tributary 0045. King County will share their findings with the City and will also begin the process to garner public input. The City will also participate with King County efforts to involve the public and formulate solutions. King County has indicated that the Additional Alternatives Report should be completed in approximately two months. Staff feels the timing for the recommendation to impose the moratorium is appropriate as the annexation of the West Hill area is complete and they have a better understanding of the issues and property owner concerns. The completion of the King County Additional Alternatives Report should allow for a comprehensive solution and will assist in identifying what the City can pursue in a uniform manner. City staff is currently in the process of updating the Comprehensive Storm Drainage Plan and determining the role of the City of Auburn and King County with regard to solutions. Staff will continue to coordinate with affected property owners and to keep track of unmitigated impacts that may occur. For these reasons, staff recommends approval of the moratorium and setting a public hearing to receive citizen input. In response to .questions from Mayor Pro Tem Singer, Mr. Carlaw stated that the King County Department of Natural Resources Mullen Slough Capital Improvement Project Study is comprised of all the tributary areas including the agriculture protection district. The study is dated October 2002. Councilmember Wagner inquired if the study provides historic flow data for the tributary streams. Mr. Carlaw indicated that the study contains peak flow information for different return intervals at various locations. Councilmember Wagner requested that a copy of the Mullen Slough Capital Improvement Project Study be provided to Public Works Committee members.
