Flag Salute Mayor Lewis called the meeting to order at 7:30 p.m. and led those in attendance in the Pledge of Allegiance. B. Roll Call Mayor Lewis and the following Councilmembers were present: Rich Wagner, Sue Singer, Gene Cerino, Nancy Backus, Bill Peloza, Lynn Norman and Virginia Haugen. Staff members present included: GIS Manager Ashley Riggs; Human Resources and Risk Management Director Brenda Heineman; Planning, Building and Community Director Cindy Baker; Public Works Director Dennis Dowdy; Chief of Police Jim Kelly; City Attorney Daniel B. Heid; Parks, Arts and Recreation Director Daryl Faber; Finance Director Shelley Coleman; Parks Maintenance Manager Mike Miller; and City Clerk Danielle Daskam. C. Announcements and Appointments 1. Announcements a) Mill Pond Fishing Derby Mayor Lewis introduced Lions Club Member Bob Darrigan to report on the Mill Pond Fishing Derby. Mr. Darrigan reported on the fourth Annual Fishing Derby for Special Needs Youth which was held at Auburn Mill Pond last weekend. Club members and their families joined together to bring this event to Auburn. Special needs children, their families and their friends were invited to this year's event. Mr. Page 1 City of Auburn Council Meeting Minutes May 5, 2008 Darrigan thanked Mayor Lewis, Parks Maintenance Manager Mike Miller, Washington State Department of Fish and Wildlife, Auburn Sports and Marine, Green River Steelhead Trout Club, and other contributors for their cooperation in organizing this event. Mr. Darrigan presented Parks Maintenance Manager Mike Miller with a certificate of appreciation for his assistance in making the Fishing Derby such a successful event the past four years. b) Auburn Rotary Club to Present City of Auburn with $25,000 for Improvements to Rotary Park Auburn Rotary Club President Mike McDermott was joined by club members Josh Hatley, Dr. Francis Horner, Karen Henry, and Dr. Tom Hughes to present the City of Auburn with a $25,000 check to fund renovations to Rotary Park. Other Auburn Rotary Club members in attendance included Councilmember Bill Peloza, City Attorney Dan Heid, Police Chief Jim Kelly, and Parks, Arts and Recreation Director Daryl Faber. The Rotary Park work party will be held June 6tn and 7tn c) Proclamation - "Relay for Life Auburn Cancer Walk Days" Mayor Lewis read and presented a proclamation declaring May 16 and 17, 2008 as "Relay for Life Auburn Cancer Walk Days" in the city of Auburn to JD Drollinger, Chairman of the Auburn Relay for Life Committee. Mr. Drollinger presented Mayor Lewis with a commemorative sign designating Auburn as a Relay for Life community. d) Proclamation - "Discover Auburn Week" Mayor Lewis read and Mayor Pro Tern and Auburn Tourism Board Chair Sue Singer presented a proclamation declaring the week of May 10-17, 2008 as "Discover Auburn Week" in the city of Auburn to Auburn Tourism Director Debbie Luce. Ms. Luce spoke briefly regarding the Discover Auburn activities and contest that will begin next week. Page 2 City of Auburn Council Meeting Minutes May 5, 2008 e) Proclamation - "Peace Officers' Memorial Day and National Police Week" Mayor Lewis read and presented a proclamation declaring May 15 as Peace Officers' Memorial Day and the week of May 11-18, 2008 as Police Week in the city of Auburn to Chief of Police Jim Kelly. Mayor Lewis encouraged citizens to commemorate law enforcement officers for their service. Chief Kelly thanked Mayor Lewis and the City Council for their continued support of the Auburn Police Department. 2. Appointments There was no appointment for Council consideration. D. Agenda Modifications There was no agenda modification. II. CITIZEN INPUT, PUBLIC HEARINGS & CORRESPONDENCE A. Public Hearings No public hearing was scheduled for this evening. B. Audience Participation This is the place on the agenda where the public is invited to speak to the City Council on any issue. Those wishing to speak are reminded to sign in on the form provided. Joe Sciola, 1225 23`d Street SE, Auburn Mr. Sciola spoke regarding the conditions of a neighboring residence. Mr. Sciola stated the residence was abandoned by its owner five years ago leaving five cats inside and the premises in poor condition. Mr. Sciola reported that he has reported the conditions to Animal Control, the Public Health Department, and Code Enforcement to no avail. Mr. Sciola requested that the City take steps to rectify the nuisance. Dick Hutchens, 1405 23`d Street SE, Auburn Mr. Hutchens agreed with the comments made by Mr. Sciola earlier regarding the condition of the house on 23"' Street SE. Mr. Hutchens stated that the house is stacked with garbage, the septic system has backed up, and the premises is filled with abandoned cars, filth and rodents. Mr. Hutchens also reported that each time a notice of code violation is posted on the premises, a neighbor Page 3 City of Auburn Council Meeting Minutes May 5, 2008 removes the notice. Mr. Hutchens requested the City take action to rectify the situation. Joe O'Donnell, 1315 23rd Street SE, Auburn Mr. O'Donnell requested that the City improve 22nd Street SE, 23rd Street SE, 24th Street SE and 25th Street SE. Mr. O'Donnell also agreed with comments made by Mr. Sciola and Mr. Hutchens earlier regarding the condition of the house on 23rd Street SE. He requested that the City take action to remedy the condition of the house. Mayor Lewis responded to the public comments regarding the house on 23rd Street SE. Mayor Lewis stated that City Code Enforcement Officers have visited the site and written violations when warranted. Additionally, Animal Control has visited the site, and the City has requested King County Public Health to inspect the premises. Mayor Lewis assured the neighbors that the City's Code Enforcement Officers will continue to inspect the site on a regular basis. Mayor Lewis encouraged the neighbors to contact their King County Council representative and King County Public Health and urge them to address the septic system issue. Mayor Lewis responded to Mr. O'Donnell's comments regarding the condition of the streets in his neighborhood. Mayor Lewis reported that the Save Our Streets Programs provides for the improvement of approximately seven and one-half miles per year. Mayor Lewis stated that a portion of 23rd Street SE east of Cedar Lanes will be improved this year, and a portion of 23rd Street SE toward R Street SE will be improved next year. C. Correspondence No correspondence was received for City Council review. III. COUNCIL COMMITTEE REPORTS A3.7.6 A. Municipal Services Chair Cerino reported the Municipal Services Committee met April 28, 2008. The Committee discussed Resolution No. 4345 relating to the National League of Cities' Partnership for Inclusive Communities, a proposed Adopt-a-Road and Adopt-a-Stop Programs, reducing police patrol car idling and a possible idling ordinance, a license plate reader program, and Resolution No. 4348 approving a Purchase and Sale Agreement. The next regular Page 4 City of Auburn Council Meeting Minutes May 5, 2008 meeting of the Municipal Services Committee is scheduled for May 12, 2008 at 3:30 p.m. B. Planning & Community Development Chair Norman reported the Planning and Community Development Committee met April 22, 2008. The Committee discussed the status of State Route 18 signage for Auburn's city center, Ordinance No. 6173 relating to two-hour parking zones, Resolution No. 4328 approving a Transportation Improvement Board grant, Resolution No. 4340 approving a Public Works Trust Fund Loan, the workings of a public development authority, Resolution No. 4315 approving a Design Agreement with the Army Corps of Engineers for Mill Creek Restoration, and an Agreement for Services with Tetra Tech for the 15th Street culvert enhancement project. The next regular meeting of the Planning and Community Development Committee is scheduled for May 12, 2008 at 5:00 p.m. C. Public Works Chair Wagner reported the Public Works Committee met this afternoon at 3:30. The Committee approved right-of-way use permits for Petpalooza and Holy Family Church and contract administration items related to the Olympic Middle School Pedestrian Project, the 2008 Local Street Pavement Preservation Project, and traffic data collection. The Committee recommended approval of Ordinance No. 6173 regarding two-hour parking zones on West Main Street, Resolution No. 4335 approving an Interlocal Agreement with City of Pacific regarding sewer service area boundaries, and Resolution No. 4350 approving a license agreement with MCI Communications. The Committee also discussed traffic impact fees and Resolution No. 4349 relating to a Purchase and Sale Agreement with Lee Fields. The next regular meeting of the Public Works Committee is scheduled for May 19, 2008 at 3:30 p.m. D. Finance Chair Backus reported the Finance Committee met this evening at 6:30. The Committee approved consent items comprised of claims and payroll vouchers and a contract with Tetra Tech, Inc. for the 15th Street Culvert Enhancement Project. The Committee recommended approval of Resolution No. 4315 authorizing a design agreement with the Army Corps of Engineers and Resolution Nos. 4348 and 4349 approving Purchase and Sale Agreements. The Committee also discussed Resolution No. 4345 Page 5 City of Auburn Council Meeting Minutes May 5, 2008 approving an Interlocal Agreement with City of Pacific regarding sewer service areas and Resolution No. 4350 regarding an agreement with MCI Communications. The next regular meeting of the Finance Committee is scheduled for May 19, 2008 at 6:30 p.m. E. Community Center Chair Wagner reported the Community Center Committee met April 24, 2008. The Committee discussed the budget for the Community Center construction and LEED certification. Chair Wagner announced that an open house will be held Thursday, May 8 at 6:00 p.m. at the Parks, Arts and Recreation Building to provide information and receive comments on the proposed Community Center building and site concept design. The next meetings of the Community Center Committee are scheduled for May 7 and 12, 2008. F. Downtown Redevelopment Chair Norman reported that the next regular meeting of the Downtown Redevelopment meeting is scheduled for May 13, 2008 at 3:30 p.m. IV. REPORTS At this time the Mayor and City Council may report on significant items associated with their appointed positions on state, regional and local organizations. A. From the Council Mayor Pro Tern Singer reported on her attendance at the Puget Sound Regional Council General Assembly meeting and her re- election as President of the Puget Sound Regional Council. Councilmember Backus reported that she and Councilmember Norman attended a National League of Cities Leadership Training Institute conference on economic development. Councilmember Peloza reported on his attendance at meetings of the King County Pollution Abatement Advisory Committee and the Regional Water Quality Committee. Additionally, Councilmember Peloza attended the flag transfer ceremony at the new Veterans Building. Councilmember Haugen congratulated Gildo Rey and Pioneer Elementary Schools on receiving state grant funds for implementation of new lunch programs. Claims Claims check numbers 373596 through 374040 in the amount of $2,166,281.74 and a wire transfer in the amount of $4,389.84 and dated May 5, 2008. 2. Payroll Payroll check numbers 523142 to 523273 in the amount of $353,333.88 and electronic deposit transmissions in the amount of $1,110,751.50 for a grand total of $1,464,085.38 for the pay period covering April 17, 2008 to April 30, 2008. C. Contract Administration 1. Professional Services Contract No. 08-09 03.4.1.17 City Council approve an Agreement for Professional Services Contract No. 08-09 with Tetra Tech, Inc. for professional services related to the 15th Street Culvert Enhancement project. 2. Public Works Project Number CP0759 04.12.1 CP0759 City Council grant permission to advertise for bids for Project No. CP0759, Olympic Middle School Pedestrian Improvements. 3. Public Works Project Number CP0808 04.9.1 CP0808 City Council grant permission to advertise for bids for Project No. CP0808, 2008 Local Street Pavement Preservation project. Public Works Service Agreement AG-S-020 A3.16.9, 04.10 City Council grant permission to enter into Service Agreement No. AG-S-020 with Trafficount, Inc. for the City's annual traffic count program. Mayor Pro Tern Singer moved and Councilmember Wagner seconded to approve the Consent Agenda. MOTION CARRIED UNANIMOUSLY. 7-0. VI. UNFINISHED BUSINESS There was no unfinished business. VII. NEW BUSINESS There was no new business. VIII. ORDINANCES AND RESOLUTIONS A. Ordinances 1. Ordinance No. 6173 01.2 An Ordinance of the City Council of the City of Auburn, Washington, amending Section 10.36.390 of the Auburn City Code relating to creating a two-hour parking zone on West Main Street and F Street NW Councilmember Wagner moved and Councilmember Cerino seconded to introduce and adopt Ordinance No. 6173. MOTION CARRIED UNANIMOUSLY. 7-0. 2. Ordinance No. 6175 03.6 An Ordinance of the City Council of the City of Auburn, Washington, approving a Major Amendment to the Lakeland Hills South Planned Unit Development (PUD) Final Development Plan Councilmember Norman moved and Councilmember Backus seconded to introduce and adopt Ordinance No. 6175. Ordinance No. 6176 03.8 REZ08-0001 An Ordinance of the City Council of the City of Auburn, Washington, approving a newly added portion of the Lakeland Hills South Planned Unit Development to be rezoned from R-1 Single Family Residential to Planned Unit Development (PUD) District Light Commercial - Lakeland Hills South Special Plan Area Councilmember Norman moved and Councilmember Backus seconded to introduce and adopt Ordinance No. 6176. MOTION CARRIED. 6-1. Councilmember Haugen voted no. B. Resolutions 1. Resolution No. 4315 03.4.1.17, 04.11, F5.4 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk to execute an Interlocal Agreement between the City of Auburn and the Department of The Army for design of the Mill Creek Restoration Project Councilmember Backus moved and Mayor Pro Tem Singer seconded to adopt Resolution No. 4315. MOTION CARRIED UNANIMOUSLY. 7-0. 2. Resolution No. 4328 F5.2.15, 04.9.1 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor to accept a grant in the amount of Three Million Dollars ($3,000,000) from the Transportation Improvement Board for the design and construction of West Valley Highway Improvements Page 9 City of Auburn Council Meeting Minutes May 5, 2008 Councilmember Wagner moved and Councilmember Cerino seconded to adopt Resolution No. 4328. MOTION CARRIED UNANIMOUSLY. 7-0. 3. Resolution No. 4335 04.6.1 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk to execute an Interlocal Agreement establishing sanitary sewer service boundaries between the City of Auburn and the City of Pacific Councilmember Wagner moved and Councilmember Cerino seconded to adopt Resolution No. 4335. MOTION CARRIED UNANIMOUSLY. 7-0. 4. Resolution No. 4340 04.9.1 CP0611, F5.2.17 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor to execute a Public Works Trust Fund Loan Agreement between the City of Auburn (The City) and the Public Works Board (The Board for Project No. CP0611, M Street NE/Harvey Road & 8t Street NE Improvements Councilmember Wagner moved and Councilmember Cerino seconded to adopt Resolution No. 4340. MOTION CARRIED. 6-1. Councilmember Haugen voted no. 5. Resolution No. 4348 A3.13.4 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk to execute a Purchase and Sale Agreement between the City of Auburn and Eric A. Resolution No. 4350 03.10.9 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk to execute an agreement between the City of Auburn and MClmetro Access Transmission Services for a license to use the City of Auburn's conduits Councilmember Wagner moved and Councilmember Cerino seconded to adopt Resolution No. 4350.
