City Council to conduct a public hearing on whether or not to disestablish the Auburn Central Business
District Parking and Business Improvement Area.
Background Summary:
This issue is discretionary so no resolution or ordinance necessarily needs to be prepared at this point,
and if the City council were to decide that it wants to disestablish the BIA, it would or could include
language that says "and staff is hereby directed to put together the language of the legislative act that
would result in the disestablishment." However, because the City Council in its own discretion may
choose to not disestablish the BIA it wasn't clear what preliminary action staff should anticipate. As the
agenda bill for resolution 4365 (setting the public hearing for the City Council to consider whether or not it
wishes to disestablish the BIA) indicates that this is a discretionary act, no action is called for, if the
council wishes to take no action. If the council wishes, however, to disestablish the BIA, it might be
appropriate for the city council to direct staff in whatever motion it takes following the public hearing to
direct that the appropriate action be reduced to paper.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF AUBURN, WASHINGTON, SETTING A
PUBLIC HEARING TO CONSIDER WHETHER OR
NOT TO DISESTABLISH THE AUBURN CENTRAL
BUSINESS DISTRICT PARKING AND BUSINESS
IMPROVEMENT AREA, FOLLOWING RECEIPT OF
A PETITION REQUESTING DISESTABLISHMENT
WHEREAS, on July 5, 1988, the City Council established, through
Ordinance No. 4293, the Auburn Central Business District Parking and Business
Improvement Area; and
WHEREAS, the provisions of said ordinance, specifically Section 2,
paragraph 8 of Ordinance No. 4293, were amended by Ordinance No. 6097,
adopted on the 21st day of May, 2007; and
WHEREAS, the City has recently received requests for the
disestablishment of the Auburn Central Business District Parking and Business
Improvement Area and, pursuant to the provisions of RCW 35.87A.180, the City
Council shall hold a public hearing for consideration of such disestablishment.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
HEREBY RESOLVES as follows:
Section 1. That a public hearing to consider whether or not the City
Council should disestablish the Auburn Central Business District Parking and
Business Improvement Area as initially established by Ordinance No. 4293 and
amended by Ordinance No. 6097, shall be scheduled for 7:30 p.m., or as soon
thereafter as the matter may be heard, on the 4th day of August, 2008, at the
Resolution No. 4365

98001.
Section 2. That the Mayor is authorized to implement such
administrative procedures as may be necessary to carry out the directives of this
legislation.
Section 3. That this Resolution shall take effect and be in full force
upon passage and signatures hereon.

RE: Dissolution of Business Improvement Area (BIA)
Dear Mayor Lewis:
I have been requested by business owners to advise on the dissolution of the Business
Improvement District (BIA). I have undertaken this pro bono to assist my neighbors.
Enclosed you will find a copy of the Petition to City of Auburn for Dissolution of Business
Improvement Area (BIA). This petition contains the name of the business owner, their address,
telephone number and signature.
From the information provided me the person that circulated the Petition was able to obtain
signatures from every business visited except one. That business wanted to think about it.
Therefore, in accordance with RCW 35.87A.180 we request that the City Council disestablish by
ordinance. The condition precedent to the ordinance is a resolution of intention to disestablish.
An additional concern has been the increase in the amount of assessment. The assessment
increased significantly approximately 2 years ago. The statute provides at RCW 35.87A.140 a
methodology to change the rate of assessment. That procedure calls for a hearing. Many of
the people that approached me indicated that they had no knowledge of a hearing.
By copy of this correspondence I am alerting City Attorney Dan Held to the issue so he may
review so I may respond to the local businesses.

I have owned Curves in downtown Auburn for 6.5 years. I have been paying dues to ADA every year.
Last year my dues tripled, I now pay almost $500.00 per year. What does my money get used for?
I think ADA should send an annual report to all members of the ADA telling us how much money is
taken in and where it is all spent each year. If ADA was more accountable to it's merchants maybe
it wouldn't have the complaints it does.
I was surprised Friday morning when I came to work and saw Main Street closed for the ADA annual
sidewalk sale. Where was my notice that it was going to happen? I have participated in this event every
year. It was not on the Auburn Community Calendar either. I also have not received any notice about
Good of Days. I have to say, this year I do resent being required to pay this fee to ADA. Where is the
obligation the City of Auburn and ADA has to it's merchants?
I read in the Auburn Reporter about ADA losing Debbie Luce last August and it says it can't afford to
replace her, did she work for FREE? I can't quite imagine that. Why isn't her salary for this job good
enough for a replacemant? Why hasn't the Vice President taken over for her until a replacement is
found? Isn't that why there is a President and a Vice President, so the VP can take over if the President
becomes unable to perform. For the BIG sidewalk sale it looked like the VP took over for Debbie in the
planning and in notifying his immediate neighbors, only 5 or 6 businesses out of 300 to participate is
very sad. I say BIG jokingly because that's exactly what Auburn's 2008 sidewalk sale was, a BIG JOKE!
It would have been better for Auburn's image to not have that sale at all. 1 can't believe the City of Auburn
and Police Department closed streets for this private non-event. I do believe ADA has definately failed its
merchants.
1 feel the best solution at this time is to dissolve the ADA, and refund 2008 fees. Let the ADA be reborn
at a later date after Auburn does something with downtown besides turning it into a ghost town with all
the empty buildings. Rebirth at the right time should be met with new ideas and enthusiasm.
I regret that I won't be able to attend the meeting about ADA, but a preplanned trip will have me out of
town from July 26 thru August 10. Therefore, this letter is so my voice will be heard.

BY DIRECTION OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON,
NOTICE IS HEREBY GIVEN that a public hearing will be held before the Auburn City Council
at 7:30 p.m., Monday, August 4, 2005, in the City Hall Council Chambers located at 25 West
Main Street, Auburn, Washington, to consider whether or not to disestablish the Auburn
Central Business District Parking and Business Improvement Area.
Any interested person is invited to appear and express their views regarding the matter,
Non-English speaking residents wishing to review documents pertaining to the request should
contact the City of Auburn City Clerk's Office at (253)931-3039. Citizens with speech, sight or
hearing disabilities wishing to review documents should contact the City of Auburn within 10
calendar days prior to the Council meeting, as to the type of service or equipment needed.
Each request will be considered individually according to the type of request, the availability of
resources and the financial ability of the City to provide the requested services or equipment.
