City Council conduct a public hearing.
Background Summary:
RCW 35A.63.220 establishes a process whereby cities may impose moratoria on zoning, land use and
development regulations. The City of Auburn employed that device to impose a moratorium on the
development of the West Hill annexation area as it relates to the drainage area contributing flows to Mill
Creek tributaries 0045, 0047, 0048 and 0053, as identified by King County. In connection with the
statutory authority for the moratorium, the statute requires that a public hearing be held within 60 days
after the date the moratorium is approved. The public hearing scheduled for February 19, 2008, falls
within the time-frame required since Resolution 4300 was adopted January 22, 2008.
The action before the City Council is to receive the testimony of persons interested in or speaking to the
moratorium issues and for the Council then to decide whether to maintain the moratorium as is, remove
the moratorium or modify it in some way, consistent with such testimony.
