Background Summary: Mountain View Cemetery has consistently tried to meet the needs of citizens in making pre-need arrangements for interments as well as those made following a death. Currently City Code states that a person desiring to reserve grave space, a niche or a crypt may do so by paying a non-refundable fee amounting to a minimum of 10 per cent of the space cost. This deposit amount can be applied to the total purchase price if paid in full within 60 days, or where contract terms are entered into. Twelve percent per year interest is charged on any outstanding contract balances up to two years. We have seen a steady decline over past years in clientele using this option. There are so many credit programs available for family at this time that we propose to allow families to hold property for a maximum of 30 days with no money down. The new cemetery software currently being considered for use at our office would be more expensive because of the need to track property for which we have a contract, and does not work with the City's Finance Department computer tracking system. Staff requests that you agree with changes in code as stated in Ordinance 6180 to allow citizens to reserve property for 30 days at no cost. Information Services Action: Committee Approval: ?Yes ?No Council Approval: ?Yes ?No Call for Public Hearing Referred to Until Tabled Until Councilmember: Norman Staff: Faber Meeting Date: September 15, 2008 Item Number: VIII.A.2 AUBURN *MORE THAN YOU IMAGINED ORDINANCE NO. 6 1 8 9 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, AMENDING SECTION 2.72.100 OF THE AUBURN CITY CODE RELATING .TO RESERVATION OF GRAVE SPACE WHEREAS, in connection with the municipal functions and operations of the City of Auburn, the City provides various services including cemetery grave and niche spaces; and WHEREAS, the Cemetery Board and staff recommend that the rules and regulations for reservation of grave space be amended to reflect a more streamlined business practice. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Amendment to City Code. That Section 2.72.100 of the Auburn City Code be and the same hereby is amended to read as follows: Section 2.72.100 RESERVATION OF GRAVE SPACE. Said GentFaGt shall be with terms up te The cemetery staff will hold a specific grave or niche for thirty (30) days for pending purchase. There will be no charge for the service. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directions of this legislation. Ordinance No. 6189 July 22, 2008 Page 1 Section 3. Severability. The provisions of this ordinance are declared to be separate and severable. The invalidity of any clause, sentence, paragraph, subdivision, section or portion of this ordinance, or the invalidity of the application thereof to any person or circumstance shall not affect the validity of the remainder of this ordinance, or the validity of its application to other persons or circumstances. Section 4. Effective date. This Ordinance shall take effect and be in force five days from and after its passage, approval and publication as provided by law.
