Background Summary:
The King County Flood Control Zone District is asking for a permanent easement for the Stuck River
Drive revetment repair project to cover construction and repair activities associated with this summer's
project as well as future maintenance and operations. Many of the Districts flood protection facilities,
including Stuck River Drive, do not have existing flood protection easements. Flood protection easements
are an important element of the District's facility repair projects, since an easement grants the District the
necessary access rights to perform operations and maintenance of the facility in perpetuity, and describes
the Districts responsibilities for restoration, damages, locks/gates (as needed), special notifications to the
land owner for activities related to O&M, and any other specific requirements the landowner may have.
This is a way of protecting both parties by laying out the lessee's responsibilities in the agreement and
ensuring that the District will have perpetual access rights (within the limits of the agreement) if the land at
some future date is transferred to another party. Though transfer of this land is probably unlikely here
since Auburn's trail follows the top of the bank, the need to obtain easements on all current and future
facility repair projects has been emphasized, especially as the District becomes more involved in
partnering with other agencies, including FEMA and the Corps o Engineers, where adequate easements
and access rights are closely scrutinized.
The 2008 summer project will include repairing approximately 520 feet of embankment and toe scour
along the Stuck River Drive revetment which protects the Parks Trail along the left (south) bank of the
White River, immediately upstream of the "R" Street Bridge. A short section of the trail (approximately
150 feet) is proposed to be moved landward approximately three to five feet in order to rebuild this
section of the revetment at a more stable 2:1 overall slope. There is room to do this and avoid utilities.
King County is will apply for permits associated with clearing and grading, shoreline, right of way use and
a pedestrian plan for trail users is part of the design drawings. King County will be doing the work using
solely County resources.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
AUBURN, WASHINGTON, AUTHORIZING THE MAYOR
AND CITY CLERK TO EXECUTE A FLOOD CONTROL
EASEMENT FOR THE KING COUNTY FLOOD CONTROL
ZONE DISTRICT
WHEREAS, the King County Flood Control Zone District ("District") has a
flood protection revetment located on City property along the south bank of the
White River, adjacent to Stuck River Drive ("Stuck River Drive Revetment"); and
WHEREAS, the District currently has no easement to access the Stuck
River Drive Revetment; and
WHEREAS, the District plans to repair the existing Stuck River Drive
Revetment this summer and to construct new facilities to enhance the
revetment; and
WHEREAS, the City Council finds that the District's construction and
repair project, as well as the District's future maintenance and repair of the
Stuck River Drive Revetment, is in the best interest of the citizens of Auburn;
and
WHEREAS, such activities require that the District have access to the
Stuck River Drive Revetment.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
KING COUNTY, WASHINGTON, HEREBY RESOLVES as follows:
Section 1. The Mayor is hereby authorized to execute the Flood
Control Protection Easement for the benefit of the King County Flood Control
District, a copy of which is attached hereto, marked as Exhibit "A" and
incorporated herein by this reference.
Section 2. The Mayor is hereby authorized to implement such
administrative procedures as may be necessary to carry out the directives of
this legislation.
Section 3. This resolution shall be in full force and effect upon
passage and signatures hereon.
